Supreme Court declines to hear appeal from Christian fire chief who wanted to make it easier to sue for discrimination
Ronald Hittle, a 24-year veteran of the fire department in Stockton, California, said he was fired after attending a two-day Christian conference on city time. The city countered that Hittle had been instructed to attend a 'leadership' conference and told the high court in a brief that the chief had a long history of disobeying direction from superiors.
Two conservative justices – Clarence Thomas and Neil Gorsuch – dissented from the decision to deny the case.
Represented in part by the First Liberty Institute, which has filed several successful religious claims at the Supreme Court in recent years, Hittle asked the Supreme Court to toss out a 1973 precedent, McDonnell Douglas Corp. v. Green, that has for decades dictated how discrimination claims are reviewed in federal courts.
Thomas wrote the precedent targeted by the case was 'producing troubling outcomes on the ground.'
'I am not aware of many precedents that have caused more confusion than this one,' he added.
Discrimination claims are reviewed under a three-step process under the precedent. First, an employee alleging discrimination must show they belong to a class of people protected under the law — based on race or sex, for instance — and that the company appeared, at first impression, to have engaged in discrimination. In step two, the employer must then show that it had legitimate, non-discriminatory reasons for the actions it took against the plaintiff.
In the third step, the burden shifts back to the employee to show that the company's stated reasons aren't simply a pretext for discrimination. Hittle asked the court to toss out McDonnell entirely or, alternatively, make it easier for employees to win under the third step.
'The court should take the opportunity to overrule this unworkable and egregiously wrong test without further delay,' Hittle's attorneys told the Supreme Court. The approach, they said, 'has rightly been criticized by judges and scholars alike.'
A federal district court in California sided with the city and the 9th US Circuit Court of Appeals affirmed that decision. Hittle appealed to the Supreme Court in October.

Bernie Sanders calls out Kamala Harris' campaign for being 'heavily influenced by wealthy people'
Sen. Bernie Sanders, I-Vt., called out former Vice President Kamala Harris and her campaign on Sunday for being influenced by wealthy people in 2024 and failing to speak to working families. CNN's "State of the Union" host Dana Bash pressed Sanders on a statement he made on one of his "Fighting Oligarchy" tour stops about the former vice president. Bash played a clip of Sanders telling the crowd, "One of the reasons, in my view, that Kamala Harris lost this election is she had too many billionaires telling her not to speak up for the working-class of this country." The CNN host reacted to the clip and said, "ouch." Clarence Thomas's Wish for Same-Sex Marriage Is About to Come True
Same-sex marriage could soon be back on the Supreme Court docket. Kim Davis, the Kentucky county clerk who was jailed in 2015 for refusing to issue same-sex marriage licenses, is appealing her case. Davis is appealing a $100,000 jury verdict for emotional damages plus $260,000 for attorneys' fees, reported ABC News Monday. In a petition filed last month, Davis claimed that her First Amendment rights protecting her religious freedom effectively immunized her from repercussions for denying the licenses. 'The mistake must be corrected,' Davis's attorney Mathew Staver argued in the petition, further condemning Justice Anthony Kennedy's majority opinion in Obergefell v. Hodges as 'legal fiction.' 'This court should revisit and reverse Obergefell for the same reasons articulated in Dobbs v. Jackson Women's Health Center,' reads one titled portion, under which Staver claims that 'Obergefell was wrong when it was decided and it is wrong today because it was grounded entirely on the legal fiction of substantive due process.' Staver's argument alluded to Justice Clarence Thomas's concurring opinion in Dobbs, which overturned the nationwide right to abortion established in Roe v. Wade. In his 2022 opinion, Thomas argued that the court 'should reconsider' its substantive due process precedents, including contraception, same-sex marriage, and even same-sex relationships. Davis served six days in jail for refusing to issue the licenses. Her appeal marks the first time that the nation's highest judiciary has been formally asked to reconsider the landmark decision. 'If there ever was a case of exceptional importance,' Staver wrote, 'the first individual in the Republic's history who was jailed for following her religious convictions regarding the historic definition of marriage, this should be it.' Gay marriage was effectively legalized in 2015, when the Supreme Court ruled in Obergefell that keeping marriage licenses from same-sex couples was discriminatory. The decision mandated that all states issue licenses to gay and lesbian couples, and required states to recognize marriages performed in other jurisdictions, as well. Marriage equality was further protected at the federal level in 2022, when the Respect for Marriage Act became law, requiring all 50 states to recognize same-sex marriages performed in other states. It did not, however, formally legalize gay marriage, so if the Supreme Court were to take up Davis's case and overturn Obergefell, gay marriage rights would fall with it. Roughly 69 percent of Americans support same-sex marriages, according to a 2024 Gallup poll.
