Transparency in banking vital to combat fraud, build trust, says legal expert

KUALA LUMPUR: Consistent and transparent disclosure of internal compliance information by banks—particularly in cases involving suspicious cross-border remittances—is key to boosting corporate confidence in Malaysia's financial system, said legal expert Datuk J. Shamesh.
He said pre-action discovery mechanisms, increasingly recognised by Malaysian courts, are playing a pivotal role in compelling financial institutions to disclose crucial documents that could help uncover fraudulent transactions.
"Legal tools such as the Norwich Pharmacal relief and Order 24 Rule 7A of the Rules of Court 2012 allow aggrieved parties to seek access to a bank's internal documents—even before initiating formal legal proceedings—especially in cases involving potential fraud, money laundering or questionable transfers," said Shamesh.
Speaking to Bernama, the lawyer also highlighted that while these tools are not intended to implicate the bank, they enable access to records that may assist in identifying wrongdoers or enforcing legal rights.
The corporate lawyer cited the case of First Malaysia Finance Bhd v Dato' Mohd Fathi Haji Ahmad [1993] 3 CLJ 329, in which the court endorsed the Norwich Pharmacal principle, ruling that a third party, such as a bank, can be ordered to disclose information if it is innocently mixed up in potential wrongdoing.
Shamesh explained that this decision confirms that compliance records, anti-money laundering (AML) frameworks, internal alerts, and audit trails can be disclosed when legitimate legal interests are at stake.
He further noted that courts may issue disclosure orders when there is evidence of fraud, financial misconduct, the use of third-party accounts for illicit fund transfers, suspected breaches of internal compliance policies, or money laundering activities involving cross-border transactions.
"These disclosures are especially important when doubts arise about a bank's internal controls or when red flags are raised during due diligence," he added.
Shamesh stressed that consistent and transparent cooperation by banks in such proceedings could significantly strengthen trust among corporate clients.
"Corporates want assurance that financial institutions will support legitimate investigations and are not safe havens for questionable remittances," he said.
However, he cautioned that resistance or selective disclosure by banks could backfire, potentially undermining public and corporate confidence in the sector's commitment to transparency.
"If applied consistently, these disclosure practices not only reinforce governance and compliance standards but also send a strong message that banks are active partners in the fight against financial crime," he said.

Man Charged With 52 Sexual Offences Against Daughter In Melaka

MELAKA, Aug 12 (Bernama) -- An electrical goods technician was charged in the Ayer Keroh Sessions Court here today with 52 counts of committing incest, physical sexual assault and recording pornographic videos of his biological daughter since May. According to the charges, the 41-year-old man is accused of committing the offences at a house in Taman Tambak Paya Harmoni, Melaka Tengah, against his 18-year-old daughter between May 12 and Aug 6. When the charges were read before Judge Haderiah Siri, the accused pleaded not guilty to all counts. Of the total charges, 17 were framed under Section 376B of the Penal Code for committing incest, which carries imprisonment of not less than 10 years and up to 30 years, and whipping, if convicted. For the other 34 charges, the accused was charged under Sections 14(b) and 14(a) of the Sexual Offences Against Children Act (SOACA) 2017, read together with Section 16(1) of the same Act. The offences under those sections carry a penalty of imprisonment of up to 20 years and whipping, while Section 16(1) of SOACA 2017 provides for imprisonment not exceeding five years and a minimum of two strokes of the cane. One charge was also brought under Section 7 of SOACA 2017 for producing child pornography by recording two images of his daughter naked in a bathroom at the same location on July 9. If convicted, the accused faces imprisonment of up to 20 years and not less than five strokes of the cane. The prosecution, led by Muhamad Ehsan Nasarudin, proposed bail of RM20,000 for each charge with additional conditions including prohibition on contacting the victim and witnesses, reporting to the nearest police station every two weeks and surrendering his passport to the court.

BIMB Securities: Malaysia's 2Q GDP likely below 4.5% estimate

MALAYSIA'S economic growth in the second quarter of 2025 (2Q25) is expected to come in slightly below the Department of Statistics Malaysia's (DOSM) advance estimate of 4.5%, at around 4.3%, according to BIMB Securities Research. In its gross domestic product (GDP) preview, BIMB said the moderation reflects softer private consumption and slower export growth amid persistent global headwinds. Retail sales growth eased to 5% year-on-year – the weakest in six quarters – while export growth slowed to 3.5% from 4.4% in the previous quarter. Manufacturing output growth softened to 3.9% from 4.2%, with the sector's PMI staying below the 50-point mark at 48.9 in 2Q. Exports to China contracted by 4.4%, while growth to the US decelerated to 20.2% from 36.4% in 1Q. BIMB said investment momentum remained solid but is likely to moderate given global uncertainties, including potential US tariffs of up to 100% on semiconductor imports and varying levies on other major economies. Despite external risks, domestic demand is expected to provide some buffer, supported by government measures such as a one-off RM100 cash transfer to all Malaysian adults at end-August and the 25-basis-point cut in the overnight policy rate in July. 'While external uncertainties may weigh on the export-oriented sectors, domestic policy measures are expected to help sustain Malaysia's near-term growth momentum,' the research house said. — TMR
