Blake Lively makes shock move in Justin Baldoni legal battle

New York Post2 days ago

The twists and turns continue.
Blake Lively, 37, is trying to abandon her infliction of emotional distress claims against Justin Baldoni, according to new legal documents obtained by The Post.
Lively, who previously accused Baldoni, 41, of both intentional and negligent infliction of emotional distress in a December 2024 lawsuit, attempted to withdraw the allegations on Monday after Baldoni's legal team sought to obtain her medical records.

'Instead of complying with the Medical RFPs, Ms. Lively's counsel recently advised us, in writing, that Ms. Lively is withdrawing her IED Claims,' Baldoni's team responded in a filing viewed by The Post. 'However, Ms. Lively has refused the Wayfarer Parties' reasonable request that the withdrawal of such claims be with prejudice.'
'She is only willing to withdraw her claims without prejudice,' it continued. 'In other words, Ms. Lively wants to simultaneously: (a) refuse to disclose the information and documents needed to disprove that she suffered any emotional distress and/or that the Wayfarer Parties were the cause; and (b) maintain the right to re-file her IED Claims at an unknown time in this or some other court after the discovery window has closed.'
The filing, which was addressed to Judge Lewis Liman of the Southern District of New York and signed by Baldoni attorney Kevin Fritz, argued that Lively 'cannot have it both ways.'

'If Ms. Lively wants to withdraw her frivolous IED Claims, the Wayfarer Parties are entitled to a dismissal with prejudice to ensure they will not be re-filed,' the filing read.
'If Ms. Lively is unwilling to stipulate to the dismissal of her IED Claims with prejudice, then the Wayfarer Parties will continue to defend against them,' it added, 'and she must produce her medical information and documents as set forth herein.'
In December 2024, the former 'Gossip Girl' star accused Baldoni of sexually harassing her on the set of 'It Ends With Us' and then launched a 'coordinated effort to destroy her reputation.'

Lively's infliction of emotional distress claims against Baldoni were two of the allegations she waged against her 'It Ends With Us' co-star and director when she filed her lawsuit against him, Wayfarer Studios and others later that month.
She alleged that he caused her to suffer 'severe emotional distress and pain, humiliation, embarrassment, belittlement, frustration and mental anguish' in addition to lost wages.
But Baldoni and Wayfarer Studios' attorneys have argued that Lively 'waived any doctor-patient privilege' when she claimed to have suffered 'physical and emotional injuries' at the hands of Baldoni and the studio.

'By alleging that she suffered physical and emotional injuries, Ms. Lively has placed her physical and mental condition at issue and, in turn, must produce relevant information and documents,' Fritz wrote.
'In other words,' he added, 'Ms. Lively has waived any doctor-patient privilege.'
Judge Liman and the Southern District of New York must now decide whether Lively's infliction of emotional distress claims will be dismissed with or without prejudice or if the actress must turn over the mental health information sought by the opposing counsel.

'Once again, this is a routine part of the litigation process that is being used as a press stunt,' Lively's lawyers told TMZ on Monday. 'We are doing what trial lawyers do: preparing our case for trial by streamlining and focusing it; they are doing what they do: desperately seeking another tired round of tabloid coverage.'
'The Baldoni-Wayfarer strategy of filing retaliatory claims has exposed them to expansive new damages claims under California law, rendering certain of Ms. Lively's original claims no longer necessary,' they continued.
'Ms. Lively continues to allege emotional distress, as part of numerous other claims in her lawsuit, such as sexual harassment and retaliation, and massive additional compensatory damages on all of her claims,' the actress' attorneys concluded.

Baldoni has denied all of Lively's allegations against him. He also countersued Lively and her husband, Ryan Reynolds, 48, for $400 million in January for alleged defamation and extortion – accusations they have also denied.
A trial date is scheduled for March 2026.

Where Blake Lively and Taylor Swift stand after pop star was subpoenaed in messy Justin Baldoni lawsuit: report

There's bad blood between Blake Lively and Taylor Swift amid the actress's lawsuit with Justin Baldoni. 'Their friendship has halted,' a Swift insider reportedly told People Thursday. 'Taylor wants no part in this drama.' A separate insider pushed back on the notion that their friendship has come to a hard stop, however, telling the outlet that while Swift, 35, and Lively, 37, are 'taking some space,' they are 'not no longer friends.' Page Six reached out to reps for Lively and Swift, but did not immediately hear back. Lawyers for Baldoni and his Wayfarer Studios officially subpoenaed the 'Cruel Summer' songstress as a witness in Lively's sexual harassment case against her 'It Ends With Us' co-star on May 8. The trial is set to begin in March 2026, but Swift's legal team at Venable is fighting the subpoena. On Wednesday, news emerged that Baldoni's attorneys accused Blake Lively's lawyers of threatening to release alleged texts between the longtime pals if the 'Blank Space' singer refused to publicly support the actress in the continuing legal battle. In docs obtained by Page Six on Thursday, Baldoni's attorneys alleged the 'Another Simple Favor' star's attorney Michael Gottlieb of Willkie Farr issued the demand to Venable. According to the filing, they specifically alleged that Gottlieb 'demanded that Ms. Swift release a statement of support for Ms. Lively, intimating that, if Ms. Swift refused to do so, private text messages of a personal nature in Ms. Lively's possession would be released.' The docs claimed that in the absence of compliance, the actress 'would release 'ten years' of private texts' between her and Swift. On Thursday, Page Six obtained documents further claiming that the mom of four asked Swift to 'delete their text messages' amid the bombshell case. Baldoni's lawyers also claimed a rep for the pop star 'addressed these inappropriate and apparently extortionate threats in at least one written communication transmitted to Mr. Gottlieb.' 'It is those communications that the Wayfarer parties seek to obtain by way of subpoena,' the docs continued. 'The [communications] would evidence an attempt to intimidate and coerce a percipient witness in this litigation.' In a statement to Page Six, Gottlieb 'unequivocally' denied the claims and slammed them as 'completely untethered from reality' and 'categorically false.' A judge subsequently ruled that the claims made by Baldoni and Wayfarer's teams are inadmissible in the case. A rep for the 'Don't Blame Me' singer, meanwhile, put Swift's subpoena on blast in a scathing statement to Page Six. 'Taylor Swift never set foot on the set of this movie, she was not involved in any casting or creative decisions, she did not score the film, she never saw an edit or made any notes on the film, she did not even see 'It Ends With Us' until weeks after its public release, and was traveling around the globe during 2023 and 2024 headlining the biggest tour in history,' the statement read. Lively apparently agrees, as her rep called Baldoni a 'bully' for his subpoena and stated that Baldoni and Wayfarer 'continue to turn a case of sexual harassment and retaliation into entertainment for the tabloids.' 'The defendants continue to publicly intimidate, bully, shame and attack women's rights and reputations,' Lively's rep said in part in a statement to Page Six on Saturday.

Taylor Swift and Blake Lively's friendship status revealed after Justin Baldoni drops subpoena amid ‘stressful' few weeks

Taylor Swift and Blake Lively are reportedly still not speaking despite Justin Baldoni dropping the pop superstar's subpoena amid his legal battle with his 'It Ends With Us' co-star. 'There's been radio silence between Taylor and Blake since the subpoena was dropped,' a source told Us Weekly Saturday. 'They won't pick up where they left off because of all the emotional residue.' Baldoni, 41, initially dragged Swift, 35, into his $400 defamation and extortion countersuit against Lively, 37, because he claimed the 'Gossip Girl' alum had leveraged her friendship with the famous singer to try and gain control of their 2024 film. He alleged in the complaint, obtained by Page Six, that Lively brought Swift and her husband, Ryan Reynolds — whom she affectionately referred to as her 'dragons' — to a meeting about script re-writes, making Baldoni feel 'pressured' to accept the changes his co-star wanted. 'The message could not have been clearer. Baldoni was not just dealing with Lively. He was also facing Lively's 'dragons,' two of the most influential and wealthy celebrities in the world, who were not afraid to make things very difficult for him,' the director's lawyer Bryan Freedman previously claimed. The countersuit was filed after Lively sued Baldoni for sexual harassment and other allegations. Swift was then officially subpoenaed earlier this month, prompting the 'Fortnight' singer's rep to adamantly deny their client was ever involved in any 'casting' or 'creative decisions' pertaining to the film. The legal drama immediately caused an even deeper rift between Swift and Lively, with a source telling People at the time the friendship 'has halted' and the 'Shake It Off' singer 'wants no part in this drama.'Baldoni's team then shockingly dropped Swift's subpoena just a few weeks later and an insider cryptically noted to Page Six at the time, 'When information is voluntarily received, there is no need for subpoenas.' Last week, a source claimed to the Daily Mail that the 'Lover' singer's dad, Scott Swift, had made a deal with Baldoni's lawyers and he 'voluntarily gave up' information in an effort to protect his daughter. Us Weekly's source added Saturday that Taylor is 'feeling an immense sense of relief' to be able to put the legal drama behind her, further noting, 'It's been a stressful few weeks for her and she seems happier and lighter since the subpoena was dropped.' The insider also recognized that the 'Blank Space' singer handled the entire situation with 'a lot of grace and is not solely focused on it,' concluding, 'She's moved on.' Taylor has much to celebrate lately, given that she recently bought back her masters. 'I've been bursting into tears of joy at random intervals ever since I found that this is really happening. I really get to say those words,' she wrote in part in a lengthy letter to her fans on her website Friday. Taylor was involved in a public feud with music manager Scooter Braun when he bought her masters for a reported $300 million dollars in 2019 — which she claimed he did without her permission. Then in 2020, Braun, 43, sold the recordings to Shamrock Capital, who just sold them back to the global superstar.

Taylor Swift's blunt reaction to Blake Lively's ‘groveling excuses' revealed after Justin Baldoni subpoena: report

Taylor Swift has reportedly been ghosting Blake Lively after being dragged into the actress's messy legal battle with Justin Baldoni. 'Even though Taylor has totally cut ties with her, Blake hasn't with Taylor,' an insider told the Daily Mail Tuesday. 'She's been reaching out to her with texts, voicemails and even emails, begging to mend what they once had. Blake isn't giving up on trying to get her friendship with Taylor back on track.' According to the source, Swift, 35, 'hasn't responded to any of Blake's pleas' and has 'ignored all her groveling excuses.' 'The missives explain there must be some misunderstanding on Taylor's part and that she'd never do anything to harm their 10 years of closeness and personal secrets,' the insider claimed. However, a separate source claimed to People that the duo were trying to get back 'on good terms,' though 'their friendship isn't the same as it was before.' 'Taylor is working to trust Blake again but it's going to take some time,' the insider claimed. Reps for the 'Lover' songstress and Lively, 37, weren't immediately available to Page Six for comment. The longtime besties are reportedly no longer on speaking terms after Swift was name-dropped in Baldoni's $400 million lawsuit against Lively and her husband, Ryan Reynolds. The 'Jane the Virgin' star, 41, alleged in the filing that Lively threatened him with Swift's influence to assert her control over their 2024 movie, 'It Ends With Us.' He claimed the 'Gossip Girl' alum referred to the 14-time Grammy winner and Reynolds as her 'dragons' who 'protect' her in battle after a meeting about script revisions. 'The message could not have been clearer. Baldoni was not just dealing with Lively. He was also facing Lively's 'dragons,' two of the most influential and wealthy celebrities in the world, who were not afraid to make things very difficult for him,' the lawsuit stated. As a result, Swift was subpoenaed last month to testify as a witness in the co-stars' upcoming March 2026 trial. Baldoni's legal team, however, dropped the subpoena weeks later. At the time, a source cryptically told Page Six of the matter, 'When information is voluntarily received, there is no need for subpoenas.' Baldoni filed his countersuit against Lively and Reynolds after she sued him for sexual harassment and retaliation last December. The 'Five Feet Apart' actor has denied the allegations against him.
