Dutch probe largest shipyard on corruption, sanctions charges

THE HAGUE: Dutch prosecutors said on Friday they had brought criminal charges against the country's largest shipbuilder, including in relation to breaking sanctions against Russia.
Based in Gorinchem near the port of Rotterdam, Damen Shipyards is being probed for bribery, forgery and money laundering, the Public Prosecutions Service (OM) said.
'This occurred in connection with the sale of ships abroad. In addition, the OM also summoned Damen for violating the Sanctions Act,' it said.
The second summons 'relates to violating sanctions imposed in response to the war between Russia and Ukraine', the OM added.
Prosecutors brought two separate cases against Damen -- the first into the alleged bribery in the sale of ships between 2006 and 2017.
The second was for selling goods and technology 'that could contribute to the military and technological strengthening of Russia' after Moscow's February 2022 invasion of Ukraine.
The first probe focused on alleged large commissions paid to agents used for selling ships to various countries in Africa, Asia and South America.
'Over a number of years, a large number of false documents have probably been drawn up in order to conceal the high commission payments to agents and to frustrate control of it, including in applications for export credit insurance,' the OM said.
In the second probe, Damen allegedly continued deliver goods and technology to Russia despite European Union sanctions against Moscow.
This investigation focused on the second half of 2022.
Damen responded by saying the OM's first probe 'mainly concerns suspicions of forgery, no longer mainly corruption'.
'Damen has assessed the file and concludes that the Public Prosecution Service does not have a feasible case,' it said.
'(The company) has always acted in accordance with the applicable sanctions packages and... full transparency has been exercised about its activities,' Damen added.
'The sanctions probe was a case involving the supply of a very limited number of civilian cranes to Russia. This delivery took place within the sanctions legislation in force at the time,' it said.
The company, which employs some 12,000 people and operates in 120 countries, said it 'foresees a long legal battle'.
Damen is the main shipbuilder for the Dutch navy, including its frigates, combat support ships and offshore patrol vessels.
The case is likely to start later this year with a court date still needed to be set.

KUALA LUMPUR: Once a title winner in the Netherlands and a Premier League regular, Ronnie Stam is now behind bars after being found guilty of drug smuggling on an industrial scale. According to SUN UK, the ex-Wigan Athletic defender, 41, was part of a gang plotting to flood the Netherlands with more than two tonnes of cocaine - a haul with a street value of £48.6million. Prosecutors had demanded 13 years, calling him a "major player" in the Dutch criminal underworld. But a court cleared him of two of the most serious charges and instead handed down a seven-year jail term. Stam was convicted of trafficking 724 kilos of cocaine and MDMA, and for possessing nitrous oxide or "laughing gas". He at first protested his innocence, insisting: "It was stupid to go along with those guys… but I had nothing to do with those big batches of cocaine and nothing to do with setting up lines." But he later admitted helping smuggle 20 kilos of cocaine from Brazil to Frankfurt - a consignment intercepted in Chile before reaching Rotterdam. Police, who had hacked an encrypted messaging service, swooped on six homes and a camper van, arresting Stam's parents, brother and girlfriend. Officers found £85,000 in cash and later ordered the ex-footballer to repay £1.47million in criminal profits. Stam's fall from grace is stark. A Dutch champion with Steve McClaren's FC Twente in 2010, he joined Wigan that summer, making 73 appearances before missing their 2013 FA Cup final triumph over Manchester City with a broken leg.

Amsterdam-headquartered Prosus, which is majority owned by South Africa's Naspers, announced the deal in February, banking on its artificial intelligence capability to boost Just Eat Takeaway, Europe's biggest meal delivery company. The European Commission, which acts as the EU competition enforcer, said Naspers offered to significantly reduce its 27.4% stake in Delivery Hero to below a specified very low percentage within 12 months, confirming a Reuters story. Naspers also pledged not to exercise the voting rights with its remaining limited stake in Delivery Hero and also not to increase its stake beyond the specified maximum level. It will not recommend or propose any person to Delivery Hero's management and supervisory boards. Prosus said the EU decision was the final regulatory approval needed to close the offer which ends on October 1 and that if all offer conditions including the acceptance threshold for the deal are met by that date, it will declare its offer unconditional within three business days. "Our ambition is clear: to build a true European tech champion and lead the next chapter in food delivery innovation," Prosus CEO Fabricio Bloisi said in a statement. EU antitrust chief Teresa Ribera said Naspers' concessions will preserve competition and consumer choice. "This decision also sends a clear warning to an industry with recent antitrust issues: we won't tolerate any anti-competitive behaviour that may harm consumers," she said. Delivery Hero and its Spanish unit Glovo were fined 329 million euros by the EU antitrust watchdog in June for taking part in a cartel which included an agreement to divide up markets among themselves and not to poach each other's employees. The deal would make Prosus the world's fourth-largest food delivery company after Meituan, DoorDash and Uber, according to ING analysts.
