EB-1 Visa: What is the 'Einstein visa' that agents are ‘guaranteeing'? Eligibility, categories — All you need to know

EB-1 visa: As the Donald Trump administration's crackdown on visas intensifies, attention is shifting to the EB-1 visa – with the category being touted as a suitable alternative to the H-1B visa, for those who meet the eligibility for the same. Although the EB-1 visa – colloquially known as the 'Einstein Visa' is reserved for people with 'extraordinary talent' — a report by The Print claims that a growing network of agents offering "guaranteed EB-1 visas" is flooding platforms like LinkedIn, Facebook, and Telegram. As per the report, agents are offering ghostwriting research papers, manufacturing acclaim— all of which give researchers an edge in their visa application. What is this EB-1 visa that everyone is talking about? What makes a person eligible? Livemint explains. Colloquially known as the 'Einstein Visa', the EB-1 category is reserved for people who are 'aliens of extraordinary ability', are 'outstanding professor or researchers'. Donald Trump often uses the term "alien" to refer to non-citizens, especially undocumented immigrants. His usage is typically in the context of border security, illegal immigration, and deportation policies. The EB-1 visa, meant for the people with 'extraordinary abilities' spans across the three categories, each having its respective set of 'evidence' that a person needs to prove: Extraordinary Ability Outstanding professors and researchers Certain multinational manager or executive EB-1 Category Who can apply Eligibility Extraordinary Ability Applicant must be able to demonstrate extraordinary ability in the sciences, arts, education, business, or athletics through sustained national or international acclaim Evidence of one-time achievement such as Pulitzer, Oscar is required, or evidence of 3 of the following: Receipt of lesser nationally/internationally known prizes or awards of excellence Articles or media coverage about applicant in prominent industry publications or major news outlets Documentation showing applicant was appointed to judge others' work, either independently or as part of a panel Evidence of original and significant contributions respective field Proof of authoring scholarly articles published in respected journals or major industry media Records showing work has been featured in notable exhibitions or public showcases Applicant has held a leading or essential role in reputable and distinguished organizations Documentation of high earnings or substantial compensation compared to others in the same profession Proof of commercial success in the performing arts Outstanding Professors and Researchers One must demonstrate international recognition for outstanding achievements in a particular academic field. Must have at least 3 years experience in teaching or research in that academic arena. Must be entering United States in order to pursue tenure or tenure track teaching or a comparable research position at a university, institution of higher education, or private employer. Applicant needs to meet two of the following criteria: Proof that you've received major awards or honors in recognition of your exceptional accomplishments Documentation of membership in professional associations that require notable achievements for entry Articles or publications written by others that discuss applicant's academic work in recognised journals or outlets Evidence of evaluating peers' works either independently or as part of a review panel, within your academic or related field Proof of original and impactful research or scientific contributions to the applicant's discipline Documentation showing the person has authored scholarly books or articles published in internationally circulated academic journals Certain Multinational manager or executive Must have been doing business for at least 1 year, and have a qualifying relationship to the entity the person worked for outside the US, and intend to employ you in a managerial or executive capacity. Employer must be a US employer and intends to employ the person in a managerial or executive capacity. For those applying under the Extraordinary Ability category, you need to apply yourself by filing a Form I-140, Petition for Alien Worker, states the USCIS. For the Outstanding Professors and Researchers category, the US employer is required to fill Form I-140, Petition for Alien Worker. As part of the application process, the employer is also required to demonstrate a continuing ability to pay the offered wage such as annual report, or federal income tax returns. For Multinational Manager or Executive, the US employer is required to file USCIS Form I-140, Petition for Alien Worker. The employer must also be able to demonstrate a continuing ability to pay the offered wage, as in the case of Outstanding Professors and Researchers. Although the criteria for EB-1 visa is slightly more demanding than the H-1B visa, the program is a standard means of acquiring a green card to be a US resident. With the tightening visa rules, the EB-1 visa provides a suitable alternative to H-1B visa for those who meet the required eligibility criteria.

ACC to TVS Motor -Jay Thakkar suggests three stocks to buy for short-term in F&O segment

Stock market news: Indian stock indices maintained an upward trend for the fourth consecutive session, bolstered by favorable global cues, relative calm regarding the Israel-Iran conflict, and the potential extension of the tariff deadline set for July 9 by the US government. A spokesperson from the White House suggested on Thursday that the reciprocal tariff deadline might be postponed, but emphasized that the final decision rests with President Donald Trump. Meanwhile, President Trump indicated that a "great deal" involving India is forthcoming, which has improved investor confidence. The Indian negotiation team is currently in the United States working on a trade agreement. India's robust domestic fundamentals, an agile RBI, and favorable monsoon conditions are supporting the financial markets. With US markets reaching record highs and the US dollar weakening, emerging markets such as India are expected to gain. The Sensex concluded the day at 84,058 points, rising by 303 points, while the Nifty 50 finished at 25,637 points, up by 89 points. Nifty 50 has provided a clean breakout from the sideways consolidation; thus, the short-term trend is bullish. The June series ended on a positive note as Nifty 50 closed above 25,300 levels and the FIIs also reduced their short positions on the Index to quite an extent i.e. from over 1 lakh to merely 35,000 contracts , they also had bought huge in the equity cash segment of over 12,500 crores. So, the short covering coupled with strong buying in equity cash segment led to a clean breakout and thus the uptrend has been established. There was strong call writing in the range of 25,200-25,300 prior to the breakout, hence this range now becomes an immediate support, whereas, 26,000 to 26,300 are the short to medium term targets. The Bank Nifty has also provided a clean breakout above 56,500 levels, thus the supporting Nifty 50 to inch higher. Jay Thakkar of ICICI Securities recommends TVS Motor Futures, Mahanagar Gas Futures, and ACC Futures. TVS Motor has provided a breakout from the sideways consolidation with a clear long built up, indicating further uptrend in the stock. The stock has been one of the outperformers in the two-wheeler segment and hence the upside probability seems higher. There has been good put additions at the lower levels as well as call unwinding indicating good upside possibility. Currently, the stock is trading above its max pain and modified max pain level as well as its 20-day VWAP levels, hence the short-term trend appears bullish Mahanagar Gas had seen huge short built in the previous fall post which the stock managed to bounced back and consolidate. In the entire consolidation period, the stock had witnessed short covering and finally it has provided a breakout from the consolidation which is much positive in the near term. The stock has now moved above its 20-day VWAP as well as its max pain and modified max pain levels, so the upside potential is higher. The cements sector is witnessing good long built up overall and in the case of ACC short covering is expected in the short term as the stock has formed multiple bottoms as well as the sector is in overall uptrend. Although there is higher call base at 1900 and 2000 strikes, however, there is good unwinding of calls below 1900 strike, hence the uptrend has a higher probability in the near term. The stock is also trading well above its 20-day VWAP now as well as its above max pain level. US Senate unveils revised Trump tax draft with plans to vote soon: Key details here

Senate Republicans have announced a revised $4.2 trillion tax cut package, moving closer to a vote as they aim to meet US President Donald Trump's July 4 deadline. The new draft reflects compromises designed to bridge differences within the Senate GOP, particularly regarding social safety programs such as Medicaid and how rapidly to phase out of renewable energy tax credits enacted under the Biden administration, according to a Bloomberg report. Increased SALT deduction: A tentative deal with House Republicans to raise the state and local tax (SALT) deduction cap from $10,000 to $40,000 for five years before snapping back to the $10,000 level. The new cap applies to 2025 and rises 1% in subsequent years. Rural Hospital Fund: To appease moderate Republicans concerned about Medicaid cuts, the bill proposes a new $25 billion rural hospital fund aimed at helping some Medicaid providers avoid cuts. Republican Senator Susan Collins of Maine, however, had demanded a $100 billion fund. Delayed Medicaid provider tax cap: A critical win for the Moderate Republicans is the delay of a new 3.5% cap on state Medicaid provider taxes. This cap, which impacts how states can boost their federal Medicaid reimbursement rates, will take effect in 2032 instead of 2031. Extended Hydrogen production tax credit: In the new bill, the phase-out of a tax credit for hydrogen production has been extended from 2025 to 2028 for projects that begin construction before that year. Republicans plan to start voting on the tax bill on Saturday with final votes coming as soon as early Sunday. Party leaders plan to bring House members back to Washington early next week for what they hope will be final approval of the measure in time for Trump's Independence Day deadline. However, it remains uncertain whether the 50 Senate Republicans required to pass the bill are all on board. The bill can be further altered on the Senate floor to secure the votes if needed. The House could also make more changes if Speaker Mike Johnson has trouble corralling votes for the measure. The measure would avert a US payment default as soon as August by raising the debt ceiling by $5 trillion, the news agency said.
