Fertiliser firms fined for price fixing

The Competition Commission of Pakistan (CCP) has cracked down on alleged collusion in the fertiliser sector, imposing Rs375 million in penalties for creating a monopoly and extracting billions from farmers. In response, the Fertiliser Manufacturers of Pakistan Advisory Council (FMPAC) has announced it will challenge the CCP order in court.
Interestingly, these fertiliser barons had previously refused to pay multi-billion rupee dues on account of the Gas Infrastructure Development Cess (GIDC), instead obtaining stay orders from the courts. They had collected billions from farmers but failed to deposit these funds in the national exchequer — a matter that remains unresolved.
The CCP, a watchdog for anti-competitive practices, launched a suo motu inquiry and imposed a penalty of Rs50 million on each of the six major urea manufacturers, along with a Rs75 million fine on FMPAC, totalling Rs375 million. The penalised companies include Fatima Fertiliser Limited, Fauji Fertiliser Company Limited, Fauji Fertiliser Bin Qasim Limited, Fatima Fertiliser Company Limited, Engro Fertiliser Company Limited, and Agritech Limited.
According to the CCP's findings, these firms, in coordination with their trade association FMPAC, ran an 'awareness campaign' that effectively amounted to fixing urea prices nationwide. The Bench, comprising Dr Kabir Ahmed Sidhu and Salam Amin, concluded that this activity violated Section 4 of the Competition Act, 2010.
While the manufacturers claimed to be setting prices independently, they failed to justify the remarkably synchronised pricing strategy. The CCP investigation revealed that the practice distorted competition and harmed farmers — particularly during the critical Rabi and Kharif seasons — by artificially inflating fertiliser prices and limiting market choices.
The companies' attempt to shield themselves under the 'state action doctrine' was also dismissed. The CCP Bench found no formal government directive, or compulsion, to justify their collusive behaviour. Instead, the firms exploited a government instruction about raising awareness among farmers regarding urea prices. They used this as cover to jointly announce uniform urea prices across the country. The bench held that such "actions, taken under the pretext of complying with government instructions, effectively undermined market dynamics and distorted competitive pricing mechanisms."
The CCP expressed concern that despite differences in input costs, economies of scale, market size, and gas prices, all six companies were selling a urea bag for the identical price of Rs1,768. The bench remarked that in a market where each company's production capacity and market share are publicly known, such coordinated disclosures cannot be viewed as incidental or competitively benign. Rather, the joint announcement amounted to overt collusion.
Repeated directives from the Fertiliser Review Committee (FRC) also went unheeded, with companies failing to address supply imbalances. Notably, the CCP had earlier warned fertiliser manufacturers and FMPAC in 2010, 2012, and 2014—warnings that did not lead to lasting change.
The CCP chairman reiterated that trade associations should not serve as platforms for sharing price-sensitive information or coordinating pricing strategies. The Commission reaffirmed its commitment to ensuring competitive markets, protecting consumer welfare, and holding violators accountable. In response to the CCP's order, FMPAC issued a statement asserting it had no role in pricing decisions. It clarified that it does not determine or coordinate the pricing of urea or any other fertiliser product. As a non-commercial advisory body, FMPAC claimed it has never engaged in price-setting activities, and any implication otherwise is factually incorrect.
FMPAC stated that the controversial advertisement was published under a formal directive from the federal government, communicated via the Fertiliser Review Committee (FRC).
During the FRC's meeting on November 25, 2021 — held amid concerns about urea hoarding and market manipulation — it was resolved to initiate a public awareness campaign. FMPAC was directed to publicise the prevailing market price, which had already been acknowledged during the proceedings.
FMPAC insisted that it acted in good faith to implement the government's directive, without involvement in setting or proposing the published price. The intent, it said, was to ensure transparency and protect farmers from exploitative practices — not to distort market dynamics.
FMPAC plans to contest the CCP's interpretation and pursue legal remedy through the appropriate appellate forum. The Council expressed confidence that a fair and comprehensive review would confirm its actions were lawful and transparent.

POL's operations in FY25 were hit by a surplus of gas in the country's network, which forced buyers to take less gas from its key fields in the Tal and Adhi blocks. With these curtailments cutting production and global oil prices averaging lower than last year, the company's quarterly revenues stayed under pressure.4QFY25 sales were down 18 percent year-on-year, reflecting double-digit declines in both oil and gas output and weaker realized prices. The biggest swing factor was exploration. POL booked Rs11 billion of exploration and prospecting expenses in FY25—about 6–7 times the prior year—largely due to a dry well recognized early in the year and higher seismic/geological spend across operated blocks. Finance costs rose and other income fell as market yields eased, further weighing on the bottom line. Despite these headwinds, operating costs for the full year declined, helping keep the gross margin intact. The E&P company announced a final dividend of Rs50 per share, taking the FY25 payout to Rs75 per share—still a double-digit yield even after the earnings drop. For FY26, three things will matter most for POL: first, how quickly the gas supply issues ease so production from fields can return to normal; second, where oil prices and the rupee-dollar rate go, since both directly affect revenues; and third, the results from upcoming exploration after the big spending in FY25. While analysts flag high reliance on the Tal and Adhi fields as risks, there could be upside from reserve updates other fields. With earnings now at a lower base, any boost in production or prices—along with steady exploration costs and normal taxes—could lift profits, and the strong dividend should continue to support investor returns.

FBR to suspend ‘uncooperative' sales taxpayer

ISLAMABAD: The Federal Board of Revenue (FBR) will suspend/ blacklist a sales taxpayer, who would refuse to allow access to its business premises for deputation of tax officers to monitor stocks, production/ clearances; etc., at manufacturing premises. According to the updated Sales Tax Rules 2006, where the Commissioner or Board has reasons to believe that the registered person is to be suspended or blacklisted, in order to ensure that the Large Taxpayer Offices (LTOs) and Regional Tax Offices (RTOs) follow a uniform policy for suspension and blacklisting of sales tax registered persons under section 21(2) of the Sales Tax Act and for subsequent proceedings in such cases, the following procedure shall be followed, namely:-Where a Commissioner, having jurisdiction, is satisfied that a registered person has issued fake invoices, evaded tax or committed tax fraud, registration of such person may be suspended by the Commissioner through the system, without prior notice, pending further inquiry. Sales tax payers: FBR to hold public hearings before action The basis for such satisfaction may inter alia include the following, namely: 1: Non-existence of the registered person at the given address. 2; Refusal to allow access to business premises under section 40B and 40C or refusal to furnish records under section 25 and 37 of the Sales Tax Act to an authorized Inland Revenue Officer. 3; Activity becomes five time more than sum of the capital and liabilities declared in the balance sheet. 4; Making more than 10 per cent purchases from or making 10 per cent supplies to other suspended person in the month of suspension, except suspension based in terms of clause B or value of above Rs50 million or whichever is higher. 5; Non-filing of sales tax returns for three consecutive months and null filing of sales tax returns for six consecutive months and committed any act which falls within the ambit of tax fraud, the FBR added. Workers' body alleges corruption in SESSI and WWBS

The Workers' Solidarity Committee (WSC) — a coalition of labour, human rights, and social organisations alongside progressive intellectuals — has strongly condemned what it described as an "assault on workers' rights," the legitimisation of lawlessness through the Sindh Labour Code. WSC alleged large-scale corruption within key social protection institutions, the Sindh Employees Social Security Institution (SESSI) and Sindh Workers Welfare Board (WWBS). Speaking at a press conference at the Karachi Press Club, prominent activists including Anees Haroon (National Commission on Human Rights), Dr Riaz Shaikh (SZABIST), Nasir Mansoor (NTUF), Gul Shar (Watan Dost Mazdoor Federation), Liaqat Sahi (Democratic Workers Union), Razzaq Memon (Port Workers Union), Qazi Khizar (HRCP), Tahir Khan (PFUJ), Zehra Khan (HBWWF), and labour leader Comrade Usman Baloch, accused the Sindh Labour Dept of shielding factory owners while failing to enforce labour laws. They claimed that the WWBS - which manages over Rs50 billion in workers' funds - has been run on an ad-hoc basis for months, violated procurement rules, purchased an expensive Clifton office inaccessible to workers, and misused billions on poorly executed repairs, non-mandated insurance schemes, and unapproved projects such as a Rs3 billion e-bike programme. They demanded full investigation into WWBS expenditures and reconstitution of its board, permanent appointments in all social protection institutions, registration of at least 3 million workers in SESSI per court orders.
