Drivers should be ‘very pessimistic' over car finance claims, say lawyers

Drivers should be 'very pessimistic' about getting any compensation for taking out a car loan after a landmark ruling by the Supreme Court, experts have warned.
Industry analysts also said on Friday that banks will 'breathe a sigh of relief' after the Supreme Court ruled they are not liable for hidden commission payments in car finance schemes.
Nevertheless, the financial watchdog has said it is still considering whether to launch a redress scheme for consumers who potentially receive compensation.
Lawyers have also indicated that some consumers should still consider pursuing their claims over 'unfair' treatment.

Two lenders, FirstRand Bank and Close Brothers, went to the UK's highest court to challenge a Court of Appeal ruling which found 'secret' commission payments paid by buyers to car dealers in agreements before 2021 without the motorist's fully informed consent were unlawful.
The ruling last year found three motorists, who all bought their cars before 2021, should receive compensation.
But in a decision on Friday, justices at the UK's highest court overturned the Court of Appeal, though some customers could still receive payouts by bringing claims under the Consumer Credit Act (CCA).
Lawyers for the lenders told the Supreme Court at a three-day hearing in April the decision was an 'egregious error', while the Financial Conduct Authority intervened in the case and claimed the ruling 'goes too far'.
However, the judges upheld a claim brought by one driver under the CCA that his relationship with the finance company had been 'unfair', awarding him the commission amount of £1,650.95 plus interest.
Lizzy Comley, chief operating officer of consumer law firm Slater and Gordon, said the ruling still reinforces the right of many consumers to pursue claims.

She said: 'This landmark ruling is positive news for the millions of people who have lost money due to the car finance mis-selling.
'The court confirmed that for years, consumers have potentially been unfairly overcharged on car finance agreements, and this ruling reinforces their right to pursue justice and recover the compensation they deserve.'
However, others have said that the ruling will make it harder for most claims.
Nicola Pangbourne, partner at Kennedys law firm, said: 'If I was a driver, I would be very pessimistic about getting compensation. There's now quite a few hurdles they've got to get through.'
Industry experts have suggested the ruling will be broadly seen as a success for lenders, who had been preparing for significant compensation payments.
Caroline Wayman, global head of financial Services at PA Consulting, said: 'Lenders will breathe a sigh of relief at the ruling, but it should still be a wake-up call for firms to scrutinise any large, undisclosed commissions in their business.
'Firms should ask themselves whether it still feels justifiable or could be considered unfair, particularly if they haven't disclosed commercial ties to the broker and it won't be enough to expect customers to have read and understood the fine print.'
On Friday, a spokesperson for the Financial Conduct Authority said after the ruling that it would confirm whether it will consult on any such scheme by 8am on Monday.
They said: 'We want to bring greater certainty for consumers, firms and investors as quickly as possible.'

Banking analysts at RBC said in a note that they expected the cost to come in at 11.5 billion pounds, but that scenario would still leave several banks under-provisioned and potentially needing to set aside more cash. Close Brothers, which had previously set aside 165 million pounds, also provided no update to its provision in a statement on Monday and said it looked forward to engaging with the FCA on its consultation. While claims management companies (CMCs) prepared for a bumper bonanza – their fees could have topped a third of the £44 billion claims bill – fate had other plans. Last October, the English Court of Appeal held that car sales firms couldn't lawfully receive commission from finance companies unless they had the customer's "fully informed consent". On Friday, the UK Supreme Court (UKSC) gave its ruling in the three linked appeal cases of Hopcraft, Johnson and Wrench. It decided car firms didn't owe their customers a fiduciary duty when arranging car finance. A fiduciary duty is a legal obligation to act in someone's best interests – like a trustee would owe to a beneficiary or a director owes to a company. The lack of a commission disclosure applied to almost all car finance agreements, so any claim based purely on that point is now lost. However, in the case of Johnson, an unfair relationship challenge was upheld under section 140A of the 1974 Consumer Credit Act. The UKSC said, 'the size of the commission paid by FirstRand (the lender) to the dealer was significant, amounting to 25 per cent of the advance of credit and 55 per cent of the total charge for credit (comprising interest and fees). The fact that the undisclosed commission was so high is a powerful indication that the relationship between Mr Johnson and FirstRand was unfair'. Car finance is a £40 billion per year business in the UK. Traditionally, most people would buy a car using a hire purchase (HP) or conditional sale agreement – both types of consumer credit where you own the car at the end of the agreement. After the financial crisis of 2008, personal contract purchase (PCP) grew to become the most popular form of credit to buy new and used cars in the UK. After an initial deposit, the monthly payments are lower than HP and after a few years you can either make a 'balloon payment' to own the car outright or swap the car for a new model. 83 per cent of car finance deals use PCP. Car dealers generally act as brokers for lending companies. Until January 2021, dealers were able to set the interest rate on loans within a low to high range – known as a discretionary commission arrangement (DCA). Their customers didn't know the car dealer would get a higher DCA if they persuaded you to accept a higher interest rate. This unethical conflict of interest was banned by the Financial Conduct Authority (FCA) in January 2021. But 40 per cent of car finance deals involved DCAs – the number of consumers with pre-January 2021 car finance who might have a valid claim runs into the millions. DCAs fall foul of the FCA's regulatory rules on fairness and transparency. The FCA is expected to announce a consultation on a 'redress scheme' under section 404 of the 2000 Financial Services and Markets Act by today. If this happens, the scheme will be free and easy to use. Millions of drivers could be owed a share of up to £18bn after the Financial Conduct Authority (FCA) announced it will consult on an industry-wide compensation scheme. Motorists could receive a pay-out after it emerged many motor finance firms were not complying with rules or the law by not providing customers with relevant information about commission paid by lenders to the car dealers who sold the loans, the FCA said. The authority estimates that most individuals will probably receive less than £950 in compensation. The final total cost of any compensation scheme is estimated to be between £9 billion and £18 billion, the FCA added. Consumer champion Martin Lewis said in a video posted to X that millions of people are likely to be due a share of up to £18 billion. He told Sky News the consultation is 'likely to mean 40% of people who got a car finance deal between 2007 and 2021 will be due some form of redress, likely to be hundreds not thousands of pounds'. The consultation will be launched by early October. If the compensation scheme goes ahead, the first payments should be made in 2026. It comes after Friday's ruling by the Supreme Court on cases in which the FCA had intervened. While some motor finance customers will not get compensation because in many cases commission payments were legal, the court ruled that in certain circumstances the failure to properly disclose commission arrangements could be unfair and therefore unlawful, the FCA added. People who have already complained do not need to do anything, the FCA said. Consumers who are concerned that they were not told about commission and think they may have paid too much to their motor finance lender have been urged to complain now. Consumers do not need to use a claims management company or law firm and doing so could cost them around 30% of any compensation paid, it added. To make an initial complaint, the FCA says people should get in touch with their lender or broker, then the provider should send an acknowledgement within eight weeks. Under the FCA's current rules, it will not have to send a final response until after December 4 2025. But as the FCA is consulting on a compensation scheme, the deadline may be extended. If customers are unhappy with their provider's response, they can then complain to the Financial Ombudsman Service, the FCA added. The authority will propose rules on how lenders should 'consistently, efficiently and fairly' decide whether someone is owed compensation and how much. It will monitor if firms are following the rules and act if they are not. Nikhil Rathi, chief executive of the FCA, said: 'It is clear that some firms have broken the law and our rules. It's fair for their customers to be compensated. 'We also want to ensure that the market, relied on by millions each year, can continue to work well and consumers can get a fair deal. 'Our aim is a compensation scheme that's fair and easy to participate in, so there's no need to use a claims management company or law firm. If you do, it will cost you a significant chunk of any money you get. 'It will take time to establish a scheme but we hope to start getting people any money they are owed next year.'
