Govt urged to take concrete action against bullying

PETALING JAYA: An NGO is calling for the government to take proactive measures to address the issue of bullying and enact an anti-bullying law.
Gerakan Gubal Akta Anti-Buli (GAB) chairman Wan Azliana Wan Adnan said: 'We sent a memorandum and a report about bullying back in 2022 and we were called by the Education Ministry to discuss the issue. We also had an MoU with universities but because of a lack of funding, all our efforts had to stop.'
Wan Azliana said this is why GAB is urging the government to introduce an anti-bullying law.
'The government needs to take action now before more bullying cases happen.'
She said according to Education Ministry statistics, bullying cases in schools continue to show an upward trend each year.
In 2022, a total of 7,360 bullying cases were reported among secondary school students. This number increased by 20% to 8,820 cases in 2023 and as of October 2024, 5,703 cases were recorded, involving 11,594 students.
The reported cases involved either physical bullying such as pushing or hitting, and threatening or verbal bullying, which includes insults, use of abusive language and mocking in front of peers.
Wan Azliana said the phenomenon of cyberbullying has also become increasingly complex and difficult to control as students use social media platforms such as WhatsApp, Instagram and TikTok to spread hate messages, embarrassing images or videos of bullying incidents.
A 2023 study by the Malaysian Communications and Multimedia Commission revealed that one in three secondary school students had experienced cyberbullying but more than half of them did not report the incidents due to fear of retaliation or a lack of trust in the school system.
'We urge the government to promptly enact an anti-bullying law as an umbrella law that covers all forms of bullying – physical, verbal, cyber, mental and any form of harassment.
'This Act must provide a clear definition of bullying and outline the rights and responsibilities of
all parties involved, including institutional administrators, perpetrators and victims.'
She said the Act's aim should not only be to educate and prevent bullying but also to ensure that justice is served, voices of the victims are heard and confidence in the legal system is strengthened.
Wan Azliana also said GAB would be starting a petition drive to gather support from the public for the introduction of the Act.

(Bernama pic) PETALING JAYA : The Kuala Lumpur High Court today ordered rapper Caprice to archive 31 allegedly defamatory posts about an entrepreneur from his Instagram account. Lawyer Abdul Hakeem Aiman said Justice Anand Ponnudurai made the ruling after allowing an ex parte ad interim injunction sought by Asyraf Khalid against Caprice, whose real name is Ariz Ramli, 39. 'All publications issued by the defendant (Caprice) relating to or referring to the plaintiff (Asyraf) must be archived starting today until the disposal of the inter parte injunction application, which will be heard on Sept 2,' Bernama quoted Hakeem as saying. He said Caprice has not yet filed a statement of defence. Asyraf, 33, filed the suit on Aug 4, claiming that Caprice had published 31 allegedly defamatory posts against him on his Instagram profile between July 30 and Aug 2. He said the defamatory posts involved a podcast where a personal trainer, Murad Zaidi, appeared. 'I invited Murad so that he could share his experience in running a gym and the challenges he faced,' he said. Asyraf claimed Caprice's posts subjected him to public ridicule, dragged his father, Khalid Mohamad Jiwa (better known as Datuk K), into the dispute and tarnished his family's reputation. Asyraf is seeking an injunction to stop Caprice and his associates from repeating or sharing the posts and their removal from social media within 24 hours of judgment. He is also seeking a public video apology on all of Caprice's platforms, as well as general damages, aggravated damages, costs and other relief deemed appropriate by the court.

Lawyer Abdul Hakeem Aiman, who represented Muhammad Asyraf, said Judge Datuk Anand Ponnudurai made the decision after allowing an application for an ex-parte ad-interim injunction in a suit filed by the stepson of Biduanita Negara, Datuk Seri Siti Nurhaliza Tarudin against Caprice, whose real name is Ariz Ramli, 39. "All publications issued by the defendant (Caprice) relating to or referring to the plaintiff (Asyraf) must be archived starting today until the disposal of the inter-parte injunction application which will be heard on Sept 2," the lawyer told the media after the ex-parte injunction hearing proceedings which took place in chambers. Meanwhile, Abdul Hakeem said that so far the defendant has not filed a statement of defence to respond to the suit. Muhammad Asyraf, 33, filed the suit on August 4, claiming that Caprice had published 31 allegedly defamatory posts against the plaintiff on his Instagram from July 30 to August 2. The plaintiff claimed that the defamatory posts, among other things, meant that the plaintiff was a disgrace for inviting Murad Zaidi, who was his personal trainer, on an Audio Siar (Podcast), simply to give the man a chance to defend himself via social media, while ignoring the injuries suffered by the victim due to the man's actions. "I invited Murad so that he could share his experience running a gym and the challenges he faced, as well as provide an explanation for Murad's statement via Instagram which denied all the allegations against him and his family," said Muhammad Asyraf in the suit. Muhammad Asyraf said the posting also meant that the plaintiff was the son of Datuk Seri Khalid Mohammad Jiwa or Dato K who is the husband of Siti Nurhaliza and in that capacity the plaintiff had abused money, power, influence and family ties to supposedly trap the defendant. According to him, although he had decided not to broadcast the full episode of Murad Zaidi as Caprice wanted, Caprice still continued to attack him. He said Caprice's reckless and irresponsible actions had caused the plaintiff to be insulted and hated by the public in addition to dragging Muhammad Asyraf's father into the dispute and giving an untrue and shameful image. In this regard, he sought an injunction to prevent Caprice, its employees, representatives or agents from publishing, distributing, spreading or repeating defamatory postings whether oral or written against him on any social media platform and to delete the postings on any social media platform within 24 hours from the date of judgment.
