SC to T speaker: Decide pleas on BRS turncoat MLAs in 3 months
Chief Justice B R Gavai and Justice A G Masih gave this ruling while directing the Telangana assembly speaker to decide within three months the disqualification petitions filed against 10 BRS MLAs who defected to Congress after it formed govt in the state following the Nov 2023 elections. The verdict marks a departure from the restraint that courts have shown in setting deadlines for speakers and could well be a precedent in settling defection-related cases in the future.
The CJI-led bench also directed the speaker not to allow the 10 MLAs, facing disqualification proceedings, to protract proceedings. "In the event, any of such MLAs attempt to protract the proceedings, the speaker would draw an adverse inference against him," the bench said.

Constitutional courts have generally refrained from fastening speakers with a timeline to decide pending disqualification petitions. However, SC said since the Telangana speaker has delayed adjudication of the disqualification petitions by more than a year, it warranted issuance of directions to him.
The bench was critical of the way the speaker issued notice on the disqualification petitions seven months after they were filed, and said such a delay breached the trust Parliament reposed in presiding officers to adjudicate defection cases fearlessly and expeditiously. In the 2023 elections to the 119-member assembly, Congress had won 64 seats, BRS 39, BJP eight, AIMM seven and CPI one.
However, Congress's numbers rose after the defection of the10 BRS MLAs.
Writing the 74-page judgment recording numerous instances of speakers' deliberate inaction in speedy adjudication of disqualification petitions against MLAs, CJI Gavai said, "It is for Parliament to consider whether the mechanism of entrusting speakers the important task of deciding the issue of disqualification on the ground of defection is serving the purpose of effectively combating political defections or not?"
"If the very foundation of our democracy and the principles that sustain it are to be safeguarded, it will have to be examined whether the present mechanism is sufficient or not...it
is for Parliament to take a call on that," the CJI said.
SC reiterated the settled law that speakers/chairman of assemblies, Lok Sabha or Rajya Sabha function as tribunals while deciding disqualification petitions under the anti-defection law, and that their decisions can be scrutinised by the HCs and the apex court.
CJI Gavai examined the purpose behind enactment of the anti-defection law in 1985 through a constitutional amendment and said the only purpose of entrusting the work of adjudicating the disqualification petitions to the speaker/chairman was to avoid dilly-dallying and resultant delay in the courts of law or the Election Commission's office.
He said, "Parliament decided to entrust the important question of adjudication of disqualification petitions, on account of defection, to the speaker/chairman expecting him to decide them fearlessly and expeditiously."
CJI Gavai and Justice Masih said, "With the experience of over 30 years of working of the 10th Schedule to the Constitution, the question that we will have to ask ourselves is as to whether the trust which the Parliament entrusted in the high office of the speaker or the chairman of avoiding delays in deciding the issue with regard to disqualification has been adhered to by the incumbents in the high office of speaker and the chairman or not?"
Referring to a chain of cases under the anti-defection law marred by inordinate delay in adjudication by speakers across states, already frowned upon by SC in as many cases, the bench said, "We need not answer this question, since the facts of the various cases themselves provide the answer."

Modi highlights govt's farmer outreach, his bond with Kashi

During his daylong visit to the city, he inaugurated and laid the foundation stone for 52 projects worth around ₹2,200 crore. He also transferred ₹20,500 crore directly into the bank accounts of over 9.70 crore farmers nationwide under the 20th installment of the PM-KISAN Samman Nidhi scheme. A short film showcasing the success and impact of the scheme on farmers was also screened during the event. He cited the PM-KISAN Samman Nidhi as proof of the government's firm commitment and recalled how Opposition parties like the Samajwadi Party and Congress had spread rumours in 2019, claiming the scheme would stop after elections or the money would be taken back. 'Has a single installment stopped over the years? The PM-KISAN scheme is running without any break,' he said. Presenting data, he shared that nearly ₹3.75 lakh crore has been transferred directly to farmers' accounts so far. In Uttar Pradesh alone, 2.5 crore farmers have received over ₹90,000 crore, while farmers from Kashi have got ₹900 crore. Modi emphasised the transparency of the scheme, saying there are no cuts, commissions or middlemen. 'We have created a permanent system where there's no leakage and no one can steal the rights of the poor,' he added. Reiterating the development mantra 'jo jitna pichhra, use utnahi zyada prathamikta (the more backward one is, the higher the priority that one receives),' Modi announced that earlier this month, the central government approved a major new initiative—the Pradhan Mantri Dhan-Dhanya Krishi Yojana. He informed that ₹24,000 crore will be allocated for this scheme. The prime minister emphasized that the focus of this initiative will be on districts that were left behind due to flawed policies of previous governments—areas with low agricultural output and where farmers' incomes remain limited. Modi said the Pradhan Mantri Dhan-Dhanya Krishi Yojana will directly benefit millions of farmers in Uttar Pradesh as well. 'Our government is working with full strength to transform the lives of farmers, increase their income, and reduce the cost of cultivation, We stand firmly with farmers from seed to market,' he said , highlighting that to ensure water reaches the fields, irrigation schemes worth lakhs of crores of rupees are being implemented across the country. He acknowledged that weather has always posed a major challenge for farmers—be it excessive rainfall, hailstorms, or frost. To protect farmers from such uncertainties, the government launched the PM Fasal Bima Yojana. He informed that under this scheme, farmers have received claim settlements amounting to over ₹1.75 lakh crore so far. Affirming that the government is committed to ensuring farmers receive fair prices for their produce, the prime minister stated that record increases have been made in the Minimum Support Price (MSP) of crops, including key staples like rice and wheat. He expressed satisfaction at connecting with the farmers from across the country through videoconference. Emphasising the government's focus on increasing women's participation in the agricultural economy, Modi highlighted the 'Lakhpati Didi' campaign, with a target of creating three crore Lakhpati Didis across India. He said that listening to this figure the people of the SaPa (SP) will run away riding their cycles. Modi said that over 1.5 crore women have already achieved this milestone. He also mentioned that the government's 'Drone Didi' initiative has significantly boosted the income of lakhs of women. He said, 'Under the Jan Dhan Yojana, 55 crore bank accounts have been opened for the poor across the country'. He said the scheme recently completed 10 years and as per regulations, bank accounts require fresh KYC verification after ten years. He added that to fulfill this requirement, a nationwide campaign has been launched from July 1, 2025. He appealed to every individual who holds a Jan Dhan account to ensure they complete their KYC process without delay. Modi shared that in recent days he had been observing images of Shiva devotees in Varanasi carrying Gangajal, especially on the first Monday of Sawan, when the pilgrims set out to perform the sacred Jalabhishek of Baba Vishwanath. 'I had a deep desire to visit Baba Vishwanath and Markandeya Mahadev during the holy month of Sawan,' he said. However, he noted that his presence could cause inconvenience to Mahadev's devotees or disrupt their darshan, hence he was offering his salutations to Lord Bholenath and Maa Ganga from here only. Recalling his recent visit to the historic Gangaikonda Cholapuram temple in Tamil Nadu, Modi noted that this temple was built by the renowned king Rajendra Chola, who had brought Gangajal from North India to symbolically unite the North and South. He highlighted that a thousand years ago, through his devotion to Lord Shiva and commitment to Shaivite tradition, Rajendra Chola had proclaimed the vision of 'Ek Bharat, Shreshtha Bharat.' He said that during his recent visit to Gangaikonda Cholapuram, he had carried Gangajal with him, and with the blessings of Maa Ganga, the puja was conducted in a deeply sacred atmosphere. File defamation case against Konda Surekha, orders court
Hyderabad: The Special Judicial Magistrate of First Class at Nampally Court on Saturday directed the Hyderabad police to register a criminal defamation case against Telangana Forest Minister Konda Surekha in connection with a petition filed by BRS working president K T Rama Rao against her. Court found sufficient grounds to proceed under Section 356 of the Bharatiya Nyaya Sanhita (BNS), which addresses criminal defamation, in conjunction with procedural provisions under Sections 222 and 223. Last year KTR filed a criminal defamation case against Surekha in the Nampally Court. KTR has sought criminal action against Surekha, citing her baseless and malicious remarks aimed at tarnishing his reputation. KTR, in his plea, emphasised that such actions cannot go unchecked, as they not only cause personal damage but also undermine reputation. KTR highlighted that this is not the first time Konda Surekha has indulged in such defamatory actions. He reminded the court that Surekha had previously been reprimanded by the Election Commission for similar baseless remarks. Her repeated violations of decorum, he argued, reflect a deliberate attempt to harm his reputation through a pattern of malicious behavior. KTR's petition followed Surekha's comments few days prior his petition that KTR was the reason behind the divorce of Tollywood actor couple Naga Chaitanya and Samantha. She went on to say that KTR was addicted to drugs and used to host rave parties. The court ordered the registration of a criminal case against Surekha and mandated that a notice be served to her on or before August 21. The court also addressed objections regarding the admissibility of a pen drive submitted as evidence by KTR. Surekha's team argued that a Section 65-B certificate under the Indian Evidence Act was required for electronic evidence. The court ruled that this requirement was premature at the current stage and could be addressed during the trial's evidence phase, ensuring that the electronic material would be evaluated per legal procedures. The court concluded that the evidence and testimonies established a prima facie case of a punishable offense under the BNS provisions.
