Is your favourite show CanCon enough? Here's why the definition of Canadian content may get a reboot
What's your favourite bit of CanCon? Maybe Schitt's Creek, which aired on CBC but also streamed on Netflix, comes to mind. Perhaps some iteration of Anne of Green Gables. Or maybe a classic David Cronenberg flick like Dead Ringers? These are all considered to be CanCon — shorthand for Canadian content, it refers to film and television productions made in Canada by Canadians. But maybe you have a favourite show like CBS's Tracker, which airs on Global TV in Canada. It's one of the most watched shows on broadcast and streaming according to the Nielsen ratings, a U.S.-based audience measurement system. It's filmed in British Columbia and employs Canadians, but it's not considered CanCon. That matters because broadcasters in this country have obligations to ensure that a minimum percentage of the content they distribute to viewers meets government CanCon requirements to ensure Canadian stories are available on Canadian TV screens or streaming devices. On-demand streaming changed the game, with global companies like Netflix, Amazon Prime and Disney+ dominating the market. But they haven't been held to the same CanCon standards as traditional Canadian broadcasters, and the streaming companies say it's not realistic to expect them to do so. That's not necessarily something that's on the minds of viewers when they settle into the couch and reach for the remote or the laptop. So here's what you need to know about CanCon and the challenge of getting Canadian eyes on it. I just want to watch my shows. What do I care? Canada's broadcasting regulator, the Canadian Radio-television and Telecommunications Commission (CRTC), is at a bit of a fork in the road when it comes to CanCon. The reason there are CanCon requirements is to ensure that Canadian stories and points of view don't get drowned out by the flood of content flowing in from the U.S. "We are a small market in a big world and we sit next to a very experienced, prolific producer of content," said Dave Forget, executive director of the Directors Guild of Canada. "There should be some shelf space for the Canadian stories so that Canadians can also see themselves in their own experience." In 2023, Canada's Online Streaming Act came into effect, updating broadcasting laws to include content streaming services. It meant that foreign streaming companies would not only have to promote or recommend Canadian programming on their platforms, but streamers making $25 million or more in Canada will have to start paying five per cent of their domestic revenue to support the production of Canadian media content. The CRTC estimates that the levy would raise around $200 million a year and said the funding would be used to boost local and Indigenous broadcasting. But now the CRTC is also looking into updating what it considers to be Canadian content. "Our goal is clear: to modernize the definition of Canadian content to reflect today's reality," said Vicky Eatrides, the CRTC's CEO and chairperson, during the start of public consultations last month aimed at reviewing what exactly constitutes CanCon, and to determine whether foreign streamers should be held to the same standards as traditional broadcasters in Canada. The public hearings in Gatineau, Que., spanned two weeks and wrapped up on May 27. While many south-of-the-border movies and shows may have been filmed in Canada, with Canadian crews and talent, it's not enough to be considered CanCon in the eyes of the CRTC. First, the film or show's producer has to be Canadian. Then, there's a 10-point system for key creative roles, and six out of 10 points are needed to meet the bar to be considered CanCon. For example, if the director or writer is Canadian, that gets you two points. But, between the director and the writer, at least one must be Canadian. That also goes for the top performers; one of the two leads must be Canadian. That counts for one point each. Other crew roles such as production designer, director of photography, editor and music composer count for one point each. Other rules apply for animated productions. On top of the point system, Cancon rules state that 75 per cent of production and post-production expenses have to go to Canadians or Canadian companies. The requirements have been loosened before. The CRTC reduced the minimum number of points needed from eight to six in 2016, something the commission said would allow more films to become eligible for certain funding programs. At last month's hearings, there was talk of actually increasing the number of points needed to 15, as well as whether a requirement to reflect Canadian cultural elements should be introduced. Canadian broadcasters, producers — and even artists — want the foreign streaming services, primarily the big U.S. ones many Canadians use, to meet minimum CanCon requirements like they do in order to maintain broadcasting licences and qualify for subsidies. Anthony Shim, a director whose credits include the critically-acclaimed 2022 independent film Riceboy Sleeps, admits it's a challenge to balance the freedom of creativity with the need to protect Canadian artists and storytelling — a goal he says should always be top of mind. Toronto-born writer, producer and director Anthony Q. Farrell, who has worked on series including The Office, the British series The Secret Life of Boys and CTV's Shelved, says the definition of CanCon is more important than ever. "Especially in a time where we're really focusing in on buying Canadian and taking care of our national voice, I think it's important that we … use our Canadian creatives to tell our stories," said Farrell, who provided recommendations at the CRTC consultations on behalf of the Writers Guild of Canada. He agrees that streaming companies "making money off Canadians" should be putting some of their profits back into distinctly Canadian film and television production. The streaming companies, however, don't see it quite the same way. They were collectively represented at the consultations by the Motion Picture Association of Canada, which argued that they're already an integral part of Canada's film and television production sector but that they shouldn't be held to the same content requirements as traditional broadcasters. Wendy Noss, the association's president, appeared at the hearings on May 16 and said the CRTC should make changes to its CanCon policies, including reassessing the number of points required in the 41-year-old CanCon points system, as well as re-evaluating which roles qualify for points. She said that before the CRTC imposes Canadian content requirements on foreign streamers, they need to "introduce meaningful flexibility in modernizing the definition of Canadian programs." "Broadcasting policies should be straightforward, sustainable and flexible to enable global producers to do what they do best: creating entertainment for audiences at home and worldwide," said Noss. The CRTC will hold further CanCon consultation hearings at a later date. But the big streaming companies are also set to battle the CRTC in court over the implementation of the Online Streaming Act. They filed an appeal last year, after the commission ordered global online streaming services to fork over five per cent of their domestic revenues to support the production of Canadian content. Throne speech was an 'emotional moment' for the King, Buckingham Palace says
Social Sharing Some observant royal watchers thought King Charles looked emotional at times throughout his trip to Canada last week — and a Buckingham Palace spokesperson confirms to CBC News that the normally stoic monarch found delivering the throne speech to be a particularly poignant moment. "His Majesty was deeply moved and touched by the enthusiastic response to his visit," the palace spokesperson said. "On the speech, the standing ovation in particular was an unexpected and emotional moment for His Majesty. You can hear his voice go a bit crackly in the final lines." Footage shows Charles looking pleased by the warm reception he received as the assembled dignitaries rose to applaud him and his speech. Charles's line about Canada "indeed" being the Truth North "strong and free" was particularly well received in the Senate chamber. There was no act of protest like when an Australian Indigenous senator shouted at the King in Parliament during his visit to that realm last year. Charles also seemed to tear up outside the Senate building as thousands of people watched him arrive in the royal landau and inspect the military honour guard while the Royal Canadian Air Force band played O Canada. After the speech, he cheerfully greeted many of the onlookers and there were no obvious signs of protest. "It was the warmest of welcomes and the fondest of returns to a nation and a people we love," Charles and Queen Camilla themselves said in a joint statement released after they left Ottawa. "Royals don't normally 'do' emotion, at least they do their very best to hide whatever feeling they have. But for some reason, King Charles seemed unable to do that on this occasion at the end of a short, but highly significant, visit," ITV's royal correspondent Chris Ship wrote in his coverage of the speech. In an interview with CBC News, Justin Vovk, a royal historian at McMaster University, said there was "more emotion than we've come to expect from members of the royal family." "I think Charles was taken aback somewhat. The King had been itching to get here and eager to make his presence felt in Canada but no one really knew what kind of reaction he would receive," Vovk said. "Journalists, academics, royalists, we were all watching and wondering: would there be a tepid turnout? Would there be protests? And I think once Charles saw the level of reaction from the people, it floored him; it seems he wasn't expecting it." The emotion may also have been driven by just how high-stakes the visit was for him and the country, Vovk said. In the face of American taunts and insults, Prime Minister Mark Carney pressed Charles into service, asking the head of state to assert Canada's sovereignty in the first throne speech delivered by a monarch in nearly 50 years. It was a diplomatic balancing act because Charles, as the sovereign of 15 realms, had to fulfil his duties as King of Canada without torpedoing Anglo-American relations given there's a sometimes mercurial president in the Oval Office and the U.K. is also facing trade threats. "Opening Parliament, reading the speech from the throne, these are the most significant constitutional roles that the sovereign plays in our political system," Vovk said. "He understood the weight of it politically, personally and dynastically," he said. Plus, Vovk said, for Charles, "Canada has deep meaning for him and deep meaning for his family." The King's favoured relative, his grandmother, Queen Elizabeth the Queen Mother, and his own mother, Queen Elizabeth, made dozens of trips to Canada and wrote and spoke fondly about their experiences. Those sentiments have seemingly rubbed off on him, Vovk said. The Queen Mother, writing to Princess Margaret in 1958, said: "I have a feeling that Canada gives one a boost. They are so nice and so loving and the Mounties are so beautiful and so romantic." Looking back at her historic 1939 tour with King George VI on the eve of the Second World War — the first time a reigning monarch had been in North America — the Queen Mother said: "Canada made us." Queen Elizabeth, who personally witnessed seminal moments in the nation's history including the repatriation of the Constitution, described Canada as "home." "Charles is acutely aware that he and his family have had a presence in Canada at crucial moments. This is one of those moments," Vovk said. "He delivered, very deliberately, slogan-worthy, quotable lines — the True North, strong and free, Canada seeping into his bloodstream and straight to the heart. Those will be phrases associated with the monarchy in Canada for a very long time," he said. As for whether Charles's ongoing cancer battle may have played into his emotional reaction, Vovk said it's hard to say. "It's impossible to speculate on what goes on behind the curtain with the sovereign," he said.

Oilers not limping into this Stanley Cup Final against Panthers

That is the most important thing for Edmonton gearing up for another championship series against the Florida Panthers. Also, acknowledging the notable absence of injured forward Zach Hyman, the Oilers are much closer to full strength in the rematch than they were a year ago and are not limping into the final this time around. 'We're very confident in the group that we have and the players that are available,' defenseman Darnell Nurse said Monday after a day off the ice for players. 'There's been guys that have stepped up in huge moments so far over the course of the playoffs, and I'm sure over the course of the series we'll need more of that.' A smoother journey through the playoffs helps. Edmonton won each of its past two series in five games apiece, and that has allowed for some much-needed rest along the way. 'Are we 100% healthy? No, not quite, obviously with Hyman being out, which will be a huge loss,' Knoblauch said Monday. 'But overall I would say we're in a little bit better position physically.' Reinforcements have also arrived just in time. Winger Evander Kane returned for Game 2 of the first round against Los Angeles after missing the entire regular season recovering from multiple surgeries to repair injuries that knocked him out of the Cup final a year ago when he needed injections just to be able to walk. Defenseman Mattias Ekholm got back in the lineup for the clinching game of the Western Conference final against Dallas after thinking several weeks earlier he wouldn't be able to play again until October. 'When doctors tell you something, they're usually right,' Ekholm said. 'Most people didn't think I was going to be in this position, so to be able to be part of this group, to be part of things on the ice and help this team win has been the goal the whole time and now that it's reality is awesome for me.' The Oilers did not win last year when they faced the Panthers, losing three in a row to start the series and clawing back to force a Game 7 only to experiencing a gut-wrenching defeat. They didn't have Kane healthy then to offset Matthew Tkachuk, Sam Bennett and Florida's hard-nosed pressure. Now they do, with Kane and Corey Perry being counted on to make up for Hyman being out. 'We can play a physical brand of hockey,' Kane said. 'We can play an in-your-face brand of hockey. Whatever game you want, we can give you. We're going to play our game, and we're looking forward to that challenge.' The Panthers are also nearly 100% after some injury scares in the East final against Carolina to clutch scorer Sam Reinhart and vastly improved defenseman Niko Mikkola. Only depth forward A.J. Greer's status is any kind of a question going in. McDavid provided some intrigue over the weekend by leaving practice after five minutes and a chat with trainers. Knoblauch brushed that off, saying the three-time league MVP and reigning playoff MVP was fine and said McDavid would practice Tuesday in the final preparation for the series. Connor Brown is also expected to be back for Game 1 Wednesday night in Edmonton after missing the conclusion of the West final. 'He adds a lot of elements to our team,' Knoblauch said. 'Obviously on the penalty kill we need him a lot, his speed, his checking. He's scored and provided some nice offense throughout the season.' Having gotten at least a goal from 19 different players during this run, the Oilers also seem mentally sharper than last year, when they were new to this stage of the playoffs going up against an opponent that had been there before. McDavid and Leon Draisaitl should keep driving the bus, but they don't need to do it all. 'This time around we have a lot more depth throughout the entirety of our lineup,' Kane said. 'If we need scoring, we have scoring. If we need some guys that can be a little bit more physical, we can be more physical.
