HC denies bail to key conspirator in 2011 murder of Bhandup eatery

MUMBAI: The Bombay high court has denied bail to Amit Madhukar Bhogle, alleged gang leader and key conspirator in the murder of Bhandup-based Chinese food stall owner Suraj Mehra, observing that there was material to show his active involvement in the 'well planned' murder, falling squarely under the provisions of the Maharashtra Control of Organised Crime Act (MCOCA). Mehra, also known as 'Nepali', was attacked on October 4, 2021 by Sachin Dhananjay Kulkarni alias Chingya and Piyush Priyadarshan Naik while he was heading back home with his friend after closing his eatery. Though his friend survived the attack, Mehra succumbed to his injuries and was declared dead at Mulund General Hospital.
The Bhandup police investigated the case initially before it was transferred to the Mumbai crime branch. The police alleged that Mehra and his friend were attacked by members of an organised crime syndicate and Bhogle, arrested on September 28, 2021, was the key conspirator.
During the probe, the police found that Bhogle had planned Mehra's murder in collusion with other co-accused including Ramchandra Raut alias Kaka, who coordinated with assailants like Rahul Jadhav, Umesh Kadam and Sushil alias Sada Sawant. The police later invoked the MCOCA against Bhogle and the other co-accused, claiming that the gang led by him was involved in at least 34 criminal cases, among which he was named in 14 cases.
Advocates Sana Raees Khan and Sumit Sharma, representing Bhogle, submitted that invocation of the MCOCA against him was legally untenable and unjustified, as there was a delay of nearly one year in granting approval for applying the law. They further contended that there was no material on record to substantiate the allegation of Bhogle being a 'gang leader' or his involvement in the conspiracy or execution of Mehra's murder.
Additional public prosecutor Veera Shinde emphasised that Bhogle's conduct was established by a continued criminal tendency. He had long-standing enmity with Mehra and had planned the latter's murder to assert his dominance and control over the locality. There was sufficient prima facie evidence to indicate that Bhogle was not only a conspirator but also played a key role in orchestrating the offence through his gang members, the prosecution said. The material collected by the investigating agency revealed Bhogle's deep-rooted criminal background and his active participation in the offence, they added.
The single judge bench of justice Amit Borkar rejected Bhogle's bail application, saying his involvement in the offence did not seem to be merely incidental or peripheral, but integral and connected to the planning and execution.
Mehra's murder was meticulously planned and Bhogle had shared pictures of the deceased's mutilated body, the court noted.
'It is particularly disturbing that the accused allegedly shared a photograph of the deceased, showing grievous injuries with his intestines protruding, immediately after the incident, which indicates lack of remorse and a sense of impunity,' the court said.
Bhogle was a habitual offender with a long-standing criminal background and the alleged murder fell squarely within the definition of 'continuing unlawful activity' under the MCOCA, the court held.

Salman Iftikhar is a Pakistan-origin businessman based in London who hit headlines two years ago for his abusive behaviour towards a Virgin Atlantic flight attendant during a first-class flight from London Heathrow to Lahore. He was recently sentenced to 15 months in prison in connection with the incident. According to his LinkedIn profile, Iftikhar (37) is the founder and director of Staffing Match, a UK-based recruitment company. Media reports describe him as leading a lavish lifestyle, residing in a £2 million home and owning a fleet of luxury vehicles. The court was told that Iftikhar has a criminal record spanning over two decades, with six previous convictions related to 15 offences, according to a report in NDTV. These offences include a common assault charge in 2004 and a drink-driving conviction in 2008. Further, in 2021, he was fined £3,000 after being caught driving his Rolls-Royce under the influence of alcohol and cannabis. NDTV, citing local reports, mentioned Iftikhar reportedly wore a grey suit paired with a pink shirt and yellow tie during his court appearance. He broke down in tears as he was sentenced to 15 months in jail. A father of three and husband to two wives, Iftikhar was travelling in the first-class section on February 7, 2023 when he became enraged after being asked to stop taking ice from the onboard bar. Iftikhar, who had been consuming champagne as he travelled with his wife Erum Salman and their three children, verbally abused and threatened a flight attendent saying she would be dragged out of her hotel room, gang raped and set on fire. The entire incident was captured on camera by a co-passenger. The video showed Iftikhar accusing the flight attendant of being a racist. In the video, he was heard saying, 'You called me a Pa-i in front of everybody." When cabin crew asked him to return to his seat, Iftikhar replied, 'Don't tell me what to do you racist f—ing b–ch. I know where you are from in Cardiff." Isleworth Crown Court heard the case as Prosecutor Abdul Kapadia said Iftikhar's behaviour even forced the cabin crew to discuss diverting the plane to Turkey, the report further mentioned. However, the plane was not diverted and landed in Pakistan. The 37-year-old was arrested a year later, on March 16, 2024 at his home in Iver in England's Buckinghamshire. As per prosecutor Abdul Kapadia, Iftikhar knew the specific hotel, but also the hotel room numbers, and threatened the cabin crew. 'He told [the stewardess]: 'You will be dead on the floor of your hotel'." 'You will be dragged by your hair from your room and gang raped and set on fire," Kapadia said, citing Iftikhar. The victim, who was present in the court during the hearing, said: 'I am a strong, brave, happy stewardess, and loved my job… I was working when all flights were grounded on 9/11, and I've even flown into a warzone. A special court in Mumbai on Tuesday rejected the bail plea of 27-year-old Chetan Dilip Paradhi, accused in the high-profile murder case of former MLA Baba Siddique, observing that he knowingly assisted the assailants and facilitated their operations at the behest of gangster Anmol a photographer from Thane, is Accused No. 7 in the case and is currently in judicial custody. He is alleged to have harboured the two shooters involved in the killing and provided them with logistical support, including shelter and practice space for dismissing his bail application, Additional Sessions Judge Mahesh K Jadhav, presiding over the Special MCOCA Court, held that Paradhi failed to meet the stringent twin conditions for bail under Section 21(4) of the Maharashtra Control of Organised Crime Act (MCOCA). The court cited two confessional statements submitted in the case, which indicated that Paradhi "with knowledge provided assistance and rendered his service to the gang leader Anmol Bishnoi for facilitating the murder of Baba Siddiqui".Appearing for Paradhi, advocate Amey Pitale argued that his client was a working photographer with no criminal intent or knowledge of the conspiracy. The defence claimed Paradhi merely gave a lift to acquaintances and that the mobile phone seized from him was broken, lacked a SIM card, and contained no recoverable data. They also highlighted procedural gaps, including the absence of a test identification parade and inconsistencies in witness Special Public Prosecutor Mahesh Mule and Advocate Pradip Gharat, representing Siddique's wife, strongly opposed the bail plea. They presented call data records, Paradhi's own recovery memorandum, and the confessions of the co-accused as evidence of his direct role in aiding the shooters, identified as Shivkumar and Dharmaraj, who were allegedly dispatched by Bishnoi to execute the Jadhav further noted that Paradhi had prior criminal antecedents and a history of association with the co-accused in earlier cases. NEW DELHI: The Punjab's Anti-Gangster Task Force (AGTF) on Thursday averted a major terror attack planned by Pakistan-based Babbar Khalsa International (BKI) operatives Harwinder Rinda and Lakhbir Landa. In a post on X, DGP Gaurav Yadav said that acting on precise intelligence, AGTF teams, along with Tarn Taran Police, launched a swift operation that led to the seizure of the IED before it could reach Rinda's associates in Punjab and wreak havoc. The bomb was discovered in Tarn Taran district, a region known for terror infiltration threats. Yadav said that the IED was safely moved and neutralised by a bomb disposal squad in a controlled explosion. Officials said the IED was powerful enough to cause mass casualties, had it not been intercepted in time. A case has been filed under the Explosives Act at Sirhali Police Station.
