Drugs kingpins guilty of plotting murder and running drugs empire on EncroChat

James Harding, 34, and his 'loyal right-hand man' Jayes Kharouti, 39, ran a vast criminal empire which made £5 million in profits from importing drugs over 10 weeks in 2020 alone.
They tried to recruit a hitman to put an unnamed rival courier 'permanently out of business', arming him with a gun and ammunition for the 'full M' – a murder, the court was told.
At the time, Harding, who claimed to be a high-end watch sales executive, was living in luxury in Dubai, staying in five-star hotels and driving Bugatti and Lamborghini sports cars.
The plot was scuppered by Scotland Yard officers who accessed the defendants' discussions on EncroChat and trawled through thousands of messages.
They were handed the data after French police smashed the encryption code to the service favoured by the criminal underworld.
Their Old Bailey trial was held amid heightened security, with an armed police escort to and from the central London court and prison.
On Tuesday, they were found guilty of conspiracy to murder while Harding was also convicted of conspiring with others to import cocaine, which Kharouti, of Epsom, Surrey, had admitted.
They were remanded into custody to be sentenced on Thursday.
Three other members of the organised crime group had previously admitted drugs offences.
Prosecutor Duncan Atkinson KC told the trial the defendants discussed on EncroChat importing a tonne of cocaine over a period of 10 weeks.
Harding used the nickname 'thetopsking' while Kharouti went by the handle 'besttops' and 'topsybricks', the prosecution alleged.
In EncroChat messages the pair discussed the robbery of a drugs courier and Kharouti reported back on whether six or seven kilograms of cocaine had been delivered to a client the day before.
Mr Atkinson said it was Harding who first raised the idea of a 'cryp robbery' – taking drugs from a courier – which became a plan to kill a courier instead.
The defendants discussed how and where the murder would take place, with Kharouti offering the potential hitman £100,000, the court was told.
Kharouti kept his boss informed about the plan who told him it should involve a 'double tap' shot to the head and chest.
Despite a delay over transport for the hitman, the defendants worked on alternative solutions even arranging the shooting near to the proposed gunman's home.
The alleged hitman was arrested on suspicion of conspiracy to murder in the early hours of June 3 2020, which the defendants were unaware of.
Kharouti increased the offer to £120,000 but an EncroChat user trying to locate an individual for him said the price should be no less than £200,000, the court was told.
Harding, who had previous convictions for drugs and false documents, was arrested at Geneva airport in Switzerland on December 27 2021 and extradited from Switzerland.
Kharouti was extradited from Turkey to the UK on June 25 last year.
Giving evidence, Harding denied using the handle 'the topsking', saying it belonged to an 'intimate' male partner called TK, who he refused to identify.
The case formed part of a wider operation targeting criminals who used EncroChat.
Detective Chief Inspector Jim Casey, who led the investigation, said: 'This conviction sends a clear message: no matter how sophisticated the methods, criminals cannot hide behind encrypted software.
'This operation dismantled a major supply chain and is a testament to the relentless work of our officers.
'We monitored their drug-dealing activity but then we saw the group discussing the contract killing of a rival. We moved fast to protect those in danger.
'Harding and Kharouti planned to kill, we stopped that and put them before the courts.'
Detective Inspector Driss Hayoukane, who oversaw the Met's EncroChat operation, said: 'Thanks to the tenacity and commitment from Met officers, over 500 criminals have been successfully convicted since the EncroChat platform was cracked back in 2020, leading to well over 5,000 years of sentences being handed down to those involved.
'This represents our commitment to combating illegal drug supply, as well as the serious violence that comes with it.
'Our work doesn't stop here – we will continue to pursue those who profit from bringing harm to our communities and will continue to deliver our mission of reducing crime.'
Previously, Calvin Crump, 29, of Redhill, Surrey; Khuram Ahmed, 38, of Slough; and Peter Thompson, 61 of south-west London, had admitted the cocaine conspiracy charge with Thompson also pleaded guilty to possession a pistol. A man alleged to have been the proposed hitman was cleared.

Reports of "gunfire" being heard has resulted in a police investigation being launched. Police have launched a probe following reports of gunshots being heard on the afternoon of Wednesday June 25. A statement issued by the Greater Manchester Police said: "We are aware of gunfire heard in Greenfield area today, this has been investigated and determined to be a fire cracker style bird scaring device and the farmer using a shotgun to warn away birds from the crops. "This may continue for the immediate future and there is no cause for alarm. As usual, call 999 in an emergency or 101 for non-emergency." On Sunday, in a separate incident, we reported that a gang of gunmen opened fire at a wedding and shot the bride dead while injuring three others. The day of celebration was ambushed by four hooded gunmen, who fired rounds at the bride and groom as they were leaving at around 4.30am on Sunday, June 22. ‌ Police were called and rushed to the Vaucluse venue, in Goult, in the south of France following the tragic shooting. One of the attackers was also killed and three other people, including a 13-year-old boy, were injured in the wedding slaying. The bride and groom were reportedly leaving their car when they were ambushed by the gunmen, who arrived in a Golf car. ‌ The groom then reversed his car, in a desperate attempt to escape the attackers, and hit one of the shooters. French police have launched an investigation into what was behind the horror shooting as they try to track down the three gang members who fled the scene. Londoner Jaskarn or 'Jacky' Jhaj, 39, was arrested after paying £111,000 to stage the vile fake event at the fairlytale Sleeping Beauty castle, featuring musicians, a cake and chairs for hundreds of 'guests'. Fantasist Jhaj, who has a track record of elaborate, bad taste hoaxes, was jailed for four years in 2016 for grooming and sexually assaulting two 15-year-old schoolgirls, MailOnline previously revealed. Now, a bizarre Facebook advert offering children as young as five 200 euros to take part in the Disneyland stunt has come to light, calling for 100 kids to attend the 'high-end wedding rehearsal'. The ad explicitly states that guests must maintain 'absolute confidentiality', and would have to 'stand up, sit, applaud and play their part in this prestigious gathering'. It was posted by a woman named Christelle Ka, who bills herself as 'actor and TV host' and runs firm Cristal Communications. Her link to Jhaj remains unclear. The offer included a private bus service to take 'guests' from the centre of Paris to the event. Those who attended were required to wear a 'very elegant evening outfit', such as a 'suit, evening dress or tuxedo', according to the ad. He was arrested following the phony movie premiere on suspicion of breaching a sexual harm prevention order and was released on bail. Jhaj, who poses as a film producer, was subsequently fined £1,500 at Isleworth Crown Court last July for breaching notification requirements and a sexual harm prevention order. The source of funding for his expensive set-ups is a mystery.

A British sex offender accused of staging a mock wedding with a child at Disneyland Paris has been charged with money-laundering and fraud offences in France. Jacky Jhaj, 39, who was found guilty of sexual activity with two 15-year-olds in 2016, was arrested this weekend at Disneyland Paris after the theme park was hired for a private wedding. Staff are said to have called police when they saw that the 'bride' dressed in a wedding dress was in fact a nine-year-old girl. Jhaj, who prosecutors said was playing the role of the groom in the mock wedding, has been charged by an investigative judge in Meaux with offences including money laundering and identity theft. The nine-year-old girl, who is Ukrainian, was not harmed, police said. Jhaj was identified as the arrested man by the BBC, which has previously published investigations into him. French police and prosecutors have not named him, though prosecutors said the charged man had a criminal record in the UK for sexual assault offences. Jhaj is accused of organising a bizarre mock marriage ceremony that included an orchestra, a giant cake and a backdrop of a Disney castle. He had organised for more than 100 paid extras to be bussed from Paris. They believed they were playing the role of guests in a real wedding scenario. The French court also opened an investigation into the suspected corruption of a minor, designating the man as an 'assisted witness' – a step before being indicted. Disneyland Paris is Europe's most-visited theme park and can be hired for weddings at a very high price outside opening hours, with its Sleeping Beauty castle as a backdrop. The event had been scheduled to take place between 5am and 7am on Saturday for a price of around €130,000 (£111,000). The French state prosecutor in Meaux, Jean-Baptiste Bladier, said the British man played 'the role of the groom after being professionally made up to display a face completely different from his own'. Bladier said French judicial authorities were informed by British police that the man 'has been convicted in the past, notably for sexual offences against minors'. The Metropolitan police in London said a 39-year-old man was currently wanted for breaching a sexual harm prevention order and a breach of a sex offender register notification requirement. In a statement, they said: 'We are aware the man has been arrested in France for other matters and officers are in contact with the French authorities.' PA Media reported that the man was placed under supervision after being convicted of sexual activity with two 15-year-old girls in 2016. The French prosecutor said investigations had showed that the Disneyland 'marriage' was in fact 'a fictitious ceremony intended to be filmed privately'. The prosecutor's office designated a 24-year-old Latvian, who played the role of the bride's sister at the event, as an assisted witness in the investigation. The British man is suspected of 'recruiting, with the help of a Latvian citizen, other Latvian nationals to ensure the smooth running of the event, as well as around 100 French extras, who were falsely presented to Disneyland Paris as wedding guests', the prosecutor said. The Ukrainian child, who arrived in France two days before the event, suffered 'no violence, either physical or sexual' and 'was not forced to play the role' of bride, the prosecutor said at the weekend. According to the prosecutor, Disneyland Paris was deceived, with 'the organiser impersonating a Latvian national and using false documents to secure the contract to hire the park'. Disneyland Paris has also filed a legal complaint.
