Governor's sanction required to take cognisance against CM: court

The Hindu03-07-2025
The prosecution sanction from the Governor is required for a court to take cognisance against the Chief Minister in an alleged offence of abetment, the Chief Judicial Magistrate, Ernakulam, has said.
The court made the observation while considering a petition filed by Muhammad Shiyas, president of the Ernakulam District Congress Committee, seeking the registration of a case against Chief Minister Pinarayi Vijayan for abetment of violence.
The judge noted that the complainant must obtain prosecution sanction from the Governor for the court to take cognisance of the alleged offence.
In his complaint, Mr. Shiyas alleged that the Chief Minister abetted DFYI activists in unleashing violence against Congress and Youth Congress workers during the 'Navakerala Sadas' undertaken by the State Cabinet, which covered all 140 Assembly constituencies in the State. He pointed out that the Chief Minister had claimed the DFYI activists were carrying out a 'rescue mission' by removing Youth Congress workers protesting in front of the bus carrying him and his Cabinet colleagues. The statement of Mr. Vijayan amounted to abetment, he alleged.
The court posted the case for November 1.

CM, Ministers skip Governor's ‘At Home' event

Amid the continuing stand-off between the government and Raj Bhavan, Chief Minister Pinarayi Vijayan and the Ministers did not attend the 'At Home' event hosted by Governor Rajendra Vishwanath Arlekar in connection with the Independence Day celebrations on Friday. The State government has not made any official comment regarding the matter. Chief Secretary A. Jayathilak, State Police Chief Ravada Chandrasekhar, and senior officials of the armed forces attended the 'At Home' event hosted by the Governor. According to a statement issued by the government's Public Relations Department, former Mizoram Governor Kummanam Rajasekharan, former Union Minister O. Rajagopal, freedom fighters, differently abled children and other prominent personalities also attended. The CPI(M)-led LDF government and Mr. Arlekar have been at odds over a host of issues, the most recent being Mr. Arlekar's directive to the universities to observe August 14 as 'Partition Horror day.' On its part, the State government advised the universities and affiliated colleges that observance was not compulsory. Chief Minister Pinarayi Vijayan had described the Governor's directive as unconstitutional and unacceptable. In June, the State government had taken strong exception to the display of an image of a 'saffron flag-holding Bharat Mata' at official events held at Raj Bhavan. The same month, the issue had spilled out onto the streets after protests erupted over the display of the motif at a private event attended by Mr. Arlekar at the Kerala University's Senate Hall.

Kerala CM boycotts ‘At Home' called by Guv

Thiruvananthapuram: In a fresh display of the growing rift between Kerala Governor Rajendra V. Arlekar and Chief Minister Pinarayi Vijayan, the Chief Minister and his Cabinet colleagues on Friday boycotted the traditional 'At-Home' reception hosted by the Governor at Raj Bhavan as part of Independence Day celebrations. Although invitations had been extended to the Chief Minister and all ministers, none of them attended the evening function. The state government was represented only by Chief Secretary The absence of the political leadership is being widely seen as a public reiteration of the ongoing tensions between the Governor and the state administration. The friction between the two sides has sharpened in recent months over multiple issues, most recently, the controversy surrounding a government circular to observe 'Partition Horrors Remembrance Day' and the disputes over temporary appointments of vice-chancellors in state universities. The issue of the appointment is now under the scrutiny of the Supreme Court. Interestingly, the state government had sanctioned an additional Rs 15 lakh for the Governor's reception this year, despite the strained relations. The allocation was made under the 'hospitality expenses' head after relaxing earlier cost-cutting directives. The funds were sanctioned based on a request from the Additional Chief Secretary to the Governor, who sought financial clearance to host prominent citizens and distinguished guests at the Raj Bhavan reception. Sources indicated that the decision to allocate the amount was taken even as the dispute over university appointments was at its peak. The gesture, however, did not translate into political participation, as the Chief Minister and ministers stayed away from the gathering. Traditionally, the Governor's 'At-Home' event is a high-profile social occasion, bringing together senior officials, political leaders, and eminent members of society. The visible absence of the ruling front's top political figures this year underscores the deepening institutional standoff in Kerala's governance. Observers note that while the administrative machinery continues to function, the lack of political engagement between the Governor and the state's elected leadership could complicate decision-making on key matters, including higher education appointments and protocol-related events in the coming months.
