Shimla: The ongoing standoff between governor

and the Himachal Pradesh govt over the appointment of vice chancellors of Dr YS Parmar University of Horticulture and Forestry in Solan and CSK Himachal Pradesh Agriculture University in Palampur has escalated.
Shukla, as chancellor of universities, has now held the state agriculture secretary's Aug 11 letter as 'patently illegal' and 'unconstitutional' for unilaterally withdrawing the advertisements issued by the Raj Bhawan secretariat on July 21 for the appointment of vice chancellors of these two varsities. Terming the letter issued by agriculture secretary C Paulrasu as 'nonest in the eyes of law', the governor has now set aside the letter.
"The advertisement, being issued under a specific Act, while exercising statutory powers can only be withdrawn by the authority that issued it," clarified Shukla. Restoring the advertisement notices issued by the Raj Bhavan secretariat on July 21, the governor has now extended the time period for receiving applications from the aspirants for the post of vice chancellors of these two varsities up to Aug 18.
The posts of vice chancellors of the Palampur university and Solan university have been vacant since Aug 21, 2023, and May 8 this year, respectively.

The governor has reiterated that the process to fill these two posts has been initiated by him in accordance with rules, legal as well as constitutional provisions.
Meanwhile, the agriculture secretary, in his Aug 11 letter, termed the selection process of the vice chancellors initiated by the governor as illegal and 'against the spirit of the constitution and values of democracy'. Earlier, agriculture minister Chander Kumar, on July 26, wrote to the governor to keep the selection committee in abeyance, stating that the Amendment Bill, 2023, pertaining to the appointment of vice chancellors, is to be reconsidered by the legislative assembly in the forthcoming monsoon session starting from Aug 18.
The Himachal Pradesh Vidhan Sabha, on Sep 21, 2023, passed The Himachal Pradesh Universities of Agriculture, Horticulture and Forestry (Amendment) Bill, 2023, which mandates the governor to appoint vice chancellors on the "aid and advice" of the state govt. However, the governor returned the Bill to the state govt with the observation to make amendments in the Bill for the constitution of a selection committee.
However, the governor, in the notification issued on Thursday, clarified, "The chancellor, while exercising the statutory powers under the specific Act, is not bound by the aid and advice of the council of ministers as he was not exercising his constitutional powers but is exercising his statutory powers." Responding to the agriculture secretary's Aug 11 letter, the governor mentioned that the chancellor, having statutory powers under the Act, is the sole competent authority to initiate the process of appointment of the vice chancellor.
Therefore, it is implicit that the process for such appointments is to be initiated by the office of the chancellor and not otherwise as inferred by the advocate general in his advice.

Sreenivasan murder case: HC grants bail to four PFI members
The Kerala High Court has granted bail to four members of the banned Popular Front of India (PFI) who had been arraigned as accused in the murder of RSS leader Sreenivasan of Palakkad in 2022. A Division Bench of Justice V. Raja Vijayaraghavan and Justice K.V. Jayakumar granted them bail while hearing their plea challenging the dismissal of their bail applications by the NIA Special Court, Ernakulam. Muhammed Bilal, Riyasudheen, K.P. Ansar, and K.V. Saheer, who were granted bail, had been arraigned as among the accused in the case. They had been charged with participating in a conspiracy, conducting reconnaissance along with the other accused, and playing a prominent role in facilitating the murder. They contended that, though the incident was a 'political murder', the NIA deliberately gave it a communal colour by deleting the name of the political party from the final report, replacing it with 'a Hindu leader,' and incorporating provisions under the Unlawful Activities (Prevention) Act (UAPA). The NIA deposed before the court that the investigation had revealed that the PFI had a hidden agenda to overthrow democracy in India and to establish Islamic rule by 2047. The court said that the final report filed by the NIA was voluminous, consisting of 1,688 documents, 1,114 witnesses, 696 material objects, and 10 terabytes of forensic reports. Given the magnitude of the prosecution case and the stay on proceedings issued by the Supreme Court, specifically interdicting the framing of charges, there is no foreseeable possibility of the trial commencing or concluding in the near future. Out of the total 66 accused in the case, 49 had already been enlarged on bail either by the High Court or the Supreme Court, and only 12 remained in custody. The court granted bail to the four accused since the accused persons facing almost similar charges had already been released.

Hemant govt ‘grabbing' tribal land, says Champai
1 2 Ranchi: BJP MLA from Seraikela and former CM Champai Soren on Tuesday hit out at the Hemant Soren-led alliance govt by reiterating that the incumbent regime is busy "grabbing" tribal land. Addressing the media in Kanke ahead of his announced stir on Aug 24 against the proposed Rims-2 hospital project, Champai demanded that the state govt take this project to the Smart City area. "On Aug 24, I will be part of the mass protest here where tribals will plough the field to raise their voice against the govt's attempt to grab their agricultural land in the name of the hospital project. Neither I nor anyone else is against this project, but all that we are demanding is that farmers must not be robbed of the agricultural land," said Champai. Notably, in the past, many BJP leaders have already criticised this project at this particular site, citing large-scale displacement of farmers. Champai accused the state govt of violating the Land Acquisition Act, 2013, and the Chotanagpur Tenancy (CNT) Act before acquiring the land for the project. However, the govt had earlier said the land belonged to it. "Nobody got any notices for land acquisition here. How can the govt take the land without following the rules? Under this regime, tribals and their land are constantly under threat," the former CM claimed. Reacting to the stir in the past, state health minister Irfan Ansari had said the land belongs to the govt and the project was aimed at revamping healthcare infrastructure, which will benefit people of Ranchi as well as the state. India, China agree to reopen border trade through three Himalayan passes
India and China on Tuesday agreed to reopen border trade through Lipulekh Pass in Uttarakhand, Shipki La in Himachal Pradesh and Nathu La in Sikkim, as part of a series of measures to strengthen bilateral ties during Chinese Foreign Minister Wang Yi's official visit to India.
