
British artist wins court fight with Argentinian winery after suing them for £150K over claims her work was copied for its Malbec labels
Shantell Martin's distinctive black and white murals saw her gain international recognition, with lucrative collaborations involving singer Kendrick Lamar and labels Tiffany & Co, Adidas and Puma.
The 44-year-old, who grew up in Thamesmead, south London, and first found fame as a VJ in Japan before moving to New York, was also handed an MBE by King Charles earlier this year.
But in April 2020, Ms Martin became locked in a copyright battle with winemaker Bodegas San Huberto Sa and British importer Marc Patch after complaining that her designs had been copied on over 18,000 bottles of Malbec.
The artist protested that the label for the winemaker's Aminga Malbec featured drawings that appeared to be lifted from a site-specific drawing she created for her 2017 solo show 'Someday We Can' at the Albright-Knox Art Gallery in Buffalo.
She went on to complain that two more labels displayed on a further 500,000 bottles of imported wine also infringed on her work.
Ms Martin sued both companies along with Mr Patch claiming damages of 'at least £150,000 ($200,000) based on the licence fee she said she would have expected had the Argentinean winemaker asked permission to use her work.
Now Judge David Stone, at London's High Court, has ruled that the first of the three labels the artist complained about - created for the winery by an independent designer - did indeed copy her work.
Ms Martin grew up in southeast London and has spoken of experiencing racism during a tough childhood as a mixed race child on a predominantly white estate.
She graduated from Camberwell College of Art and Central St Martins and in 2003 moved to Tokyo where she had the idea that she could project on nightclub walls drawings that she made live while playing music.
She became a popular Tokyo VJ before moving to New York, where she made her name in the US and world art scene.
Much of her work is improvised, drawn live with a black and white marker often on a huge scale and incorporating text, map-like landscapes and human faces
Some of her best-known work was installed in New York's Calatrava World Trade Center Oculus Transit Station and asked, 'WHO ARE YOU' and answered, 'YOU ARE YOU,' adding the question, 'ARE YOU YOU.'
In the last decade, she has enjoyed high profile collaborations, including with Kendrick Lamar, fashion labels Max Mara, Puma, Tiffany & Co, Adidas and The North Face.
But she complained in 2020 that her work had been copied on the company's wine labels without her being contacted to arrange an official collaboration.
Following the initial complaint, the winery had the label redesigned twice, with GM Drinks importing around half a million bottles with the new designs.
But going on to sue, Ms Martin claimed that the two new labels also infringed her work and demanded $200,000 on the basis that it was a typical fee she would arrange for such a commercial collaboration.
Judge Stone found that although the company did not know about the copying until she complained, Mr Patch's company Hampshire-based GM Drinks Ltd was liable for selling infringing bottles in the UK, while both the winemaker and Mr Patch personally also shared some joint responsibility.
Giving judgment, Judge Stone said: 'Even though GM Drinks did not know it was doing anything unlawful, it was,' and added that the winery and Mr Patch were jointly liable in relation to a small number of bottles sold after Ms Martin's initial complaint.
But he added that the vast majority of the bottles either didn't infringe on her designs or were sold before the companies were aware of the problem.
This means the amount in damages she would be entitled to will be much less than her claim, as the judge said the case was suitable to be decided at a court where claims are less than £10,000.
GM Drinks had only made a profit of £924 from the bottles the judge ruled had infringed her work, the court heard.
He said: 'Correspondence indicates that the claimants requested US$200,000 from the defendants, that being a sum said to reflect the amounts Ms Martin usually receives for her collaborations with third parties. Counsel for the claimants before me put this based on a reasonable royalty that would be agreed in the circumstances.
'It is not pre-judging the matter to remark that each of the collaborations that was in evidence before me was very different to the infringement that I have found in this case.
'The claimants are now also aware that the vast bulk of the products, being the third label products, do not infringe. Further, the low volume of first label products overall, and the very low volume dealt with from shortly after 13 April 2020, mitigate against a reasonable royalty at that level.'
He said the parties would be given time to try to agree an amount in compensation in light of his findings, but added: 'If that cannot be done, I would propose transferring the quantum proceedings to the small claims track of the Intellectual Property and Enterprise Court (IPEC) and will hear the parties' submissions on that proposal.'

Materialists Cert: 15, 1hr 56mins Matthew Bond review - Mail On Sunday Rating: The first film that screenwriter Celine Song directed as well as wrote was the delightful Past Lives (2023), which explored the choices we make in life, particularly when it comes to relationships. It earned her an Oscar nomination, critical acclaim and, for an arthouse film, commercial success. Her follow-up, Materialists, is an altogether bigger affair with a cast led by Dakota Johnson, Pedro Pascal and Chris Evans and explores similar territory only without the magic and gentle spirituality of its predecessor. That's because it's set in the ruthless world of New York dating. Johnson plays Lucy, a successful senior executive at an agency that looks down its nose at apps and still believes in the old-fashioned art of match-making, at least for those who can afford it. Its demanding clients are not so much looking for love as wealth, good looks and compatible levels of education. For women, the height of a prospective husband is everything while, for men I'm afraid it's still youth. But Lucy knows it's more complicated than that, which is why she's already on her ninth successfully arranged wedding. So why is she herself still single, despite being magnificently courted by the absurdly eligible Harry (Pascal) while being shambolically pursued by her handsome but impoverished actor ex-boyfriend, John (Evans)? Song's screenplay is smart, insightful and funny, albeit in a familiar Sex And The City kind of way. So it's probably a good thing it's also bleak, cynical and occasionally depressing, at least for balance. Johnson is excellent, the ubiquitous Pascal as charming as ever and Evans just a little bit too good to be true. Materialists lacks the emotional depth of Past Lives but it's well-made, watchable and will make you think. And possibly hope, too. Laruskha Ivan-Zadeh - Daily Mail review Rating: Do soul mates exist? That question unites the week's two biggest releases, which answer it in two, very different ways. Materialists is a movie about beautiful people chasing the perfect partner. Lucy (Dakota Johnson) reckons she's got it all worked out. She's a professional matchmaker in Manhattan, responsible for nine weddings and counting, who firmly believes that 'Marriage is a business deal, and always has been, since time eternal.' Commitment is not about love, it's about currency, market forces and 'math', with Lucy's personal 'non-negotiable' being that, as well as being tall and handsome with a full head of hair (be warned, this movie is not an ego-boost for shorter, bald men), her future husband will be eye-wateringly rich. Enter hunk-of-the-moment Pedro Pascal, a tall, handsome, hirsute moneybags with a $12million penthouse in Tribeca. However, this being a (sort of) romcom, also re-enter Lucy's ex, John (Chris Evans), a tall, handsome struggling theatre actor, with a head full of hair, but empty coffers, who Lucy broke up with because he was, er, broke. So, who will win her hand? The answer isn't as obvious as might first appear. Because this isn't cheese puff Hollywood escapism of the glossy sort that Kate Hudson and Matthew McConaughey popped out in the 2000s – it is the 'difficult' second feature from writer /director Celine Song, whose wistful romance Past Lives was arguably the finest film of 2023. Materialists is similarly based on authentic lived experience. Song worked as a matchmaker when she first came to New York, and her script here poses interesting questions most of us can relate to about the balance sheet between romance and rationalism. Bottom line: are you really going to make it long term with someone of different background and values, particularly if you always end up squabbling about money? Unfortunately, the Materialists' parts are better than its whole. Excellent and effortless as the three leads are, their dialogue can feel forced. Sometimes it's deliberate, like when Pascal's smoothy-chops woos Lucy with the line: 'I want to be with you for your immaterial assets.' But other times not. It is occasionally very witty and well-observed. Song has set out to deconstruct the romcom, but the way she reconstructs it proves kind of disappointing. As we wait to find out if love conquers all, you will likely feel unconvinced by where the happy ending lies.

Narinder Kaur criticises BBC's decision to have Thomas Skinner on Strictly
TV star Narinder Kaur has criticised the BBC's decision to cast former The Apprentice candidate Thomas Skinner as a celebrity contestant on Strictly Come Dancing after saying she was told she was 'too controversial' for the show herself. It comes after Skinner met US vice president JD Vance for a barbecue and drinks, with the 34-year-old – who befriended US President Donald Trump's number two on social media platform X – describing the event as 'once in a lifetime'. In the caption of a video posted to X, Jeremy Vine panellist and former Big Brother star Kaur, 52, said: 'Apparently I was deemed too controversial for @bbcstrictly because they only hire quiet brown and black women that fit in a box. 'But you can be a white man AND be controversial and you'll be hired on the spot! Hello Thomas Skinner!!' In a statement, she added: 'There's only so much you can say in a short video, but I felt something many others have been feeling all day and that was complete shock and utter bewilderment – to see Thomas be announced in the line-up, considering all the rhetoric about how people with right-wing opinions are cancelled and not allowed on the BBC. 'I've debated Tom on Good Morning Britain before, I supported his book release at his launch party, there is a huge disparity in what certain demographics of people are allowed to say and still get one show after another. 'I met the Strictly team at the TV Choice Awards earlier this year and got talking to one of the bookers about the show generally – and she said 'You're a bit too controversial and we can't have that for the show.'' Following the post complaining about alleged abuse, Mr Vance replied with a picture of a cartoon character typing on a keyboard and a message that read: 'Hang in there, my friend. Carrie Bradshaw dressed for herself, not men, and gave us licence to follow suit
Overdocumented as they might be now, the Nineties were a strange and lonely decade to be a fashion-lover. Fashion was a niche interest, like bone or stamp collecting. All information was strictly channelled through the pages of monthly magazines such as Vogue, Elle, The Face or i-D, bar the occasional style page in a newspaper. Interviewed for my first job as fashion editor of a national broadsheet, the editor asked, 'So, do you like clothes?' One wonders whether he asked the sport editor whether he liked football. It's hard to remember a time when people didn't post videos of their weird shoes, designer hauls, salacious handbag unboxings, bargain charity shop finds and #OOTDs on social media. In 2025, having a unique sense of style can make you rich and famous. In 1995, it was more likely to have you bullied or ostracised. Into this barren wasteland in 1998 tripped Carrie, Charlotte, Samantha and Miranda, four New York women who loved sex, shopping, cocktails and men, though never as much as they loved each other. Based on a newspaper column of the same name by Candace Bushnell (published in the New York Observer between 1994 and 1996), Sex and the City (SATC) revolutionised fashion: how it was perceived, how it was documented and how it was consumed. It legitimised fashion – not because naysayers suddenly realised the allure of a Fendi Baguette bag, but because the show's popularity proved that clothes, shoes and accessories had mainstream appeal, and deserved to be given space beyond the pages of a glossy magazine. You might think that the vast exposure inherent to being featured on a TV show would be catnip to fashion designers, whose only recourse to publicity was via print and billboard advertising, magazine editorial or catwalk shows. Not so. Rather than seeing it as an opportunity, many designers were reluctant to place their brand in an environment where they would be unable to control the narrative. 'It was difficult to borrow clothes, as everyone heard the name 'Sex And The City' and thought 'what is this?'' remembers costume designer Molly Rogers. 'I guess it sounded pretty racy. No one loaned to TV shows then, as I remember – that world was strictly for editorial.' She cites Chanel, Dior and Christian Lacroix as early supporters of the show. Rogers worked on SATC from 1998 to 2002, and served as costume designer on the 2008 and 2010 films, as well as all three seasons of And Just Like That, the divisive sequel. She witnessed first hand the genius of Patricia Field, the show's formidable New York stylist and costume designer whose eclectic, exuberant tastes ensured that Carrie would never fall into the dreary trap of wearing ' quiet luxury '. Without Field, there would be no oversized floral corsages, diamanté skull caps or ballgowns as daywear. Nor would there be what many consider to be Carrie's most iconic look, a tiered white tutu teamed with a pale pink vest top and strappy sandals, as immortalised in the show's opening sequence. Field later revealed that she'd sourced the tutu from a thrift store bargain bin and bought it for $5 – a common practice for stylists and costume designers today, but an unusual one in 1998, an era when luxury brands would pull their advertising if a glossy magazine had the temerity to feature their expensive wares next to items that might threaten to devalue them. Field's 'high-low' approach of mixing designer and vintage together was hugely influential, although it wasn't until the beginning of season three that designers wanted in on the action. 'The show exploded then,' Field said in an interview, adding that costume design 'isn't about selling clothes, it's about telling a story. That's something I learned along the way.' Now 84, Field is still telling stories through clothes, most recently as the costume designer for Emily in Paris (Netflix), the fifth season of which is due to air later this year. Before Sex and the City, the idea of 'fashion' as a main character in any TV show was virtually unheard of. While clothes had an important role in shows such as Dynasty, Friends or Beverly Hills 90210, they existed as costume, and were rarely, if ever, discussed by the characters themselves. They certainly weren't an integral part of the plot: characters didn't utter pithy lines like 'I like my money right where I can see it – hanging in my closet.' SATC made fashion a fundamental part of each character's identity – literally, in the case of Sarah Jessica Parker's 'Carrie' necklace. Here were four women with very different aspirations: Carrie a hopeless romantic, Miranda a driven career woman, Charlotte keen to settle down and Samantha happy to play the field. Their wardrobes were a visual shorthand for their aspirations. From the beginning, the clothes were given as much consideration as the acting and the script. 'At the very start [of filming], Pat [Field] had an extensive conversation with [producer and writer] Darren Starr, where he gave her so much background information on each of the actresses that it really aided in building their costume DNA,' remembers Rogers. 'Charlotte was 'Upper East Side', Miranda was 'corporate', Carrie was 'eclectic and downtown' and Samantha spoke for gay men. Pat always said three things: that SATC was a moving fashion magazine, that we aren't making a documentary therefore I don't care where she gets these clothes, and finally, that we should never repeat an outfit – they don't repeat scripts.' This idea of SATC as 'a moving fashion magazine' is spot-on. Like many viewers, I might not always have loved the wilder reaches of Carrie's style, but I loved what she stood for. Thanks to a writing and production team powered largely by women and gay men – co-creator and writer Michael Patrick King, producer and writer Darren Star, with Parker co-producing from 1999 onwards – viewers were served a heroine who wasn't traditionally beautiful (straight men almost universally seem to think SJP is unattractive, and probably wouldn't have cast her in a lead role), who unabashedly loved clothes, smoked cigarettes, enjoyed sex and had an enviable career as a writer. Who said women couldn't have it all? Well, heterosexual men, for a start. 'I despised Candace Bushnell's vile cultural monster as a book and as a TV series,' one male critic opined in 2008. 'They represented a vacuous, trivialising, anti-feminist act of self-sabotage on the part of women. What amazed me was that women, even quite smart women, seized on this frivolous, vain confection as an emblem of sisterhood and empowerment.' It shouldn't need saying that women can be clever and stylish, or debate geopolitics with the same expertise that they discuss Phoebe Philo 's latest drop. Yet there still exist people who seek to diminish anyone whose interests they deem less serious or worthy than their own. Rather than being a 'vain confection', it was a joy to see Carrie – and in a different way, Samantha – dress for themselves, seemingly unconcerned with any other gaze than the one that greeted them in the mirror. 'Carrie made me bolder,' says Alison Cragg, a 50-something fan who works in HR. 'I remember having a boyfriend in the early 2000s who had a habit of laughing at some of the wilder clothes I wore. I've still got most of the clothes, but I don't have the boyfriend.' In the absence of a fulfilling relationship, a good pair of shoes is a decent consolation prize. Most fans would agree that friendship, not fashion, was the beating heart of SATC. Flawed as the sequel was, when Michael Patrick King announced earlier this month that its third and current season would be its last (the final episode airs on Aug 14), longstanding fans of Carrie, Charlotte, Miranda and Samantha took to social media to share their sadness. 'Carrie Bradshaw is the most important character that has ever graced television, and arguably, she is up there with the likes of Odysseus, Hamlet and even Jesus,' said one user, perhaps only half-joking. While their fashion prowess will live on through re-runs and Instagram fan accounts such as @everyoutfitonsexandthecity, their honest representation of female friendship will die with them. I'll miss their finery, but more than that, I'll miss their flaws. As someone who grew up with them, I'd have happily watched these women navigate life, love and Loewe into old age. 'I'd have loved the actresses to make it to 'Golden Girl' status and create their own commune,' Rogers admits. 'But I always thought Carrie should have a certain ending, and when I read the last script of season three, I knew the final cosmopolitan had been drunk. I have not processed what it means – though superficially, it means no more stoops, no more closet scenes and no more shoe shots. It was the most incredible experience of my life. 'I saw the world and learnt from Pat and Sarah Jessica how to achieve visual success. The key to that is to be detail-oriented to a fault, make everyone around you nuts because you demand perfection – and never, ever, settle or compromise on an outfit.' Carrie couldn't have said it better.
