Probe 171 alleged fake encounters in 2021: SC to Assam rights panel

NEW DELHI: The SC on Wednesday asked the Assam Human Rights Commission (AHRC) to inquire into 171 alleged incidents of fake encounters carried out by state police in 2021 but said barring a few incidents the PIL petitioner's claim about fake encounters appeared to be speculative.
A bench of Justices Surya Kant and N Kotiswar Singh disposed of a petition by an advocate Arif M Y Jwadder and said, "We direct the AHRC to issue a public notice inviting all individuals who claim to be aggrieved (victims and their family members) by the alleged police encounters to come forward and furnish relevant evidence."
Allowing AHRC to select team of police officials unconnected to the encounters for further inquiry into some cases if the need be, the bench said "fair and impartial inquiry" is a right of citizens aggrieved by police action and expected AHRC to adopt robust measures akin to witness protection protocols to safeguard the privacy, safety and security of those participating in the inquiry process.
The state, in its counter-affidavit had said that out of a total of 171 cases, chargesheets have been filed in 125 cases, forwarding reports submitted in 23 cases, and remaining 23 cases are under investigation. Writing the judgment and examining the allegations of the petitioner, Justice Kant said that he has failed to independently place on record any cogent or verifiable material to substantiate the allegations.

Justice Kant said, "After minutely scanning such data, prima facie it seems that barring a few cases, it is difficult to infer that there has been a procedural breakdown, or the guidelines (relating to encounter inquiry) were flagrantly violated. " Referring to the status report relating to each FIR furnished by Assam, the bench said, "These documents prima facie belies the (petitioner's) claim of inaction and do establish that, at least at the foundational level, the criminal process was duly initiated.

The information, a 29-page annex to the special counsel's 2023 report, reveals that a foundational document for that theory was most likely stitched together by Russian spies. The document is a purported email from July 27, 2016, that said Hillary had approved a campaign proposal to tie Trump to Russia to distract from the scandal over her use of a private email server. The release of the annex adds new details to the public's understanding of a complex trove of 2016 Russian intelligence reports analysing purported emails that Russian hackers stole from Americans. Officials did "not know the accuracy of this allegation or the extent to which the Russian intelligence analysis may reflect exaggeration or fabrication," he said. Among some Trump supporters, the message became known as the "Clinton Plan intelligence," as Durham put it in his final report. Durham was never able to prove any Clinton campaign conspiracy to frame Trump by spreading information that it knew to be false, but he used court filings to insinuate such suspicions. 1 2 Kolkata: Bengal chief electoral officer Manoj Agarwal wrote to all political parties on Friday to send him their list of booth level agents (BLAs) so that procedure for the revision of electoral rolls could be started. Without the consent of BLAs, deletion of names from a voters' list is not possible. Bengal's booth count might increase to over 1 lakh ahead of the elections from the present 80,000, and this poses a challenge to parties since BLAs have to be voters of the booths they would represent. There are plans for a training programme for the BLAs to update them about their role in the roll revision process, an EC official said. In April, a training programme was held for BLAs of Bihar in Delhi. "The training is expected to give BLAs an overview of the importance in the election processes. The training would help them fulfil their responsibilities and familiarise them with various aspects of the election process, including the preparation, updating and revision of electoral rolls," the official said. District magistrates, who would be acting as district election officers, have also been asked to submit a list of the BLAs from their respective districts. Following the directives of the EC to restrict each booth to 1,200 voters, the CEO is planning to reorganise the booths, increasing booth count by over 20,000. On Wednesday, the EC asked the CEOs to get ready for the special intensive revision of the electoral rolls, for which the involvement of the BLAs is imperative. The letter from the EC stated, "The entire exercise of SIR will be incomplete without active participation of the political parties, and BLAs, appointed by the political parties, have to play an important role in the SIR activities. Therefore, all the political parties must be informed in writing, and they should be persuaded for the appointment of BLAs immediately so that these BLAs are in the field during SIR and they can bring out any kind of anomaly to notice. "
