Spanish-language journalist remains in ICE custody despite being granted bond

A week after an immigration judge granted him bond, a Spanish-language journalist who was arrested while covering a protest last month remains in federal custody.
Police just outside Atlanta arrested Mario Guevara while he was covering a protest on June 14, and he was turned over to U.S. Immigration and Customs Enforcement several days later. He was being held at an immigration detention center in Folkston — in southeast Georgia, near the Florida border — when an immigration judge last week granted him bond.
But when his family tried to pay the $7,500 bond last week, ICE didn't accept it and he has since been shuffled between three other jails, his lawyer Giovanni Diaz said.
'We are of the opinion that there seems to be a concerted effort between different jurisdictions to keep him detained,' Diaz said.
Guevara built a large following
Guevara, 47, fled El Salvador two decades ago and drew a loyal audience as a journalist covering immigration in the Atlanta area. He worked for Mundo Hispanico, a Spanish-language newspaper, for years before starting a digital news outlet called MG News. He was livestreaming video on social media from a DeKalb County rally protesting President Donald Trump's administration when local police arrested him.
Guevara has been authorized to work and remain in the country, Diaz said. A previous immigration case against him was administratively closed more than a decade ago, and he has a pending green card application sponsored by his adult U.S. citizen son, the lawyer said.
After Immigration Judge James Ward granted him bond, Guevara's family tried several times to pay it online but it wouldn't go through, Diaz said. They then went to pay it in person and ICE refused to accept it, he said.
'What we didn't know was what was going on in the background,' Diaz said, explaining that they have since learned that ICE was challenging his release to the Board of Immigration Appeals and asked to put the bond order on hold while that's pending.
Moved from jail to jail to jail to jail to jail
Another of Guevara's attorneys was then told that he was being transferred to Gwinnett County, in suburban Atlanta, because there were open warrants for his arrest on traffic charges there. He was taken to the Gwinnett jail last Thursday and was released the same day on bond in that case.
Because his immigration bond had not been paid, he was taken back into ICE custody at that point, Diaz said. He was taken to Floyd County, about 65 miles (105 kilometers) northwest of Atlanta, where the county sheriff's office has an agreement to detain people for ICE.
Floyd County Jail records showed that he was in custody there until Monday. Diaz said Guevara was then moved to a federal Bureau of Prisons facility in Atlanta, where he remained on Tuesday.
The immigration judge agreed with Guevara's lawyers that the journalist is not a danger to the community, but ICE is arguing he's such a threat that he shouldn't be released, Diaz said.
'We think it's overkill,' the lawyer said. And in what Diaz characterized as a concerning development, Guevara was told while in custody in Gwinnett County that his phone was confiscated under a search warrant.
What video of Guevara's arrest shows
The video from his arrest shows Guevara wearing a bright red shirt under a protective vest with 'PRESS' printed across his chest. He could be heard telling a police officer, 'I'm a member of the media, officer.' He was standing on a sidewalk with other journalists, with no sign of big crowds or confrontations around him, moments before he was taken away.
DeKalb police charged Guevara with unlawful assembly, obstruction of police and being a pedestrian on or along the roadway. His lawyers worked to get him released and he was granted bond in DeKalb, but ICE had put a hold on him and he was held until they came to pick him up.
DeKalb County Solicitor-General Donna Coleman-Stribling on June 25 dismissed those charges, saying that while probable cause existed to support the arrest, there wasn't enough evidence to support a prosecution.
'At the time of his arrest, the video evidence shows Mr. Guevara generally in compliance and does not demonstrate the intent to disregard law enforcement directives,' her office said in a news release.
Amid outcry over arrest, traffic charges filed
Guevara's arrest immediately drew widespread attention and was criticized by press freedom groups, which said he was simply doing his job.
On June 20, the Gwinnett sheriff's office said it had secured warrants for Guevara's arrest on charges of distracted driving, failure to obey a traffic control device and reckless driving, saying that, he had 'compromised operational integrity and jeopardized the safety' of victims of a law enforcement case, investigators an Gwinnett residents.
An initial incident report says the charges stem from a May 20 incident, which it says was reported June 17 — three days after his arrest at the protest. The narrative section of the report gives no details. Diaz said people charged with traffic violations are usually charged on the spot, and it is very unusual for an officer to swear out a warrant for arrest on such a violation a month later.
"None of this is normal," Diaz said.

She was pulled over by authorities at 4:00 a.m. ET after they saw a vehicle make a U-turn at a red traffic light, according to police. (She also faced a separate traffic charge, police said.) The Yeah Glo! performer told police that she had drinks earlier in the night, police said in their report, noting that her vehicle smelled like alcohol and marijuana. GloRilla performed poorly on a field sobriety test officers conducted with her, authorities said. Police said that GloRilla, who's been linked to NBA star Damian Lillard, was unable to follow a target with her eyes, walk steadily, and balance on one leg. The F.N.F. (Let's Go) rapper declined to take a breathalyzer test, police said, at which point she was taken into custody. GloRilla had an associate retrieve her vehicle from the scene, authorities said. Earlier this year she hit the road in March and April for her Glorious Tour, which had stops stretching from the east to west coasts. Whitney Purvis has been released from custody and has returned home after she was charged with involuntary manslaughter. Purvis, 33, who appeared on the MTV reality show 16 and Pregnant, was arrested earlier this month in connection with the fatal February 17 drug overdose of her friend John Mark Harris at 37. Authorities said she provided him with the narcotics that led to his tragic end. The television personality was granted a bond of $15,000 by a Georgia court last Thursday, with conditions including sobriety and a curfew. At that time, it was not immediately clear if Purvis would be able to make bond, insiders told TMZ, which first reported the news. Now, however, it has emerged that she left jail this Monday after a judge amended the agreement to stipulate that she could go home once she had been in Floyd County Correctional Institution for 14 days, according to People. She must abide by all the other conditions previously set, including that she keep a 7 p.m. to 7 p.m. curfew; stay at a residence in Bartow County, Georgia named by the court; and refrain from consuming drugs or alcohol. Purvis is not permitted, under her terms of release, to initiate contact with any members of the family of the victim, according to court documents reviewed by TMZ. Purvis on March 3 took to the site of the funeral home which handled arrangements for John Mark Harris, and penned a memorial in his honor. The MTV star posted the message more than three months before she was arrested Monday in Floyd County, Georgia in connection with with involuntary manslaughter and distribution of a controlled substance, among other felony counts, TMZ reported July 7. Purvis 'distributed a substance presented as "Tranq," commonly known as Xylazine and Fentanyl, to the victim, which directly contributed in the victim's death due to a toxic overdose,' law enforcement officials said in an arrest affidavit reviewed by People. It's been an awful year for Purvis, who would later pen an emotional memorial for her son Weston following his death at the age of 16 on June 2; Daily Mail has reached out to Purvis via Instagram for further comment on this story. Purvis thanked her late confidante 'for being such a great friend to me and always making me feel beautiful and cared for.' Purvis said that her late friend had been a dear one, as they grew close over their passion for cooking: 'We bonded over being chefs, our love of cooking and our struggle.' Harris had been employed as a chef at Barnsley Gardens, a popular North Georgia resort. She praised Harris for his candor and intelligence in their interactions over the years. 'I could tell you anything and you always knew what to say or give me your honest opinion and advice,' Purvis said. I'll miss sitting outside, smoking camel crush cigs w/ you how we talked about talked about life, gossiping and you telling me what movies/shows I need to watch next.' Purvis characterized her late friend as 'a truly good hearted, one of a kind man' who she would 'never forget.' Purvis, who has more than 17,800 followers on Instagram, wrapped up in saying: 'Rest in peace and my condolences to your family and friends. 'I pray they are able to find some kind of comfort during this tragic time. I love you forever, John Mark. Love, Whitney.' Following the death of her son last month, Purvis spoke on social media about how she was understandably struggling in the wake of her child's unexpected passing. 'This is so hard to write,' Purvis said. 'My beautiful son, Weston has passed away. He was only 16 years old. Life is so cruel and unfair. I just dont understand. 'Oh my baby is gone and I don't know what to do with myself. He was so perfect. This is really my worst nightmare come true. 'How do you go on in life after losing a child?' Purvis said she was 'in disbelief,' thinking that 'this cannot be happening' and that she didn't 'want it to be real.' She added of her late son: 'I love you so much, Weston Owen Gosa. The British teenager Bella Culley is to be held in a Georgian prison for at least five more weeks as she awaits trial on drug-smuggling charges, a court in Tbilisi has ordered. Culley, the great-granddaughter of a former Labour MP, was arrested on arrival at the city's airport in May. Georgian prosecutors said she was carrying a large amount of illegal drugs in luggage she brought with her from Thailand. During a short hearing on Thursday, she reportedly told the court in the Georgian capital: 'I hope you understand my story through my eyes. I never thought something like this would happen to me.' Her lawyer, Malkhaz Salakia, said there was no evidence she had any intention of breaking the law, adding: 'There were people who forced my client to commit this unknowingly.' It was reported that Culley concluded the submission to the court by saying 'madloba' – 'thank you', in Georgian. 'Bella will become a mother soon, she is expecting a boy,' Salakia told the court. 'I want her to feel this motherhood in freedom. It's a moment of her becoming a mother for the first time in her life – she turned 19 this June. 'Since the crime committed is not connected to Georgia, and her family has been here – father before and now the mother is here – they are here to look after her, and there is no possibility of influencing the witnesses because they are police and officials, she can be assigned to visit the police department two times per month or every day. 'However, the judge decides – she will fulfil her duty. It's summer, and a pregnant woman needs special hygiene in the month of July – we are offering a plea agreement of 50,000 [Georgian lari; over £13,500], which will be paid immediately and we ask her immediately to be set free.' But the judge decided no new evidence had been presented and, consequently, Culley would remain in detention until her trial began on 2 September unless a plea deal could be agreed beforehand. Culley exchanged regular looks and smiles with her mother, Lyanne Kennedy, during the 30-minute hearing and Kennedy became emotional after learning the sex of her unborn grandchild. 'I'll come and see you tomorrow, I love you,' she reportedly told her daughter. Georgian authorities said Culley, who is from Billingham on Teesside, faced up to 20 years in prison or a life sentence if she was found guilty. Local police said officers seized up to 12kg of marijuana and just over 2kg of hashish in a travel bag at Tbilisi international airport. Culley is the great-granddaughter of Frank Cook, a Labour MP who represented Stockton North for 27 years, rising to become a deputy speaker of the Commons. Cook died in January 2012, aged 76. The Foreign Office has previously confirmed it was 'supporting the family of a British woman who is detained in Georgia'. Cleveland police, on Teesside, confirmed an 18-year-old woman from Billingham had been arrested in Georgia on suspicion of drug offences and remained in custody.
