The Supreme Court of India on Thursday pulled up the Karnataka government and the State Film Chamber for not acting against those who threatened violence over the release of actor-politician Kamal Haasan's film Thug Life. While recording the state's affidavit stating it had imposed no restriction on the film and would provide full security if the producers chose to release it, the court questioned why action was not taken against those who had issued threats.advertisement'If the mob is attacking you, then you should approach the police. The Chamber later claimed it had acted under pressure and did not intend to obstruct the release.The bench, which was hearing petitions filed by the producer and a third party seeking guidelines on hate speech and threats of violence, said freedom of expression could not be curtailed by claims of hurt sentiments. 'Should stand-up comics be stopped? Should poets not recite poems?' the court asked, emphasising that a diverse country like India cannot allow mobs to dictate what can or cannot be released.
The petitioner argued that the state's affidavit granted 'king-like immunity' to those threatening arson, pointing out that it made no mention of initiating prosecution. He cited earlier rulings where the Supreme Court had held states accountable for failing to protect filmmakers and theatre owners.advertisementThe counsel for the Sahitya Parishad, which intervened in the matter, stated the organisation believed the actor's comments had hurt public sentiment but assured the court it would never support violence. The court recorded this assurance and asked both the state government and the Parishad to abide by their statements.When the petitioner demanded compensation for the filmmaker, the bench refused, saying, 'You think Rs 20 or Rs 30 lakh will make a difference to him?' The producer claimed losses of up to Rs 30 crore. It concluded that it would not be appropriate to issue new guidelines or enter into rival contentions, given the producer's satisfaction with the government's affidavit.The Karnataka government maintained that the dispute arose between the producer and the Film Chamber, and the producer had voluntarily withheld the release. The court reiterated that the state was now bound by its affidavit and urged all parties to act with restraint.'This is a diverse country. If sentiments are constantly cited, nothing will ever be released. The state must act proactively against such threats. You cannot take law into your own hands,' the bench said.

Bolpur: A court in West Bengal's Birbhum district on Monday granted bail to TMC leader Anubrata Mondal after he surrendered in the court and moved an anticipatory relief petition in connection with the case of alleged use of abusive and derogatory language during a telephonic conversation with a police officer. Mondal's plea on health grounds was accepted by Judicial Magistrate Banikbrata Dutta of Bolpur Subdivision Court on a surety of Rs 1,000 and on condition that he will continue to cooperate with the probe and meet the investigating officer (IO) when summoned, court officials said. In a leaked four-minute telephonic conversation between Mondal and Bolpur police station inspector-in-charge Litan Halder on May 29 this year, the authenticity of which PTI couldn't independently verify, the Birbhum Trinamool Congress leader was heard hurling invectives at the police officer and threatening his wife and mother. Left red-faced by the audio-clip, the party issued him a four-hour apology deadline and a suo motu FIR was lodged against him by the police. Mondal was issued police summons and his security details withdrawn. Faced with party annoyance, Mondal tendered written apologies to both the police officer and the TMC state president Subrata Bakshi but avoided responding to the initial summons from Bolpur Police. On June 6, seven days after the purported audio clip surfaced, Mondal appeared before the Bolpur SDPO where his cell phone was reportedly inspected. Mondal arrived at the Bolpur Subdivision Court around 10.40 am on Monday for his voluntary surrender and his bail hearing was taken up post 2 pm. "The court granted him bail considering his age and the physical ailments he suffers from. There are no pre-conditions to his bail," said Nupur Dutta Banerjee, Mondal's counsel. "I had submitted before the court that the IO in this case did not duly comply with the notice served to Mondal under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, which outlines the procedure for police to issue a notice to individuals in cognisable offenses where arrest isn't immediately necessary," said Phiroj Pal, government lawyer, confirming that he opposed the bail prayer. "Secondly, we are still not privy to the police's case diary (CD) and have no idea how far the investigations in this case have so far progressed. We wanted the court to wait till we had the CD in our hand," he added. Pal said that the court was prima facie satisfied with the petitioner's submission that Mondal has cooperated with the police and that there has been no progress in the probe for a formidable period. In September 2024, Mondal was granted bail in the multi-crore cattle smuggling case when he stepped out of the Tihar Jail after remaining imprisoned for over two years.

Vijayawada: The high court on Monday granted bail to former minister Kakani Govardan Reddy in an alleged illegal quartz mining case. The court directed Govardan Reddy to surrender his passport and to appear before the investigation officer every Sunday. The High Court also refrained him from making any kind of public statement about the case. Police registered a case against Govardan Reddy based on a complaint given by Balaji Naik, Nellore district deputy director for mining, over alleged illegal quartz mining done by encroaching govt land in Varadapuram under Podalakuru mandal. Police arrested Govardan Reddy, and the trial court sent him to judicial remand. He moved the High Court after his bail application was rejected by the trial court. Govardan Reddy, who is facing criminal charges in seven cases, obtained bail in all other cases, except in the illegal mining case. He was in judicial remand for the last 75 days. While granting bail in the illegal mining case, the High Court imposed several conditions. Govardan Reddy was directed not to enter Nellore district until the police file a charge sheet in the case. He should not leave Andhra Pradesh and Telangana without prior permission. He should not influence the witnesses in any manner, and his passport should be surrendered until the completion of the trial. Two sureties of Rs 2 lakh each should be furnished, and any violation of bail terms will be considered as deemed cancellation of bail. Kolhapur: NCP (SP) state president Shashikant Shinde demanded state govt must declare a "wet drought" in the districts facing heavy and incessant rain over the past few days and grant financial aid of Rs 50,000 to the farmers who faced crop loss. Speaking in Satara on Monday, Shinde said in the past few days, there has been heavy rainfall across the state, the rivers are in spate, and crops have been damaged. "After the rainfall in May, we had demanded that state govt declare 'wet drought' in the state and compensate the farmers. We were then informed that a wet drought can be declared only after it meets specific criteria. In the past few days, heavy rain has been battering the state, causing rivers to flood and ready crops to be washed away. What else is required to qualify for the declaration of the wet drought?" asked Shinde. There is no formal term of 'wet drought' used by the authorities, but it generally means excessive rainfall in a short time causing heavy crop losses. Shinde said the heavy rain since May has affected kharif sowing. "Govt works for the contractors, industrialists, and the people living in the cities. It has completely ignored the farmers. We demand govt must pay Rs 50,000 per acre to the farmers as immediate relief. Also, we demand a special session of two days be called to discuss the plight of the farmers," added Shinde.
