Pune police move sessions court against Juvenile Justice Board's rejection of plea to try teenage driver in Porsche crash case as adult
Pune: The city police have filed an appeal before the sessions court against the Juvenile Justice Board's (JJB) order of July 15 this year, which rejected their plea to try the 17-year-old driver in the Porsche Taycan car crash case as an adult. The crash on May 19, 2024, had claimed the lives of two young IT professionals in the Kalyaninagar area. Deputy commissioner of police (crime) Nikhil Pingale told TOI on Monday, "The Pune district collector, on behalf of state govt, gave us permission on July 31, 2025, to file the appeal. It was filed before the sessions court on Aug 4." You Can Also Check: Pune AQI | Weather in Pune | Bank Holidays in Pune | Public Holidays in Pune The JJB, while rejecting the police's plea, had relied on a Supreme Court ruling of Jan 9, 2020. It held that the offence attributed to the minor in the case could not be considered as 'heinous' under the ambit of the Juvenile Justice (Care & Protection) Act to merit his trial as an adult. The teenager's lawyer had argued, among other things, that the offences attributed to the minor could not be termed as 'heinous' in nature considering the said SC ruling. The apex court had held that offences prescribing a maximum sentence of more than seven years but not providing any minimum sentence or providing a minimum sentence of less than seven years, cannot be considered a 'heinous offence' within the meaning of section 2 (33) of the JJ Act. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like This Japanese AI invention allows you to speak 68 languages instantly. On Monday, lawyer Sarthi Pansare, who is assisting special public prosecutor Shishir Hiray, told TOI that the Pune police's appeal, filed under Section 101 of the JJ Act, states that the accident involving the teenager should be treated as an "exceptional case" and his psychological assessment was imperative to know if he acted as a minor or a major at the time of the accident. Pansare said, "Section 467 (forgery) of the Indian Penal Code (IPC) applied in this case for tampering with valuable security (blood samples) provides for a life imprisonment as the maximum punishment but does not provide for a minimum sentence. Our case is that if a minor tried under this section is convicted, s/he can be sentenced to a minimum period of seven years under section 233 (2) of the JJ Act. Our case is that at the time of the incident, the teenage driver was 17 years and eight months old. So, his psychological evaluation was needed. For that purpose, the JJB should have treated the minor as an adult." Pansare said the appeal will be listed for hearing before a special court in due course of time. Two young software engineers were killed when the 17-year-old son of a prominent Pune-based builder rammed their bike from behind at Kalyaninagar junction around 2.30am on May 19, 2024. This occurred while the teen was driving the high-end car back to his bungalow in Wadgaon Sheri after late-night partying with friends at a couple of pubs in Mundhwa. The teenager was released from an observation home after Bombay high court on June 25, 2024, held that his continuation there was illegal. In between, the Pune police had filed an appeal seeking his trial as an adult. Stay updated with the latest local news from your city on Times of India (TOI). Telangana high court quashes dowry harassment case against retd SP, wife
Hyderabad: The Telangana high court quashed criminal proceedings against a retired additional SP and his wife, a govt teacher, in a dowry harassment case registered by their daughter-in-law's father. Finding no evidence against the couple, the court ruled that they could not be subjected to the ordeal of trial, especially when there were no allegations of cruelty or harassment or any demand for dowry against them. The court examined the case facts and the evidence on record. Further relying on precedent judgments in similar matters, it noted that the couple (petitioners) could not be dragged into criminal prosecution, as doing so would be an abuse of the process of law. Consequently, the case was quashed. The case was registered at the women's police station at Gachibowli in 2021 and was pending before the court at Kukatpally. According to the complaint, at the time of the wedding, the complainant, a businessman, spent around Rs 50 lakh on the wedding, gave one kg of gold to his daughter, and Rs 20 lakh in cash to his son-in-law's family. However, his daughter was allegedly harassed for an additional dowry of Rs 25 lakh. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Get ₹2Cr life cover@ ₹700 p.m. ICICI Pru Life Insurance Plan Get Quote Undo You Can Also Check: Hyderabad AQI | Weather in Hyderabad | Bank Holidays in Hyderabad | Public Holidays in Hyderabad After the wedding, the daughter and son-in-law migrated to the US. However, after his daughter was diagnosed with thyroid cancer, the son-in-law brought her to India, left her with her parents and returned to the US. Later, after she flew back to the US to be with her husband, the harassment for additional dowry continued, the complainant alleged. When the matter came before the high court, it was observed that except for stating that the petitioners had instigated their son in harassing his wife, not a single instance of harassment, cruelty, or demand for dowry was referred against them. "It is also an admitted fact that the petitioners are staying away from their son and daughter-in-law, and therefore there was no occasion or necessity for them to harass their daughter-in-law," recorded the court. The court also pointed to the delay in lodging the complaint in 2021 when the marriage was solemnised in 2018 and the alleged harassment started immediately. Patidar women in Morbi barred from joining mixed-gender garba classes
Rajkot: In an unprecedented diktat in the run-up to Navratri, the Patidar community in the ceramic town of Morbi has prohibited its women from joining co-ed garba training classes so that 'notorious' elements don't exploit the 'innocence' of females. Tired of too many ads? go ad free now A resolution to the effect was passed with majority support at a massive congregation of various Patidar associations organised on Aug 2, attended by thousands, including politicians and local MLAs. Patidars, who account for nearly 70% of Morbi's population, have also directed the garba organisers not to open classes in areas such as Ravapar Road, Patel Nagar, SP Road, and Alap Society, where the community resides in significant numbers. Justifying the decision, Manoj Panara, president of Patidar Yuva Sena Sangh, told TOI, "This decision was taken after reports that some men joined garba classes only to target young women. When men and women dance together to love songs for three months in garba classes, it's natural that they may get attracted to each other. Some notorious people join these classes only to woo girls and exploit their innocence." As an alternative, the community has started women-only garba training centres at five locations, including Kanya Chatralay, Patel Nagar, Vaibhav Nagar, and Ravapar Road. The academies have been strictly told to employ only female choreographers for women, have separate training timings for men and women, and verify the identity of trainers and participants, considering the safety of the women of other communities who also join these classes. Sanjay Vyas, president of the Morbi Garba Classes Association, lamented the financial loss but said the organisers have agreed to comply. "They are in the majority, and we are all connected in business. Tired of too many ads? go ad free now We don't want to take responsibility if anything adverse happens," he said. There are 27 garba classes in Morbi, with a majority of them starting three months before Navratri, while around seven classes teach garba and other dance forms throughout the year. The associations have not explicitly spelt out how they would deal with violations of the rules, but said their members will meet the parents of the women flouting the decision and counsel them.
