Kashmir: Court dismisses poll code violation case against Parra
'The challan (police chargesheet) is dismissed and the accused is released. The bail bonds and personal bonds of the accused are discharged,' it said.
The police had filed the case against Parra in May 2024 for organising a rally in alleged violation of model code of conduct during parliamentary elections in April, 2024 without obtaining the necessary permission. The police had filed the chargesheet against Parra on September 14, 2024.
'By no means can the model code of conduct be classified as an order under Section 188 of the IPC,' the court observed. Parra eventually lost the May 2024 parliamentary election from Srinagar parliamentary seat but won assembly election from Pulwama assembly seat in October 2024.
The order said that the model code of conduct serves solely as guidance for political parties and candidates. 'It was established through the consensus of political parties in India with the aim of strengthening the foundations of the political system in our country. Clearly, it lacks statutory backing and many of its provisions are not legally enforceable. It is the political parties themselves that have agreed to adhere to the principles outlined in this code, thus binding them to respect and follow it both in letter and spirit,' the court said.
The five-page judgment stated that even if the model code of conduct was considered an order under Section 188 of the IPC, the document MCC itself does not specify which public servant issued this order.

Under HC lens, Punjab govt puts land pooling policy on hold for a day
Chandigarh: The Punjab govt on Wednesday informed the Punjab and Haryana high court that its contentious Land Pooling Policy 2025 would be kept on hold and no further steps taken until the next hearing on Thursday. The state govt's decision came in response to a petition challenging the policy, which aims to acquire thousands of acres of land for developing residential and industrial zones. When the matter came up for hearing, the advocate general, Punjab, requested time to address the contentions in the petition challenging the policy. A bench, headed by Justice Anupinder Singh Grewal, directed the Punjab govt to clarify whether the policy includes provisions for the rehabilitation of landless labourers and others dependent on the land for their livelihood. The bench further questioned the state on whether a social impact assessment was conducted before the policy was notified. It also referred to a Supreme Court verdict in a case of Residents' Welfare Association and another versus Union Territory of Chandigarh emphasising the need for an environmental impact assessment before urban development. The petition was filed by Gurdeep Singh, a 72-year-old resident of Ludhiana, who claimed to have inherited six acres of agricultural land. He argued that the policy is illegal and violates fundamental rights by bypassing mandatory procedures under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (LARR Act). SIDHI HORROR: Dalit girl gang raped by 5, friend beaten
Bhopal: A 19-year-old Dalit girl was allegedly gang-raped by five men in a forest area near Churhat in Sidhi district of Madhya Pradesh on Wednesday. Police have launched a manhunt to trace the suspects, three of whom have been detained. They allegedly assaulted the boy, leaving him unconscious, and took turns to rape her. The attackers also snatched their mobile phones and threatened them with dire consequences if they reported the incident. The survivor managed to reach a nearby construction site around 2.30 pm and narrated her ordeal to locals, who alerted the police. Based on her complaint, a case was registered at Churhat police station under relevant sections of the IPC and SC/ST (Prevention of Atrocities) Act. Police said evidence has been collected and teams are conducting searches in nearby villages. "Efforts are on to nab the main accused," said a senior officer.
