Selangor may go after Rawang developer's BOD

Selangor government may hold the board of directors (BOD) of a defunct developer responsible for selling bumiputra units to non-bumiputra buyers in Rawang.
The liquidator has been given three months to identify the former directors and compile records of outstanding debts and unclaimed payments, said Taman Templer assemblyman Anfaal Saari.
A total of 574 homeowners in Taman Amansiara, who had unknowingly bought bumiputra- designated units, have been unable to obtain their strata titles as they were told to pay hefty penalties.
The amount, totalling RM7.89mil, is equivalent to the 7% bumiputra discount on the purchase price of the units.
Anfaal said during a recent meeting, Selangor housing and culture committee chairman Datuk Borhan Aman Shah had instructed the liquidator to carry out the actions against the former directors.
'The next step is to determine the appropriate legal recourse, whether through a letter of demand or legal action against the former directors,' she told StarMetro.

Anfaal said while the company and its directors were legally separate entities, former directors often formed new companies to avoid accountability.
'We do not want to see this modus operandi repeated.'
She added that Selangor Housing and Property Board (LPHS) would review the liquidator's actions before any decision was made.
'One of the suggestions is to seek state executive council approval to waive the 7% penalty imposed on homeowners.'
Anfaal said efforts were being made to find a solution that maintained adherence to state housing policy while also protecting the rights of homeowners.
The meeting also involved the liquidator, land office representatives and Taman Amansiara Joint Management Body (JMB).
In 2023, buyers received a notice from the liquidator that they had been sold units meant for bumiputra.
The liquidator found that about 90% of units were sold to non-bumiputra buyers.
Taman Amansiara JMB president Susan Lawrence said the buyers hoped for a favourable outcome.
'I don't understand why owners are unfairly being asked to pay the 7% penalty when we bought the units at full price without receiving any discount,' said Lawrence, who is one of the affected owners.
StarMetro had previously reported that Selangor government had waived RM15.32mil in penalty fees for 207 non-bumiputra homeowners in USJ One Park, Subang Jaya.
Under the policy, developers are required to set aside a percentage of available units in a scheme for purchase by bumiputra buyers.
Selangor enforces a 40% bumiputra quota, together with a 7% discount.
There is a strict mechanism that housing developers must adhere to before the units can be sold to non-bumiputra buyers.

This follows the planned implementation of the new system in three local councils in the state, including MPS, on Aug 1. 'A coordination meeting between MPS and the new concessionaire was held on Aug 6 to discuss technical and operational matters, including payment systems and enforcement procedures. 'The new parking management system aims to be more systematic and efficient,' said MPS Corporate Department director Zulaina Abu Talib. The planned privatisation of street parking in Selangor involves four selected local councils first, namely MPS, Subang Jaya City Council (MPSJ), Shah Alam City Council (MBSA), and Petaling Jaya City Council (MBPJ). It is to streamline parking management under a public-private concession. Currently, the first phase of SIP has proceeded with Subang Jaya, Shah Alam and Selayang. Meanwhile, negotiations with MBPJ is still ongoing for the implementation in Petaling Jaya. The parking system is operated by Rantaian Mesra Sdn Bhd, a wholly-owned unit of Menteri Besar Selangor Incorporated (MBI), under a 10-year concession with local councils and a private partner. Revenue is split 50% to the concessionaire, 40% to the local council and 10% to MBI. Enforcement will be carried out by the concessionaire in cooperation with the respective councils. In a new development, ITMax System Bhd has announced that its 70%-owned subsidiary Selmax Sdn Bhd has been appointed by MBSJ and MBSA to be the SIP operator in partnership with Rantaian Mesra. ITMAX, in a media statement, said that under the SIP, Selmax would be responsible for deploying, managing and operating all gazetted carpark spaces under both local authorities' jurisdiction. The 10-year appointment also includes a five-year extension option. State education and information committee chairman Aznan Tamin said the annual book fair used to be a localised event. 'This is the first time we have added an international element. 'We saw exhibitors from Singapore, Indonesia, China, Turkiye and Iran among the 89 that took part over five days,' he told StarMetro. The bazaar recorded over 55,000 visitors on its opening day alone, which Aznan said reflected growing public interest in book-related experiences. 'Johor's strategic location – bordering Singapore and close to Indonesia, especially Batam – positions it well to host international literary events that double as tourism draws. 'We believe this event can grow to become a permanent fixture in Johor's tourism calendar,' said Aznan, who is also Johor Public Library Corporation (PPAJ) chairman. He said the bazaar was not just about sales – there were side activities for visitors to enjoy such as sharing sessions, book signings and choral speaking for schoolchildren. Aside from the bazaar, he said efforts were underway to turn libraries into tourist attractions, starting with PPAJ's main branch in Jalan Yahya Awal, which is the first in the country to collaborate with Petrosains. 'Visitors can explore interactive science exhibits there. 'The library is also a popular place for families, especially on weekends. 'We want our libraries to be seen not just as learning spaces but as fun, engaging destinations for all ages,' he said. Aznan said discussions with Tourism Johor would take place soon. He thanked local and international partners including the state Education Department, non-governmental organisations and publishers for making JIBB a success, and called on more collaborators to help expand the event into a regional highlight.
