Karnataka high court faults driver for parkingbus on road without lights on
Bengaluru: Finding fault with the parking of a bus on the road with lights switched off, the high court upheld the order passed by a Motor Accident Claims Tribunal in Bengaluru.
The tribunal had held that the driver of the Andhra Pradesh Road Transport Corporation (APSRTC) bus had contributed 30% to the negligence that caused an accident claiming two lives in 2005.
On June 27 of that year, Bengalureans Doreswamy Reddy, his wife N Jyothi and their son N Prashanth and daughter-in-law Supraja were returning from Tirupati by a car driven by one Rajagopal. Around 8.45pm, when the car reached the Gandlapalli bus stop on the Chittoor–Palamaner road, it hit the parked APSRTC bus from behind. Reddy and Prashanth died. The claimants contended that the bus was negligently parked on the road with parking lights off. It was also alleged that both the car and bus drivers were negligent in causing the accident.
The tribunal awarded a total of Rs 28 lakh in four claim petitions, including Rs 16.8 lakh compensation with regard to the death of Prashanth. The tribunal also held that the driver of the car was negligent to an extent of 70%, and the bus driver 30% in causing the accident.

APSRTC filed four appeals, challenging the award of Rs 28 lakh compensation for death and injuries caused in the accident, claiming that the driver of the car was solely responsible for the same. On the other hand, Supraja, and Jyothi, challenged the award of Rs 16.8 lakh compensation for Prashanth's death, citing that it was too low as the deceased was young and working as a partner in a construction company.
A division bench comprising Justices KS Mudagal and CM Poonacha noted that the accident occurred at 8.45 pm, and admittedly, the bus was stopped on the left-hand side of the road. "It is further forthcoming that the parking lights of the bus were switched off. The sketch also discloses that the bus was parked on the road and the width of the road was 40 feet," the bench pointed out while rejecting the appeals filed by APSRTC.
Regarding the appeal seeking higher compensation, the bench was of the view that no documents were produced to prove the income of the deceased except the income-tax returns filed after the death of Prashanth. The bench noted that the tribunal was right in assessing the income of the deceased at Rs 12,000 per month.
Placing reliance upon a couple of judgements of the Supreme Court, the bench said that the claimants are entitled to receive Rs 24 lakh together with interest at 6% as against Rs 16.8 lakh awarded by the tribunal in this particular claim petition.

Rs 1.5k-cr govt land cleared of scrap godowns & sheds in Gurgaon
Gurgaon: A govt land — valued at Rs 1,500 crore — in Sector 21 was cleared on Tuesday. The anti-encroachment drive saw demolition of 20 scrap godowns and 30 tin-set rooms and huts using bulldozers. Originally acquired by Haryana Urban Development Authority (now HSVP) in the late 1970s, this area was meant for developing a sector. The team cleared about 15 acres of Haryana Shehri Vikas Pradhikaran (HSVP)-owned land till evening. An HSVP official said the enforcement will continue on Wednesday, with a total of around 22 acres set to be cleared in the coming days. The official said, "Any future attempts to encroach will lead to FIRs and strict legal action." The drive saw heavy police deployment from Sector 22 police station. The enforcement was carried out in the presence of district nodal officer RS Batth along with a team of HSVP officials. Duty magistrate and SDE Surendra Babbar was also present. Soon after the operation began around noon, it faced resistance from locals and land claimants. Haryana govt subsequently appealed against this decision and the case is pending before Supreme Court.

Two men from Tiruvannamalai held for online job fraud
The Cyber Crime Police in the West Zone, Greater Chennai City Police has arrested two men who allegedly cheated several persons after receiving money by promising an online part time job. According to police, the complainant is 27 of Virugambakkam. The complainant said she received a Whatsapp message on the mobile phone promising an online part time job for Youtube promotion from an unknown person. Believing the message, the complainant started to complete the tasks assigned by the fraudster for getting high returns. She was then forced to make several payments to bank accounts that were mentioned by fraudsters but she did not receive her money back. She lost ₹3.61 lakh to the fraudsters. After analysing the call records, the Cyber Crime Police traced and arrested two men who have been identified as 28 and 29 of Tiruvannamalai district. Efforts are on to trace other suspects who were involved in the offence. Meanwhile, the Cyber Crime Police in North Zone has arrested a 39-year-old man for the same fraud. The suspect has been identified as 39 of Thirunindravur, Tiruvallur district and he was arrested by the police following a complaint from 27 of Old Washermenpet. The complainant alleged that she had received a call from a person claiming to represent Media Agency Recruitment in February last year. The caller offered an online part-time job that she would earn Rs 200 if she sent screenshots of a few videos. After clicking the links sent by the caller, she joined a group and received a meagre amount as an enumeration. Subsequently, the fraudster promised to get high returns if she invested more. Believing their words, she transferred Rs 4.54 lakh in 49 instalments to bank accounts mentioned by the caller. Later she could not withdraw the money and realised that she was cheated.
