Supreme Court cancels Kannada actor Darshan's bail in Renukaswamy murder case, says ‘no one is above the law'

The Supreme Court on Thursday, August 14, cancelled Kannada actor Darshan's bail in the Renukaswamy murder case and stated that 'no one is above the law'. The court also revoked the bail granted to actress Pavithra Gowda and five others. They are Nagaraju R., Anu Kumar alias Anu, Lakshman M, Jagadeesh alias Jagga, and Pradoosh S. Rao alias Pradoosh.
Supreme Court cancels Darshan's bail
In December 2024, the Karnataka High Court had granted bail to actor Darshan in connection with the Renukaswamy murder case. Now, nearly eight months later, the Supreme Court has overturned the judgment. This essentially means that Darshan must 'surrender or face arrest'. Earlier today, a bench comprising Justice JB Pardiwala and Justice R Mahadevan cancelled the bail and stated that the High Court's order was 'legally and procedurally flawed'. The ruling attacked the earlier decision for failing to record any 'special or cogent reasons' as required under Sections 302 and 34 of the IPC. It stated that the original verdict had left out crucial facts.

The Bench also stated that the 'well-founded allegations' of witness intimidation, which were backed by forensic and circumstantial evidence, made it necessary to cancel Darshan's bail. The bench further stated that not doing so would pose 'an imminent threat to the fair administration of justice.'
In a separate statement, Justice Pardiwala made it clear that the court is not in favour of Darshan being given 'five star treatment'. He added that if the court comes to know of any such activities, the jail superintendent will be suspended.
In July, the same Bench had reserved judgment on the matter after slamming the High Court's exercise of discretion in granting bail.
About the Renukaswamy murder case
According to police records, Darshan and his aides had allegedly abducted Renukaswamy– a fan from Chitradurga– in June 2024. The police further claim that he was beaten up and tortured on multiple days. Renukaswamy later died from the injuries and his body is said to have been dumped in a drain.
The sessions court had earlier refused to grant bail to the accused. This prompted them to approach the High Court, which granted bail in December 2024. The decision has now been nullified/overruled by the Supreme Court

Kanpur: The Additional Sessions Judge of Court No. XIV, Kanpur Nagar on Thursday sentenced a woman to life imprisonment for setting her mother-in-law afire in 2020. The court also imposed a fine of Rs25,000 on the convict, identified as Anshu alias Priyanka for the offence. Tired of too many ads? go ad free now According to the prosecution, complainant Sujit Kumar, a resident of Tiwaripur Bagia Jajmau, lodged an FIR stating that around 2am on Nov 2, 2020, his wife locked him inside a room before setting his mother Kiran Devi on fire. His sister later unlocked the room and he rushed out to find his mother engulfed in flames. Kumar suffered burn injuries while trying to extinguish the fire. The elderly woman was first admitted to Kanshi Ram Hospital and later referred to UHM Hospital, where she succumbed to her burn injuries during treatment. Initially, police booked the case under Section 326 of the IPC (causing grievous hurt by dangerous means). Following her death, the charges were amended to Section 302 (murder). Additional District Government Counsel Shiv Bhagwan Goswami told the court that the prosecution had presented evidence to establish the accused's role in the crime. During the hearing on the quantum of sentence, the defence sought leniency, arguing that it was the accused's first offence, that she was a mother of two children and that no eyewitness directly saw her set the victim on fire. They urged the court to impose the minimum sentence. The prosecution, however, pressed for the death penalty, terming the act as premeditated and heinous. The court observed that the prosecution had proved the charges beyond reasonable doubt and sentenced Anshu to life imprisonment.

New Delhi: The Delhi High Court has called the right of two consenting adults to choose each other as life partners and live together "a facet of their personal liberty and privacy" being immune to the family's disapproval. "The Supreme court has repeatedly affirmed this position and directed the police to safeguard such couples from intimidation or harm," Justice Sanjeev Narula said on August 5. The court, as a result, directed the police to provide protection to a young couple, who married against the wishes of their families and were now being threatened. "The right of two consenting adults to choose each other as life partners and to live together in peace is a facet of their personal liberty, privacy, and dignity protected under Article 21. Family disapproval cannot curtail that autonomy," the order highlighted. The couple sought the court's intervention to ensure their safety in living together, claiming threats, coercion and interference being extended by the family members. The court was urged to direct the woman's family not to harm them or interfere in their peaceful cohabitation. The plea said the woman's family was against their relationship and allegedly issued repeated threats of physical harm. It said due to the hostility and fearing for her safety, the woman left her parental home on July 18 after informing her mother about her intention to marry the man. The couple married in a temple on July 23 on their own free will and has been living together happily, it added. The high court then directed the station house office of the police station concerned to designate an official and sensitise him or her of the court order and provide immediate assistance to the couple in case of any complaint or threat. "The directions issued herein, particularly those concerning police protection, are purely preventive in nature, aimed at ensuring the petitioners' safety and safeguarding their right to life and liberty. They shall not be construed as an expression of opinion on the truthfulness of the petitioners' claims, nor as any endorsement," it said.
