Book on POCSO Act released in Madurai

Madras High Court Judge Justice L. Victoria Gowri on Sunday released a book raising awareness about the Protection of Children from Sexual Offences (POCSO) Act in Tamil and Braille. The book was written by Advocate K. Samidurai.
The event was organised by Indian Association of lawyers and Thuimai Vizhigal Arakattalai. Justice Victoria Gowri said there was a need to create awareness about the provisions of the POCSO Act. The provisions of another Act that also needed awareness was the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, she said.
Ignorance of law was no excuse, she said, adding that more such books need to be published to create an awareness among the public. People with social interest and social responsibility should unite and work towards bringing a change in society, she said.
She appreciated the efforts taken by the author Advocate Samidurai and said the question and answer format in the book made it easier for people to understand.
Senior Consultant Psychiatrist C. Ramasubramanian said the book was an important one and should be kept in schools to create awareness about the Act. The language used was simple and will help the readers, he said, adding that the Act was a tool to help the children and their families.
Madurai Government Law College Principal P. Kumaran urged the people to read the book. He said self discipline was important and advised the students not to get influenced by the contents on social media.
Advocate Samidurai thanked the dignitaries and provided free copies of the book to government schools in Madurai. He said the book will be distributed to other educational institutions.

RAIPUR: The Chhattisgarh HC has commuted the life imprisonment of a man convicted of raping his minor daughter to 20 years of rigorous imprisonment. The court, while upholding the conviction, found the original sentence too harsh considering the facts and circumstances of the case. 'While dealing with the said case, where the victim all throughout maintained her allegation against her father to be the person who committed forcible sexual intercourse with her and thus robbed her chastity. Version of the minor victim, in the facts and circumstances of the case, merits acceptance, inasmuch as, the evidence of rape victim is more reliable than even that of an injured witness. The minor contradictions and discrepancies in her testimony are insignificant and immaterial and are liable to be ignored,' the court observed. A division bench of Justice Rajani Dubey and Justice Sachin Singh Rajput pronounced the order, in an appeal filed by the 38-year-old father. He had challenged the judgment dated September 19, 2019, passed by the Special Judge (POCSO Act), Baikunthpur. The lower court had convicted the father under Section 376(3) of the Indian Penal Code (IPC) and sentenced him to life imprisonment along with a fine of Rs 1 lakh. During the trial, the prosecution examined eight witnesses. The victim testified that she had pain and bleeding following the rape by her father. She also stated that her father had threatened her not to disclose the incident. Dr. Ayushree Rai, who medically examined the victim, found signs of recent hymen rupture, supporting the prosecution's case. The defence argued that there was an unexplained delay of 15 days in lodging the FIR and that medical evidence did not support the prosecution's claims as no external injuries were found. The High Court, after reviewing the evidence, noted that while there was a delay in reporting the incident, such delays are common in cases involving sexual assault on minors due to social stigma. The court emphasized that the victim's testimony remained consistent and trustworthy across all stages, from the FIR to the cross-examination. The court cited a Supreme Court ruling which states that conviction can be based solely on the testimony of the prosecutrix if it inspires confidence and is reliable. The bench concluded that the prosecution successfully established its case beyond all reasonable doubt and found no fault in the trial court's decision to hold the accused guilty. However, on the matter of sentencing, the High Court referred to a similar case, Khemchand Rohra v. State of CG, and deemed the life imprisonment sentence to be excessively harsh. The court, therefore, reduced the sentence to 20 years of rigorous imprisonment, while maintaining the fine of Rs 1 lakh. A 23-year-old man from Chennai, identified as Kavin Kumar, has been booked under the Protection of Children from Sexual Offences (POCSO) Act on charges of sexually assaulting a 17-year-old girl from Kodumudi, whom he met on Instagram. The police said they developed a relationship over social media, and the accused made multiple visits to Kodumudi to meet the girl. During one such visit, he reportedly sexually assaulted her. The incident came to light when the girl showed signs of pregnancy; when her parents asked her about it, she disclosed the details of the incident. Based on a complaint filed by her parents, the Kodumudi police launched an investigation. A case has been registered under the POCSO Act, and efforts are on to arrest the accused.
