Kevin Costner Fires Back at ‘Patently False' Allegation Over ‘Horizon 2' Rape Scene: ‘An Absolute Nightmare'
In a motion to throw out the lawsuit filed Tuesday, Costner said the allegations are 'patently false' and 'deeply disappointing' and were designed to damage his reputation.

Kevin Costner Sued by Stunt Performer Over Unscripted 'Horizon 2' Rape Scene
Kevin Costner Premieres 'Horizon: Chapter 2' in Santa Barbara, But There's No News on Next Two Installments
'I can only assume that purpose was to use this sensationalistic language to embarrass and damage me and the 'Horizon' movies on an ongoing basis in order to gain a massive and unjustified payday,' Costner said in a court declaration. 'Equally as bad, having to read about and address allegations I know to be false involving the words 'rape' and 'assault' has been an absolute nightmare.'
Devyn LaBella sued Costner in May for sexual harassment and for creating a hostile work environment. She alleged that Costner improvised a scene in which an actor straddled her and raked up her skirt in an aggressive manner. The intimacy coordinator on the film later documented lapses in protocols during the scene, including a lack of planning, communication and the lack of a closed set.
In response, Costner stated that it was not a 'rape scene,' and that while rape was implied, there was no nudity or simulated sex.
'This was one artistic shot designed to imply what was going to happen off-screen, and purposely was not a 'simulated rape' as Devyn now falsely describes it,' he stated.
Costner and his company are seeking to throw out the suit under California's anti-SLAPP law, which is designed to protect free speech on matters of public concern.
Marty Singer, Costner's attorney, wrote in the motion that 'Horizon 2' — which has yet to be released — addresses 'the horrific struggles endured by women' in the American West in the post-Civil War era, 'including their extreme vulnerability to rape and other forms of violence,' and that therefore it qualifies for protection under the anti-SLAPP law.
In an anti-SLAPP motion, the losing side has the right to appeal immediately, which will likely delay the case for a year or more regardless of the outcome at the trial court.
The motion includes declaration from many crew members who maintain that the shot was not out of the ordinary.
Roger Ivens, the other performer in the scene, stated that LaBella offered a 'false and sensationalist' description of the scene in her lawsuit, in which she characterized it as depicting a violent rape.
'It is not what happened,' Ivens stated. 'This was not in any way, shape, or form a simulated sex scene.'
Wade Allen, the stunt coordinator who hired and supervised LaBella, also stated that the scene involved 'no intimacy, no nudity, no sexual conduct or sexual movement of any kind.'
He also stated that LaBella gave him a thumbs up before and after the run-through, and seemed upbeat and enthusiastic about the experience.
'At no point that day did she evidence any distress or discomfort, or any concern about what she had been asked to do,' Allen stated.
In response to the filing, LaBella's lawyer, James Vagnini, said that LaBella's professional demeanor does not undermine her allegations, and noted that her claims have been corroborated by the intimacy coordinator and other witnesses and text messages.
'This filing is continued evidence that one of Hollywood's most powerful men is trying to skirt accountability for reckless and harmful behavior,' Vagnini said. 'This baseless motion is nothing but a desperate delay tactic from a panicked legal team with no real defense. The only things damaging Kevin Costner's reputation are his own reckless, harmful behavior and the offensive narrative he's spreading to cover it up.'

Are Sean and Allyshia Still Together Post-‘Bachelor in Paradise'?
Sean McLaughlin and Allyshia Gupta may have left Paradise together—but did they stay together? Ever since the two self-eliminated on the latest episode of Bachelor in Paradise season 10, fans have been trying to figure out whether the couple is still going I'm sorry to say that things aren't looking good for them. Let's review the evidence, shall we? First, there was Allyshia's Bachelor Happy Hour interview on August 7, where she talked about how things might have been different if she'd arrived in Costa Rica sooner. 'I do think that had I come in Day 1 or Day 2, like earlier days, I do think that Dale [Moss] and I probably would have ended up coupled up,' she said. Sean's response? After Bachelor Happy Hour posted a clip from the episode on IG, Sean slid into the comments to write, 'Oh interesting'...before reportedly unfollowing Allyshia and removing all photos of them together from his grid. Then, on August 12, when asked by Us Weekly where she and Sean stood following her comment about Dale, Allyshia said they were on 'great terms'—though she didn't actually clarify whether they were still a couple. As she explained, 'I can see why he might feel like he was a second option, which wasn't the case whatsoever. We have a real relationship and I think that's where he has his feelings hurt a little bit because it's more than just a TV show.' She also mentioned that she was 'actually FaceTiming him before coming into this interview,' so there's that! The next twist came on August 15, when Reality Steve posted a new batch of spoilers on Instagram, which included the fact that (supposedly) Sean and Allyshia are 'not together' anymore. But the biggest clue yet came on August 19, when Sean got his turn on the Bachelor Happy Hour podcast. During his appearance, he seemed to suggest that he and Allyshia tried to make things work post-Paradise but eventually split. 'When we got sent home, I was so excited,' Sean said. 'We were going back to Tampa together. We had talked about leaving in a relationship well prior to us getting eliminated.' He continued, 'I thought I found the most amazing person. I was incredibly excited about our relationship. I couldn't wait to get back to Tampa—' but! Just as he was about to seemingly provide an update on where he and Allyshia currently stand, host Joe Amabile cut him off, saying they couldn't 'touch on where your relationship status is now.' Mmkay! Stay tuned for more deets as we have them.

Dakota Johnson and ‘Splitsville' Co-Stars on Playing ‘Unhappy' Characters, Open Relationships and a Possibly Fake Penis
'Splitsville' may be a rom-com, but Dakota Johnson's character Julie doesn't take part in much of the movie's comedy. 'I liked playing a really sort of unhappy woman,' Johnson told me Tuesday at the film's premiere at AMC the Grove in Los Angeles. More from Variety 'What We Do in the Shadows' Star Harvey Guillén to Receive Icon Award at Raizado Festival (EXCLUSIVE) 'The Pitt' Star Katherine LaNasa Shot Such a 'Disgusting' Scene for Season 2 She Told Producer 'He Needed to Give Me Some Diamonds' 'The Last of Us' Star Bella Ramsey Would Love to Play Spider-Man and Make a Heist Movie With Pedro Pascal 'Splitsville' follows two couples, made up of Julie and Paul (Michael Angelo Covino) and Ashley (Adria Arjona) and Carey (Kyle Marvin). Their lives begin to unravel when Ashley and Carey breakup and it's revealed that Julie and Paul have an open relationship. 'I just love this tone of film,' Johnson said. 'I love Mike and Kyle's comedy, the way they write, the way they work together. I think the subject matter [open relationships] is really interesting and controversial, and I think people are very curious about it.' The cast also includes Nicholas Braun, David Castañeda, Charlie Gillespie, Simon Webster, Stephen Adekolu, Tyrone Benskin and O-T Fagbenle. Marvin and Covino penned the script, and Johnson served as a producer with her TeaTime Pictures co-founder Ro Donnelly. 'Succession' star Braun makes a cameo in 'Splitsville' as a mentalist performing at a children's birthday party. He said the movie had him thinking about open relationships. 'I can't do an open marriage or open relationship,' Braun said. 'I'm too sensitive for that, too jealous. I mean, it's brutal what happens to them in this movie and they're cool about it sort of — but also not. But I couldn't tolerate that. It would be torture. And it feels mean…It's complicated.' The Covino-directed ensemble received a six-minute standing ovation at its world premiere at the Cannes Film Festival in May. Ahead of its debut in Cannes' Premiere section, 'Splitsville' was acquired by Neon. In one much buzzed about scene, Paul and Carey get into a hilarious and what seems like never-ending fight which results in destroyed walls, furniture and more in Paul and Julie's gorgeous modern lakefront home. The first half of the brawl, on the first floor of the house, was done in one take seven times. 'It was an actual house and we destroyed it,' Marvin told me. 'Everyone was just patching up and trying to figure it [out]…and then we went right away and just beat each other up.' Covino added, 'We destroyed one house multiple times, so technically two or three houses. It was heavily choreographed and heavily rehearsed. After a long day of scouting and prepping, we would go to a bouldering gym where they had deep mats that we could fall on and just throw each other around.' Carey's penis is also seen a couple of times in the movie, most notably during an incident in the opening sequence. Marvin and Covino playfully declined to say if they used a prosthetic. 'No comment,' Marvin said, laughing. 'I think people are going to have to go look and see for themselves and make a choice.' Johnson's starring role in 'Splitsville' follows the recent success of 'Materialists,' her Celine Song rom-com with Pedro Pascal and Chris Evans that has earned more $75 million worldwide at the box office. Johnson said, 'I think rom-coms are an incredible genre, so I'm glad that we are having some success.' 'Splitsville' is in select theaters Aug. 22 and everywhere Sept. 5. IN CASE YOU MISSED IT: Kevin Costner slams lawsuit as 'blatant lie'
After a stunt professional accused the Horizon: An American Saga - Chapter 2 director of breaching intimacy protocols, Costner filed a scathing response to her lawsuit this week. In May, lead stunt double Devyn LaBella filed a breach of contract lawsuit against Costner, 70, alleging he had failed to provide a safe working environment, and that she had been forced to perform a "violent" unscripted rape scene without the legally required notice or consent, and without a mandated intimacy coordinator present. This week, Costner's legal team filed a response in the LA Superior Court refuting LaBella's claims.
