Delhi High Court Dismisses Plea Against Illegal Construction Due To Lack Of Direct Interest

Delhi High Court
has deprecated the filing of frivolous petitions with no direct interest in the matter. It dismissed a plea, which alleged illegal construction at a property, with Rs 50,000 costs.
A single judge bench of Justice Mini Pushkarna observed, "In the present case, it is evident that the petitioner does not have any connection with the property in question and is staying far away from it. Thus, there is no cause of action in favour of the petitioner to file the present writ petition under Article 226 of the Constitution of India, as no right of the petitioner was violated, for enforcing which, a writ petition could have been filed.
"
The plea alleged that illegal and unauthorised construction was taking place at a property near a gurdwara in Mehrauli. The court said that the litigant had no connection with the property, was living 10 km away from it, and the only ground for filing the petition was that he took the same street while coming and going to the office.
The bench, noting that no legal or fundamental right of the litigant was affected in any manner by any construction activity taking place in a property situated approximately 10 kilometres away from his residence, said that the petition was filed clearly for ulterior motives and not for the enforcement of any fundamental right of the litigant. "The present case is clearly an abuse and misuse of the process of law," the bench said.
"The present petition is dismissed with a cost of Rs 50,000, payable by the petitioner to the Delhi High Court Advocates Welfare Trust within a period of four weeks from today," the court said.

Contraband, including 28.57 kg raw materials, three motorcycles, six mobile phones, and Rs 66,000 were seized, SP Anjani Anjan said on Thursday. SP Anjani said, "A team led by Hazaribag (headquarters) SDPO Amit Kumar Anand conducted searches at Lohsinghna, Korrah, and Sadar police station areas. Four smugglers were held from Lohsinghna. They were identified as Pintu Kumar Dangi (25) and Mukul Dangi (28), both residents of Bariatu village under Chatra (Sadar), besides Avinash Kumar (19) and Rahul Pandey (21), both residing in Giddor of Chatra district. Mukul had a criminal record at Ghaziabad police station under the NDPS Act. Avinash and Rahul had six criminal cases against them." "In Korrah, 2.5 kg opium, materials for making opium doda weighing 21.7gm, and Rs 66,000 in cash were confiscated. The arrested were identified as Rahul Yadav (23) and Mohammed Arshad Ansari of Thotwa village under Katkamsandi police station limits. Rahul Yadav belonged to Kendua in Chatra," he added. The SP further said, "From Lohsinghna, 10.8 kg opium and doda valued at 6.67 lakh were seized." Preliminary probe found that the consignment was being transported from Chatra to across the country, police said.

1 2 3 Jamshedpur: Around 10,000 people, living in the eastern fringes of Jamshedpur, would receive piped water by 2026 end as work on the second phase of the Moharda drinking water supply project would begin soon, officials said on Thursday. In the second phase expected to incur a cost of Rs 7.77 cr, two overhead water storage tanks, with a capacity of 2.4 lakh litres and 1.25 lakh litres respectively, would be built at Bhuvaneshwari Temple in Telco and old GSR in Birsanagar. A nine-kilometre pipeline would supply water to the residential areas. Laying the foundation stone for the project at Sugana Colony in Baridih, Jamshedpur (East) MLA Purnima Sahu said, "The project would end the longstanding problem of water scarcity in colonies and slums." Jamshedpur Notified Area Committee (JNAC) deputy municipal commissioner Krishna Kumar said, "The colonies and slums in Bagunhatu, Baridih, and Birsanagar will receive piped water. New connections have been added after the service area was expanded." A total of 5,000 new tap connections were given and 3,700 illegal connections regularised between 2021 and 2023. Presently, over 15,000 houses receive water from the Moharda project. Over 2 lakh people will get tap water upon completion of the Rs 30 crore project being implemented Tata Steel Utility and Infrastructure Services Ltd.
