
Man ‘racked and pointed gun in violent clash' in west Dublin, court hears
A young man was seen 'racking' a handgun and pointing it at people during a violent clash between two 'factions' in west Dublin, it is alleged.
According to gardaí, John Neary brandished the gun during the confrontation, though no weapon was recovered.
He is facing a jury trial on weapons and public order charges after a judge ruled the case was too serious to be dealt with at district court level.
Mr Neary (25), with an address at Fonthill Cottages, Clondalkin, appeared in Blanchardstown District Court charged with violent disorder and producing 'what appeared to be a handgun' in the course of a dispute.
A garda sergeant told Judge David McHugh the DPP consented to the case being heard in the district court, subject to the issue of jurisdiction being considered.
Outlining the allegations, he said gardaí were called to an incident of violent disorder 'between factions' at Greenfort Park, Clondalkin, on March 29, 2023.
It was alleged the accused was seen in possession of a handgun, which he brandished.
According to gardaí, Mr Neary 'racked the gun and pointed it at three unknown males'.
Nobody was injured and no weapon was recovered
No gun was recovered but there was CCTV evidence, the court heard.
The sergeant said shots were fired by another male towards the other 'faction' but nobody was injured and no weapon was recovered in relation to that either.
Judge McHugh refused jurisdiction after hearing the summary of the prosecution's evidence.
He adjourned the case to a date later this month for further DPP directions.
Mr Neary, who has not yet entered pleas to the charges, was remanded on continuing bail.

A VETERAN UKRAINIAN soldier who sparked a security alert at the US ambassador's official residence in Dublin has been spared a jail sentence and has left the country. Oleksandr Kucherenko, 33, claimed to be sightseeing on 13 June and that he 'wandered' into the grounds by scaling a moat and an eight-foot walled perimeter of the Deerfields residence in Phoenix Park. He pleaded guilty the following day at Dublin District Court to trespassing in a manner likely to place another person in fear. Judge Michele Finan had ordered him to donate money to the Red Cross and adjourned his case, with bail and a daily signing on condition, until Friday. Kucherenko, of no fixed address, had claimed he could give €50 to the humanitarian charity. The case resumed today, but the former army man did not appear; however, his solicitor stated that his client had left Ireland. Gardai confirmed that it was unknown whether he had given the money to charity. Judge Finan imposed a €200 fine, payable within a year, in the defendant's absence. At his earlier hearing, on 14 June, Garda Martin Curley said the accused's reply to the charge was: 'My behaviour would not have scared anyone; I was not drunk.' Garda Curley said: 'The accused crossed a moat and climbed over the wall to get into the property.' Security personnel detained the former soldier minutes later. Defence barrister Kevin McCrave, instructed by Mr O'Connor, said Mr Kucherenko had been in the Ukrainian army and came to Ireland to visit friends in Claremorris, Co Mayo. He did not address the court but briefed his barrister that he had 'just landed, was sightseeing and taking photographs around the city'. Counsel said the man 'ended up in Phoenix Park and wandered into the grounds inadvertently', and he was apologetic. The court heard his father also served in the military and was killed in action in the war against Russia, which led to the accused being allowed to leave the army. He planned to join other family members in Spain. While on bail pending sentence, the judge had ordered the accused, who was to stay in hostel accommodation, to sign in daily at a garda station, stay away from the ambassador's residence, and have no direct or indirect contact with any of the occupants or through social media.

Two in court over petrol bomb attack of Dublin home
Two people have appeared in court charged in connection with a petrol bomb attack at a home in Dublin in May earlier this year. The three occupants were treated for non life-threatening injuries but their family dog died in the blaze. A 15-year-old boy, who cannot be named because he is a minor and has the right to anonymity, appeared before Judge Brendan Toale at the Dublin Children's Court. He was charged with arson of the house on Landen Road in Ballyfermot on 21 May. The teenager, accompanied to court by his mother, did not address the court and has yet to enter a plea. He made no reply when charged. Gardaí objected to bail. Judge Toale refused bail and remanded the teenager to the Oberstown Children's Detention Campus to appear again next week for directions from the DPP. Meanwhile, co-defendant, 23-year-old Curtis Stafford, of Rutland Grove, Crumlin, appeared before Judge Paula Murphy at Dublin District Court, also charged with arson. He was granted legal aid, refused bail and remanded in custody to appear again on 11 July. In the third arrest in this investigation, a teenage boy was detained under Section 4 of the Criminal Justice Act, 1984, at a Garda station in Dublin on Friday and could be held for 24 hours.
