
‘Geng Upik' member jailed 5 years

Kota Kinabalu: A 30-year-old man, who was recently sentenced to 30 years in jail and 12 strokes of the cane for drug trafficking, was on Wednesday jailed five years by the High Court here for being a member of the organised crime group 'Geng Upik'. Zulkahar Dusing changed his plea to guilty to the charge before Judge Datuk Dr Lim Hock Leng midway through the trial, while the third witness was testifying.

He was convicted under Section 130V(1) of the Penal Code, which provides for a jail term of up to 20 years, on conviction. The court ordered Zulkahar to serve the sentence from March 1, 2024, the date he was first charged in court. Zulkahar was on trial alongside former Tawau CID Officer Insp Rahman Burijin, 44, and General Operations Force member Sjn Jaisalfian Jaineh @ Zaini, 45, on their respective charges under the same section. Rahman and Jaisalfian's trial will continue until tomorrow (July 18). Deputy Public Prosecutor (DPP) Datuk Nazran Mohd Sham, in presenting the facts of the case, informed the court that a police superintendent had lodged a police report on Nov 23, 2023 regarding intelligence on an organised crime group known as 'Geng Upik,' which was involved in dangerous drug trafficking activities. Zulkahar was arrested on March 1, 2024. Investigations revealed by the investigating officer found that Zulkahar was identified as a member of 'Geng Upik' and was directly involved in the group's drug trafficking activities between 2021 and May 3, 2023. Zulkahar was found to have played a role as a member of 'Geng Upik' in drug trafficking activities alongside other members, to gain material benefits for the group. The prosecution further informed the court the investigation also found that 'Geng Upik' had engaged in dangerous drug trafficking in several serious offence cases: Tawau (two) and Manggatal (one). The serious offences in Tawau include: In 2016 - an arrest under Section 39B involving an individual who had assisted 'Geng Upik', namely Syafilah Pawawoi, who was convicted and sentenced to 12 years' imprisonment; in Manggatal in 2017 involved an arrest with the seizure of 4.6kg of syabu with evidence indicating that the seized drugs were linked to 'Geng Upik' and in 2020 an arrest involving the seizure of 53kg of syabu with evidence indicating that the seized drugs were linked to 'Geng Upik'. It was reported on July 10 that Zulkahar was sentenced to 30 years' jail and 12 strokes of the cane by the Tawau High Court after he was found guilty of trafficking 738.6gm of syabu on May 3, 2023, in Tawau. Zulkahar was among 15 individuals charged in connection with the present case. Between March 18 and June 5 this year, 12 of them, including the group leader Datuk Maslan Sani, pleaded guilty. Maslan was jailed five years 5 June 5 for being a member of 'Geng Upik'. The remaining 11 were each sentenced to three years' jail after admitting to an alternative charge of assisting the group. Together with DPP Nazran, were DPPs Lina Hanini Ismail, Siti Hajar Mat Radzi, and Nur Ainaa Ridzwan. Man, son arrested over sexual assault of 13-year-old
BALIK PULAU: Police have detained a father and son for sexual offences against their own family member over the past two years. The sexual abuse began when the girl was 13 and continued until she turned 15. The most recent incident took place on July 8 at their apartment in Bayan Lepas. Southwest district police chief Assistant Commissioner Sazalee Adam said at about 11pm on that day, the victim was summoned by her father into the bedroom to pass her some pocket money for school. The man had allegedly sexually molested the victim, an incident which happened often since she was 13. He said the victim was also raped several times by her brother since she was 13, for a year. "The victim related the incident to her mother about 1pm last Friday after the woman wanted her son to look after the girl, who often skipped school. "The victim then came to the police station to report the incident," he said tonight. Following the report, Sazalee said police arrested the 52-year-old father and his 22-year-old son. The father had no prior record, while the son did. Investigations revealed the abuse occurred when the victim was alone at home. "The last rape incident happened mid-2024 by her brother. "The victim was referred to the Penang Hospital for examination," he added. Sazalee said both suspects have been remanded since last Saturday. The case is being investigated under Section 376 of the Penal Code for rape and Section 14(a) of the Sexual Offences Against Children Act 2017.

University Students Fined For Pornography Possession After HIV Event Raid In Kelantan
Subscribe to our FREE Three individuals, including two university students, were fined for possessing pornographic material on their mobile phones following a police raid at a community health event in Kota Bharu, Kelantan. The lawyer representing the case, Sam CH, clarified on social media that the charges were filed under Section 292 of the Penal Code for 'possessing obscene material' – not for any activities related to a 'gay party' as some media reports suggested. The incident occurred during what the lawyer described as a legitimate community health programme. A banner reading 'Program Mesra Kesihatan Komuniti' (Community Health Programme) was displayed at the venue. Doctors from government health clinics had been invited to speak about HIV prevention and awareness. Counselling sessions were also being conducted. 'No drug was found; no one was caught using drugs that night. No one was having sex at the event place,' Sam wrote in her Facebook post. Legal Consequences and Digital Privacy Warning According to the lawyer, when police found no evidence of illegal activities at the venue, they proceeded to search mobile phones of those present. The three individuals were detained for five days before being fined. The lawyer said her clients have since paid their fines and 'learned their lessons', though she noted they were 'traumatised' by the experience. Sam warned the public about digital privacy, explaining that police can retrieve deleted images and videos from phones. Ladies and gentlemen, never browse pornographic websites with your phone. Police will still be able to retrieve obscene images in your phone even if you had deleted the images and video. She also called for police to focus resources on more serious crimes, including drug trafficking, violent crimes, child sexual exploitation, domestic violence, corruption and fraud. The lawyer emphasised that her comments represented her personal views and not those of her clients or the Malaysian AIDS Council/Malaysian AIDS Foundation (MAC/MAF). NGOs Dispute Police Claims Over Raid Previously, a coalition of 31 NGOs has rejected police claims about the raid, supposedly an LGBTQ+-linked programme. The event was a legitimate health initiative providing HIV testing and sexual health information, not a 'gay sex party' as authorities alleged. MAC confirmed the session was conducted under a Health Ministry-supported model targeting high-risk groups, involving over 70 clients and healthcare providers including doctors. NGOs expressed concern about the re-emergence of raids on health centres and events for minority groups, saying such actions undermine public courage to seek HIV treatment and prevention services. The coalition called on police to correct their 'inaccurate statements' and urged the Health Ministry to investigate the matter. Doctor previously nabbed for molesting patients arrested again for fourth time
BALIK PULAU: A doctor has been arrested by the police for allegedly molesting a female patient at a private clinic in Bayan Baru yesterday. It is learnt that the doctor had previously been detained several times for indecent behaviour at a hospital in George Town. Southwest district police chief Assistant Commissioner Sazalee Adam said the 43-year-old doctor was arrested within the district police headquarters' compound at 8pm last night after being asked to come in to assist with the investigation. "We received a report from a woman who claimed that at 11.46am on June 29, she sought treatment at a private clinic in Bayan Baru for abdominal pain. "While in the examination room, the attending doctor instructed the victim to remove her shirt and proceeded to touch both of her breasts. "Dissatisfied with what had happened, the victim lodged a police report on July 18," he said when contacted. Sazalee said that following the arrest of the doctor, police confiscated his mobile phone to assist with the investigation. Meanwhile, acting state police chief Datuk Mohd Alwi Zainal Abidin confirmed that the doctor in question was the same person who had previously been arrested for indecent behaviour involving female patients. He said the man has been remanded for three days until July 23 to assist with the investigation. The case is being investigated under Section 354 of the Penal Code. Previously, it was reported that the doctor had been detained three times after being accused of indecent behaviour at a hospital and two private clinics in the northeast district, involving three female victims. The doctor had allegedly tricked the victims into removing their clothes and running in place under the pretext of further treatment before being suspected of taking photos of their bodies with his mobile phone during the examinations. Police are also investigating the man under Section 509 of the Penal Code and Section 14 of the Minor Offences Act 1955.
