
Medical malpractice bill dies in Senate committee
Members of the Senate Health and Public Affairs Committee voted 5-4 against the bill following a two-hour debate Friday evening.
Senate Bill 176, which sought to limit attorney fees in medical malpractice cases, drew strong opposition from trial lawyers and patients injured by medical malpractice. It was the only one of the six bills before the Legislature that had a shot of passing at a time when New Mexicans are facing a critical shortage of doctors, in part because New Mexico is one of the most expensive states to insure for medical malpractice given the number of lawsuits filed here annually. Providers and insurers pay out over $100 million a year in medical malpractice settlements, as a percentage of premiums collected by far more so than every other state in the union. And, as the Journal reported last week, Democratic state legislators are by far the biggest recipients of trial lawyer money.
Discussion at times became emotional as lawmakers described personal health issues involving themselves and family members.
Sen. Cindy Nava, D-Bernalillo, who voted against SB 176, wept as she described surviving a brain tumor removed by a surgeon who has since left New Mexico for reasons unrelated to medical malpractice. Nava said she favors legislation that would invest in physicians and encourage them to come to New Mexico.
"I just don't see this piece of legislation doing that," she said.
Senate Bill 176 would end lump-sum payouts from the state's patient's compensation fund, which helps providers pay for malpractice settlements. Instead, it would require that payments be made as expenses are incurred by patients.
The bill, which had 24 sponsors as of Friday, also would cap attorney fees in malpractice cases at 25% in cases settled before trial and 33% if the case goes to trial.
A third provision on SB 176 would dedicate 75% of punitive damages to a new patient safety improvement fund administered by the state Department of Health. Money from the fund would be appropriated by the Legislature to improve patient safety and health care outcomes.
Nava and others expressed discomfort with the creation of the new fund that would receive the lion's share of punitive damages.
"I'm really offended by the idea of taking 75% of a punitive damage award from an injured party and giving it to a state-run fund," said Sen. Antoinette Sedillo Lopez, D-Albuquerque, who voted against the bill. "It takes away a portion of the money that the victim should get to punish the hospital for outrageous behavior."
The bill's failure to emerge from committee essentially kills any chance of a medical malpractice measure passing in this session, said Sen. Martin Hickey, D-Albuquerque, a sponsor of SB 176.
"I actually think that we were able to get the facts out, that trial lawyers are bringing cases without merit and getting settlements," said Hickey, who testified Friday in favor of the bill.
The bill's failure will hamper the state's ability to expand the physician workforce, he said.
Hickey told committee members that physicians and practice groups often feel compelled to settle lawsuits before trial to avoid the risk of a large punitive damage award.
"That's what puts fear into the hearts of physicians in New Mexico," Hickey testified. Leaders of single-specialty practice groups say that "virtually every case now comes with the threat of punitive damages if they don't settle."
All settlements are listed in a national database, which can make it harder for physicians to find jobs, he said.
The number of reported payments made in medical malpractice cases involving New Mexico physicians have increased from 84 in 2020 to 130 in 2024, according to the National Practitioners Data Bank.
Hickey also testified that several malpractice lawsuits have resulted in historically large jury awards in recent years, including a $412 million jury verdict in 2024 that he described as the largest-ever malpractice award in U.S. history.
That case involved a 66-year-old Rio Rancho widower who sued the now-closed NuMale Medical Center in Albuquerque after receiving alleged dangerous penile injections in 2017. The clinic was part of a Las Vegas, Nevada, chain that filed for bankruptcy in February, according to court records.
The 2000 lawsuit alleged the widower sought treatment for fatigue and weight management, but was misdiagnosed and treated for erectile dysfunction, according to his lawsuit. As a result, he was left with a scarred and nonfunctional penis, the lawsuit alleged.
A jury took less than four hours to award him $37 million in compensation for his lifetime medical needs and $375 million in punitive damages.
Sen. Angel Charley, D-Acoma, said a 25% cap on attorney fees would put New Mexico patients in a situation similar to those who rely on care from the Indian Health Service, which is subject to federal tort claims laws.
"That means attorneys will not take a medical malpractice lawsuit," said Charley, who voted against the measure. "I don't want this state to have the same kind of health care that we have on the reservation."
Committee members who voted against the bill were Nava, Charley, committee chair Sen. Linda Lopez, D-Albuquerque, and Sen. Shannon Pinto, D-Tohatchi.
Those supporting the bill were Hickey, Sen. Jay Block, R-Rio Rancho, Sen. Larry Scott, R-Hobbs, and Sen. David Gallegos, R-Eunice.
Lisa Curtis, an Albuquerque medical malpractice attorney, cheered the bill's defeat following the vote.
"It's a horrible bill," Curtis said. "It does nothing to fix the problems." She blamed the malpractice suits on hospital corporations that engage in ruthless cost-cutting and pay physicians based on their productivity.
"Nobody is willing to talk about the private equity guys that are choosing to put their money in the New Mexico health care system because it's so profitable," she said.
Fred Nathan, executive director of Think New Mexico, which helped draft the legislation, said the bill received strong support from both Democrats and Republicans.
"Naturally we're disappointed, but we remain encouraged by the support it garnered," he said. The bill ultimately had 24 co-sponsors, including 12 Republicans and 12 Democrats. "This is a solid foundation that we can build on going forward."

WASHINGTON -- A year after being lauded for its plan to replace thousands of aging, gas-powered mail trucks with a mostly electric fleet, the U.S. Postal Service is facing congressional attempts to strip billions in federal EV funding. In June, the Senate parliamentarian blocked a Republican proposal in a major tax-and-spending bill to sell off the agency's new electric vehicles and infrastructure and revoke remaining federal money. But efforts to halt the fleet's shift to clean energy continue in the name of cost savings. Donald Maston, president of the National Rural Letter Carriers' Association, said canceling the program now would have the opposite effect, squandering millions of dollars. 'I think it would be shortsighted for Congress to now suddenly decide they're going to try to go backwards and take the money away for the EVs or stop that process because that's just going to be a bunch of money on infrastructure that's been wasted," he said. Beyond that, many in the scientific community fear the government could pass on an opportunity to reduce carbon emissions that contribute to global warming when urgent action is needed. A 2022 University of Michigan study found the new electric postal vehicles could cut total greenhouse gas emissions by up to 20 million tons over the predicted, cumulative 20-year lifetime of the trucks. That's a fraction of the more than 6,000 million metric tons emitted annually in the United States, said professor Gregory A. Keoleian, co-director of the university's Center for Sustainable Systems. But he said the push toward electric vehicles is critical and needs to accelerate, given the intensifying impacts of climate change. 'We're already falling short of goals for reducing emissions,' Keoleian said. 'We've been making progress, but the actions being taken or proposed will really reverse decarbonization progress that has been made to date.' Many GOP lawmakers share President Donald Trump's criticism of the Biden-era green energy push and say the Postal Service should stick to delivering mail. Sen. Joni Ernst, R-Iowa, said 'it didn't make sense for the Postal Service to invest so heavily in an all-electric force." She said she will pursue legislation to rescind what is left of the $3 billion from the Inflation Reduction Act allocated to help cover the $10 billion cost of new postal vehicles. Ernst has called the EV initiative a 'boondoggle' and "a textbook example of waste,' citing delays, high costs and concerns over cold-weather performance. 'You always evaluate the programs, see if they are working. But the rate at which the company that's providing those vehicles is able to produce them, they are so far behind schedule, they will never be able to fulfill that contract," Ernst said during a recent appearance at the Iowa State Fair, referring to Wisconsin-based Oshkosh Defense. 'For now,' she added, "gas-powered vehicles — use some ethanol in them — I think is wonderful.' Corn-based ethanol is a boon to Iowa's farmers, but the effort to reverse course has other Republican support. Rep. Michael Cloud, R-Texas, a co-sponsor of the rollback effort, has said the EV order should be canceled because the project "has delivered nothing but delays, defective trucks, and skyrocketing costs.' The Postal Service maintains that the production delay of the Next Generation Delivery Vehicles, or NGDVs, was 'very modest" and not unexpected. 'The production quantity ramp-up was planned for and intended to be very gradual in the early months to allow time for potential modest production or supplier issues to be successfully resolved,' spokesperson Kim Frum said. The independent, self-funded federal agency, which is paid for mostly by postage and product sales, is in the middle of a $40 billion, 10-year modernization and financial stabilization plan. The EV effort had the full backing of Democratic President Joe Biden, who pledged to move toward an all-electric federal fleet of car and trucks. The 'Deliver for America' plan calls for modernizing the ground fleet, notably the Grumman Long Life Vehicle, which dates back to 1987 and is fuel-inefficient at 9 mpg. The vehicles are well past their projected 24-year lifespan and are prone to breakdowns and even fires. 'Our mechanics are miracle workers,' said Mark Dimondstein, president of the American Postal Workers Union. 'The parts are not available. They fabricate them. They do the best they can.' The Postal Service announced in 2022 it would deploy at least 66,000 electric vehicles by 2028, including commercial off-the-shelf models, after years of deliberation and criticism it was moving too slowly to reduce emissions. By 2024, the agency was awarded a Presidential Sustainability Award for its efforts to electrify the largest fleet in the federal government. In 2021, Oshkosh Defense was awarded a contract for up to 165,000 battery electric and internal combustion engine Next Generation vehicles over 10 years. The first of the odd-looking trucks, with hoods resembling a duck's bill, began service in Georgia last year. Designed for greater package capacity, the trucks are equipped with airbags, blind-spot monitoring, collision sensors, 360-degree cameras and antilock brakes. There's also a new creature comfort: air conditioning. Douglas Lape, special assistant to the president of the National Association of Letter Carriers and a former carrier, is among numerous postal employees who have had a say in the new design. He marvels at how Oshkosh designed and built a new vehicle, transforming an old North Carolina warehouse into a factory along the way. 'I was in that building when it was nothing but shelving,' he said. 'And now, being a completely functioning plant where everything is built in-house — they press the bodies in there, they do all of the assembly — it's really amazing in my opinion.' The agency has so far ordered 51,500 NGDVs, including 35,000 battery-powered vehicles. To date, it has received 300 battery vehicles and 1,000 gas-powered ones. Former Postmaster General Louis DeJoy said in 2022 the agency expected to purchase chiefly zero-emissions delivery vehicles by 2026. It still needs some internal combustion engine vehicles that travel longer distances. Frum, the Postal Service spokesperson, said the planned NGDV purchases were "carefully considered from a business perspective' and are being deployed to routes and facilities where they will save money. The agency has also received more than 8,200 of 9,250 Ford E-Transit electric vehicles it has ordered, she said. Ernst said it's fine for the Postal Service to use EVs already purchased. 'But you know what? We need to be smart about the way we are providing services through the federal government,' she said. 'And that was not a smart move.' Maxwell Woody, lead author of the University of Michigan study, made the opposite case. Postal vehicles, he said, have low average speeds and a high number of stops and starts that enable regenerative braking. Routes average under 30 miles and are known in advance, making planning easier. 'It's the perfect application for an electric vehicle," he said, 'and it's a particularly inefficient application for an internal combustion engine vehicle.'

Defense Secretary Pete Hegseth's embrace of unchristian Christian nationalism
Pete Hegseth, widely considered the least qualified Defense secretary in American history, is hardly anyone's version of the ideal Christian husband and father. Only 45 years old, he's been married three times. His first marriage — to his high school sweetheart — lasted a mere four years, deteriorating after Hegseth admitted to multiple extramarital affairs. A couple of years later, he married his second wife, with whom he had three children. During that marriage, he fathered a child with a Fox News producer who eventually became his third wife. He paid off a woman who accused him of sexual assault (he denies the assault). He routinely passed out drunk at family gatherings and misbehaved in public when inebriated, according to numerous witnesses. His own mother once accused him of being 'an abuser of women,' though she later retracted her claims when Hegseth was facing Senate confirmation. Still, the Senate's Republican majority, cowed by President Trump, confirmed his appointment. Hegseth has two qualities that Trump prizes above all others. He is blindly loyal to the president, and he looks good on TV. After his installation, Hegseth proceeded to fire top military brass who happened to be Black or women or both. He has restored the names of Confederate generals to Army bases (Bragg and Benning). His petty 'anti-woke' crusade led him to strip the name of the assassinated gay rights leader Harvey Milk, a former Naval officer who served honorably, from a Navy ship. And he has considered doing the same to a ship named in honor of the abolitionist and Civil War hero Harriet Tubman. He has said that women do not belong in combat roles, and has kicked out transgender soldiers, cruelly stripping them of the pensions they earned for their service. In March, he shared classified information about an impending American airstrike in Yemen on an unsecured Signal group chat that included his wife, on purpose, and the editor of the Atlantic, by accident. He is, in short, the least serious man ever to lead this nation's armed forces. As if all that weren't dispiriting enough, Hegseth is now in bed (metaphorically) with a crusading Christian nationalist. Earlier this month, Hegseth made waves when he reposted on social media a CNN interview with Douglas Wilson, the pastor and theocrat who is working hard to turn the clock back on the rights of every American who is not white, Christian and male. In the interview, Wilson expounded on his patriarchal, misogynistic, authoritarian and homophobic views. Women, he said, should serve as 'chief executive of the home' and should not have the right to vote. (Their men can do that for them.) Gay marriage and gay sex should be outlawed once again. 'We know that sodomy is worse than slavery by how God responds to it,' he told CNN's Pamela Brown. (Slavery is 'unbiblical,' he avowed, though he did bizarrely defend it once, writing in 1990 a pamphlet that 'slavery produced in the South a genuine affection between the races that we believe we can say has never existed in any nation before the War or since.') When a new outpost of his church opened in Washington, D.C ., in July, Hegseth and his family were among the worshippers. CNN described Hegseth's presence as 'a major achievement' for Wilson. 'All of Christ for All of Life,' wrote Hegseth as he endorsed and reposted the interview. That is the motto of Wilson's expanding universe, which includes his Christ Church in Moscow, Idaho, the center of his Communion of Reformed Evangelical Churches, a network of more than 100 churches on four continents, parochial schools, a college, a publishing house and media platforms. 'All of Christ for All of Life' is a shorthand for the belief that Christian doctrines should shape every part of life — including government, culture and education. Wilson is a prolific author of books with titles such as 'Her Hand in Marriage,' 'Federal Husband,' and 'Reforming Marriage.' His book 'Fidelity' teaches 'what it means to be a one-woman man.' Doubtful it has crossed Hegseth's desk. 'God hates divorce,' writes Wilson in one of his books. Given the way sexual pleasure is celebrated in the Old and New Testaments, Wilson has a peculiarly dim view of sex. I mean, how many weddings have been graced with recitations from the Song of Solomon, with its thinly disguised allusions to pleasurable sexual intimacy? ('Let him kiss me with the kisses of his mouth! For your love is better than wine.') Wilson's world is considerably less sensual. 'A man penetrates, conquers, colonizes, plants,' he writes in 'Fidelity.' 'A woman receives, surrenders, accepts.' Mutual sexual pleasure seems out of the question: 'The sexual act cannot be made into an egalitarian pleasuring party.' Ugh. There is nothing particularly new here; Wilson's ideology is just another version of patriarchal figures using religion to fight back against the equality movements of the late 19th and 20th centuries. They are basically the hatemongers of the Westboro Baptist Church dressed up in respectable clothing. 'Some people may conflate Christian nationalism and Christianity because they both use the symbols and language of Christianity, such as a Bible, a cross and worship songs,' says the group Christians Against Christian Nationalism on its website. 'But Christian nationalism uses the veneer of Christianity to advance its own aims — to point to a political figure, party or ideology instead of Jesus.' What you have in people like Hegseth and Wilson are authoritarian men who hide behind their religion to execute the most unchristian of agendas.
