Relief for Nawab Malik! Defamation case against ex-Maharashtra minister closed as BJP functionary withdraws complaint

Former Maharashtra minister Nawab Malik on Monday was granted relief by a magistrate court in Mumbai following BJP functionary Mohit Kamboj withdrew his complaint, reported PTI.
In the ruling, the court said, as quoted by the PTI, 'The accused stands acquitted of the offence under IPC section 500 (defamation) and the proceeding is hereby closed.'
Earlier, the BJP functionary filed the application for withdrawal of the case under section 257 of the Criminal Procedure Code (CrPC).
According to Section 257 of the Criminal Procedure Code (CrPC), a complainant can withdraw his or her complaint at any time before a final order is passed. However, the magistrate should be satisfied with the grounds for withdrawal and if permitted by the magistrate, then the accused gets acquitted.
"Since this court is desirous of keeping the said case on a day-to-day basis, I am desirous to withdraw the case filed against the accused as I will be unable to attend the court on a daily basis," PTI quoted Kamboj saying in his application.
"I have voluntarily decided to withdraw the case, and no undue pressure or coercion has been exerted upon me in this regard," it added.
Earlier in 2021, Kamboj had filed a complaint in the court alleging Nawab Malik had defamed him and his brother-in-law following the NCB raided a cruise ship in October 2021.
In his complaint, Kamboj claimed that Nawab in his press conference on arresting several persons including actor Shah Rukh Khan's son Aryan Khan had 'purposefully and intentionally defamed' him and s brother-in-law Rishab Sachdev. NCP leader and ex-Maharashtra Minister Nawab Malik alleged that Aryan Khan's arrest was a forgery.
Kamboj had sought action against Malik for allegedly committing offences under sections 499 and 500 (defamation) of the Indian Penal Code.

Ghaziabad: A special Pocso court on Monday sentenced a man to 20 years' rigorous imprisonment with a Rs 25,000 fine for raping a four-year-old girl in 2019. Judge Lal Babu Gupta heard testimony from five witnesses, including the girl's father, and rejected the defence's argument about the FIR being filed late. The court concluded that since the provision for the quantum of sentence under section 376(AB) IPC was more than what is entailed in section 5/6 of the Pocso Act at the time of the commission of the crime, the convict was sentenced under IPC for 20 years. The court did not find the case to qualify for the rarest of rare categories and refrained from awarding capital punishment. Special public prosecutor Satish Sharma said the complainant informed the court that he was not aware of the incident until his wife informed him about it on March 4, following which he lodged an FIR. After registering the case, police recorded the girl's statement under CrPC 164 on March 7, 2019, and pursued the culprit's arrest. The magistrate court took cognizance on May 2, 2019, and charges were framed by Jan 2020. Rejecting the charges, the defence counsel said that there was a substantial gap between the date of occurrence of the alleged crime and the filing of the FIR. The accused denied the charges, claiming the delayed FIR suggested mala fide intent and extortion by the complainant. The prosecution examined the girl, her parents, the FIR scribe, and the investigator. The court relied on the girl's statement before the magistrate and her court deposition as key evidence supporting prosecution's case. Having heard both sides, the court awarded 20 years of RI and a fine of Rs 25,000, directing the convict to pay the entire amount of the fine for the rehabilitation of the girl.

Now, 28 years later, accused Usha Ansal and her son Naveen Chand have been named in an FIR. The Punjab and Haryana high court had ordered Punjab Vigilance Bureau (VB) chief director to probe the allegation, and the report, filed on June 20, has led to the FIR. The case has been registered under IPC Sections 419 (cheating by personation), 420 (cheating and dishonestly inducing delivery of property), 465 (forgery), 467 (forgery of valuable security, will, etc), 471 (using as genuine a forged document or electronic record), and 120B (criminal conspiracy). DSP Karan Sharma is heading the investigation to identify all those involved in this long-concealed scam involving strategic defence land. The airstrip is in Fattuwala village, very close to Pakistan border. It was only in May 2025, after HC intervention, that the land was finally restored to ministry of defence. The VB inquiry confirmed that the land belongs to IAF. Acquired on March 12, 1945 by the British administration for use in World War II, it has remained in IAF possession and was used in three wars. According to the probe, accused Usha and Naveen, of Dumni Wala village, deceitfully claimed ownership of the land and sold it off in collusion with a section of revenue officials after forging revenue records. In 2021, the commandant of Halwara Air Force Station wrote to Ferozepur deputy commissioner demanding a probe. Still nothing happened. Nishan filed a petition in HC seeking an inquiry. Counsel for the petitioner submitted that the original owner of the land, Madan Mohal Lal, died in 1991. However, the sale deeds were executed in 1997 and the names of Surjit Kaur, Manjit Kaur, Mukhtiar Singh, Jagir Singh, Dara Singh, Ramesh Kant, and Rakesh Kant were shown as owners in the Jamabandi from 2009-10, although the military had never transferred the land to them. HC reprimanded Ferozepur deputy commissioner for inaction, pointing out the potential threat to national security. In his order, Justice Harjit Singh Brar asked Punjab VB chief director to personally verify the veracity of the allegations and, if required, take action. He was asked to conclude the probe within four weeks.
