Defence questions reliability of key witness in Joshlin Smith case

The defence has argued that key testimony against the three accused in the Joshlin Smith case is riddled with contradictions, calling into question the reliability of the State's main witness, Lourentia Lombaard, who testified under Section 204 of the Criminal Procedure Act.
Advocate Fanie Harmse, representing Jacquen 'Boeta' Appollis (Accused 1), told the Vredenburg Regional Court that Lombaard's various accounts, her confession, Section 204 statement, and oral evidence in chief contradicted each other on several points.
'I submit that the two versions — the 204 statement and the 204 witness's evidence are mutually exclusive. They can't both be true,' said Harmse.
Joshlin Smith, a six-year-old girl from Middelpos in Saldanha Bay, was reported missing on February 19, 2024.
Her mother, Racquel 'Kelly' Smith (Accused 3), left her in the care of Appollis on that day. Co-accused Steveno van Rhyn (Accused 2) was also allegedly involved in what the State argues was a plan to traffic the child.
Lombaard, who initially faced charges herself, turned State's witness. She testified that there had been a discussion about selling Joshlin.
However, Harmse highlighted inconsistencies in her timeline: she initially said the conversation occurred on Sunday, but under cross-examination, she admitted it may have been Monday morning. 'That is a material conflict,' said Harmse.
Further contradictions included whether Appollis walked with Kelly as she allegedly took Joshlin to a white VW Polo for handover, and whether Kelly had acted alone or in agreement with Appollis.
According to Lombaard, when Kelly mentioned her plan to Appollis, he dismissed her, saying he didn't want to hear her 'stories', to which Kelly replied she would do it herself. Harmse argued this showed a lack of common purpose between Accused 1 and Accused 3.

'A disruptive operation was swiftly conducted, and they proceeded to the said building,' he confirmed. 'During the search, police found indoor cannabis plants, ecstasy tablets, crack cocaine, chemicals and equipment to the street value of approximately R350 000.00,' Mhlongo added. Thando Mgqobozi sentenced to life for the brutal murders of sisters Siyamthanda and Cordelia Koli
The heinous crimes, in which serial criminal offender Thando Mgqobozi tied his minor victims up and left their lifeless bodies in a forest near their home, occurred a decade ago. Image: Independent Newspapers The wheels of justice have turned against a serial offender who will now serve a further three life terms for the double rape and murders of two sisters - Siyamthanda and Cordelia Koli - committed at Willowvale, Mthatha, in the Eastern Cape. This week, the High Court of South Africa, Eastern Cape Division, Mthatha, sentenced Thando Mgqobozi, 30, to three life imprisonment terms for two counts of murder and rape, as well as 15 years for robbery with aggravating circumstances plus five years for kidnapping. The heinous crimes, in which the accused tied his victims up and left their lifeless bodies in a forest near their home, occurred a decade ago, confirmed National Prosecuting Authority (NPA) spokesperson, Luxolo Tyali. Next Stay Close ✕ 'The sentences are as a result of the conviction for crimes committed against two sisters 10 years ago by Mgqobozi, who is serving a life term for murder and robbery he committed while out on bail. While still in custody awaiting trial for the case for which he was sentenced (this week), he was sentenced for another crime of assault with intent to cause grievous bodily harm that he committed before his arrest,' said Tyali. The bodies of the sisters, aged 12 and 16, were found on December 2, 2015, in a forest near their home in Lower Nqadu, Willowvale. 'They were half naked, with multiple stab wounds, and their hands were tied with a belt. The discovery was reported to the police, and information was received that they were last seen in the company of Mgqobozi, after they had been attending a traditional ceremony the previous night. The cellular phone of the deceased, Cordelia, was discovered at Mgqobozi's place of residence. He was arrested on the same day, and DNA samples taken from him positively placed him at the scene of the crime. 'When the matter went to trial in 2017, Mgqobozi employed delaying tactics, including changing attorneys twice. On 24 March 2021, the Mthatha High Court granted him R1,500 bail as the trial dragged while he was an awaiting trial inmate for five years since his arrest. Less than three months after his warrant of liberation was signed, Mgqobozi committed four serious offences, including robbery with aggravating circumstances, murder, and unlawful possession of a firearm and ammunition, for which he was convicted on 19 October 2023,' said Tyali. During the trial, despite the overwhelming evidence mounted against Mgqobozi, he maintained his innocence but exercised his right to remain silent, said Tyali. State Advocate Mbulelo Nyendwana presented overwhelming evidence against the accused. Delivering the judgment on sentence, Judge Mbulelo Jolwana noted that Mgqobozi had not expressed any remorse at all. 'There is absolutely nothing on which anyone can have any valid hope that there could possibly be a chance that he can be rehabilitated. He is just a hardened, cowardly criminal who sees nothing wrong with brutalising young girls for personal sexual gratification and the twisted joy in murdering his victims to hide his criminal conduct,' Judge Jolwana said. Welcoming the sentence, the Eastern Cape Director of Public Prosecutions, Barry Madolo, praised the prosecution team and all role players involved in bringing the matter to a close. 'This was a senseless and brutal act of violence that devastated innocent young girls and their family. The fact that the accused will begin this sentence after completing his current life term is a demonstration of the seriousness with which our courts view such crimes,' said Madolo.

Family praises Umngeni Mayor Pappas for progress in murder case

Image: Independent Media archives The family of an induna who was killed in an execution style in broad daylight in front of his children two years ago has commended uMngeni Municipality Mayor Chris Pappas for the help that led to the arrest of the alleged killers, which includes Inkosi Simphiwe Zuma. Inkosi Zuma of the AmaNxamalala Tribal Authority, was arrested on June 13 for the murder of his Chief induna Qalokunye Zuma on January 14, 2023. Zuma made his second appearance at the Impendle Magistrate's Court on Wednesday, where the National Prosecuting Authority (NPA) argued against his bail application. Zuma, who is Umkhonto Wesizwe Party (MKP) leader Jacob Zuma's nephew, appeared alongside one of his co-accused who is also his induna Zwelithini Buthelezi. Buthelezi, who is alleged to have organised hitmen for Zuma, is also a co-accused in a case that is at Howick Magistrate's Court for the murder of Democratic Alliance (DA) councillor and uMngeni Municipality's chief whip Nhlalayenza Ndlovu, who was gunned down at his Howick home in December 2023. Qalokunye Zuma's son, Sifiso Zuma, believed that without the arrest in Ndlovu's murder, the police would have struggled to arrest his father's alleged killers. 'As a family, we should be grateful to Pappas, because I am sure that my father's case is where it is now through him. Sifiso Zuma said he had been visited by about eight investigating officers from Durban and Johannesburg, who were dealing with serious crimes, including political murders and claimed some of them told him that the gun that was used to kill his father was linked to Ndlovu's murder. 'The suspects were arrested for Ndlovu's murder, then they were linked to my father's murder,' said Sifiso. Pappas said it was known that the suspects were involved in intimidation and even alleged murder in Impendle. 'Despite the public awareness of these allegations, many remain silent out of fear of victimisation. 'We are encouraged that our relentless pursuit of justice for Nhlalayenza has also contributed to the arrest of individuals connected to other senseless acts of violence in the area,' said Pappas. In opposing Simphiwe Zuma's bail application, investigating officer Detective Sergeant Innocent Chamane told the court how Simphiwe Zuma attempted to collapse Qalokunye Zuma's murder investigation by helping Buthelezi evade arrest in Ndlovu's murder and another crime, which was related to theft of Eskom electricity's transformers and the illegal selling of uMngeni municipality's electricity. 'Accused three (Buthelezi) was on bail in another matter (electricity), appearing in the Howick Magistrate's Court when he decided to disappear. 'A warrant for his arrest was authorised by the Howick court, and the applicant (Simphiwe Zuma) facilitated that Buthelezi should continue running away from the police,' said Chamane. Out of frustration with the police delay in making an arrest, the DA and Pappas enlisted AfriForum's private investigators, who allegedly identified Buthelezi as the mastermind in Ndlovu's murder. It was only after Buthelezi's arrest on Ndlovu's murder that police allegedly connected Buthelezi to Qalokunye's murder.
