Shamsul Azri: Heads who conceal staff misconduct to face action

KOTA KINABALU: Chief Secretary to the Government, Tan Sri Shamsul Azri Abu Bakar, said department heads will face disciplinary action if they fail to act or attempt to conceal their subordinates' misconduct.
"Any department head who fails to act, or attempts to conceal misconduct, will face consequences.
"They will be summoned and issued demerit points. For failure to address governance violations, a 15 per cent demerit will be imposed," he told the media after the Jelajah Taat Setia Madani programme at the Sabah International Convention Centre.
Earlier in his speech, Shamsul Azri said that integrity issues continue to plague the civil service.
Audit reports and investigations by enforcement agencies have revealed cases of abuse of power, misappropriation of funds, and negligence, he said.
Shamsul Azri also stated that opaque procurement practices and abandoned development projects have eroded public trust.
Other offences include absenteeism, travelling abroad without approval, and taking medical leave without valid certification, he added.
"Typical penalties involve withholding salary increments or delaying promotions. Dismissal takes time, as we must adhere to the Public Officers (Conduct and Discipline) Regulations 1993," Shamsul said, adding that only around 10 per cent of civil servants are involved in such breaches of integrity.
A three-tier oversight system is in place to address disciplinary matters, beginning with the Investigation and Counselling Department, followed by review by a disciplinary board, and concluding with an appeals process, he added.
Meanwhile, Sabah Chief Minister Datuk Seri Hajiji Noor, who officiated the event, urged the 21,989 state civil servants and 126,677 federal civil servants in Sabah to act as facilitators in communicating government policies and implementing initiatives.
"Convey the government's message to the grassroots. Let the people know that the government is not only planning but also executing numerous development initiatives for the well-being of the state and its people," he said.
Hajiji added that all Sabahans should set aside political differences and work together to strengthen unity for the state's continued progress.
"Political stability is the foundation of prosperity. Let us move forward together in the spirit of solidarity, prioritising unity and renewing our commitment to a brighter future for Sabah."

KUALA LUMPUR, Aug 21 — Prime Minister Datuk Seri Anwar Ibrahim said today the government is appealing the Court of Appeal's ruling that decriminalised 'offensive' online remarks as the law needs a review. He said the government respects the court's decision over Section 233 (1)(a) of the Communications and Multimedia Act 1998 (CMA), but said any institutional reforms must be reviewed in detail. "Institutional reforms must be studied together, it is not just the Court's decision,' he told at the Asean Law Summit here. 'The court makes its decision and opinion, and we then study it to ensure it's in line with reforms.' Anwar said one of the aspects that needs studying is the freedom to assemble may encroach on restricted venues. 'Reforms are good if they are in line with our principles. But when it comes to the right to assembly, for example, I have an issue. 'If we say freedom to assemble is absolute, then what happens if it takes place at Istana Negara?' he asked. 'Sometimes, in our eagerness to demonstrate freedom, we overlook boundaries and encroach on places that should not be used — such as the grounds of the palace,' he added. Earlier this week, the Court of Appeal unanimously ruled that it is no longer a crime in Malaysia to make 'offensive' online comments with the intention to 'annoy', and struck down parts of the Communications and Multimedia Act 1998's Section 233 that had criminalised 'offensive' and annoying online speech. Federal Court judge Datuk Lee Swee Seng, chairing a three-judge panel, said the court found these words 'offensive' and 'annoy' in Section 233 to be unconstitutional, as they go against the Federal Constitution's Article 10(2)(a). Aactivist Heidy Quah had in August 2021 filed her constitutional challenge against the words 'offensive' and 'annoy' in Section 233, but failed at the High Court in September 2023, and today won her appeal at the Court of Appeal. While the Court of Appeal's decision has effectively removed the words 'offensive' and 'annoy' from Section 233, there is now a newer version of Section 233 that uses the words 'grossly offensive'. Yesterday, Communications Minister Datuk Fahmi Fadzil confirmed that the Attorney-General's Chambers will appeal the ruling in the Federal Court.

KUALA LUMPUR, Aug 21 — The government is finalising the eligibility criteria and implementation mechanism for its targeted RON95 petrol subsidy programme, with factors beyond monthly income to be considered, Prime Minister Datuk Seri Anwar Ibrahim has confirmed. In a written parliamentary reply on Tuesday, Anwar said that eligibility will be determined using various data sources to ensure a comprehensive and fair assessment, including the ownership of luxury properties and high-end vehicles. 'Eligibility for the RON95 fuel subsidy will be determined using various data sources, including income information from the Inland Revenue Board (LHDN) and the Household Income Survey (HIS) conducted by the Department of Statistics Malaysia (DOSM),' he said. 'This is to ensure a more comprehensive approach is adopted so that assistance is directed to those who genuinely need it.' The prime minister, who is also the fnance minister, was responding to a question from Larut MP Datuk Seri Hamzah Zainudin about the implementation timeline for the RON995 subsidy rationalisation. Anwar reaffirmed the government's commitment to introducing the targeted RON95 petrol subsidy in the second half of 2025. He also reiterated previous assurances that the rationalisation would not affect at least 85 per cent of Malaysians, with only non-citizens and high-income earners expected to be excluded from the subsidy. Last month, Anwar announced that RON95 would be lowered to RM1.99 per litre for Malaysians once subsidy withdrawal is implemented.

Anwar moots possible return of Ministry of Law to boost legal framework, access to justice

KUALA LUMPUR, Aug 21 — Prime Minister Datuk Seri Anwar Ibrahim has today signalled that his administration may establish a dedicated Ministry of Law to strengthen Malaysia's legal framework and improve access to justice. Speaking at the Asean Law Summit, Anwar said the move would ensure greater coherence in the country's legal ecosystem and allow Malaysia to play a stronger role in regional legal cooperation. 'Fortunately or unfortunately, I have a minister of law who is totally passionate and helps us all the time to effect change as fast as possible,' Anwar said, referring to Datuk Seri Azalina Othman Said. 'Therefore, I have to seriously consider the establishment of a dedicated Ministry of Law, a step that will not only ensure greater coherence in our national legal ecosystem, but also enable Malaysia to engage more meaningfully with our regional partners in advancing the rule of law.' Azalina is currently the minister in charge of law and institutional reform, but falls under the Prime Minister's Department. Malaysia previously had a Ministry of Law, before it was dissolved in 1995 and put under the PMD. Following the dissolution, the Legal Affairs Division (BHEUU) was formed to take over its tasks. Anwar today said that access to justice, especially for the poor and marginalised, must be central to legal reforms. 'The issue of access is very critical to ensure justice for every single citizen. I have seen where the poor and marginalised have been largely ignored because there's no access to the legal process,' he said. He added that inclusivity and sustainability — Malaysia's themes as Asean Chair in 2025 — must guide legal reforms. Inclusivity, he said, means the law must empower and protect, not intimidate or exclude. Sustainability, meanwhile, is about building institutions that endure and earn the trust of the people. The prime minister also framed the strengthening of legal institutions as part of Asean's broader push towards its 2045 vision, with rule of law as the foundation for regional trust, stability and shared prosperity. Anwar highlighted Asean's need to invest in mutual legal assistance, strengthen mechanisms for dispute resolution, and confront new challenges such as digital governance and the regulation of artificial intelligence (AI). He also pointed to Malaysia's mediation role in defusing recent tensions between Thailand and Cambodia, where Asean leaders helped broker a ceasefire. Calling it a 'triumph of diplomacy,' Anwar said it was proof that dialogue and principled cooperation can secure peace.
