Court sentences man to 20 years of imprisonment for raping daughter

New Delhi: A Delhi court sentenced a man to rigorous imprisonment of 20 years for repeatedly raping and engaging in unnatural sex with his 13-year-old daughter.
The court of Additional Sessions Judge Anu Aggarwal, in an order dated May 28, observed, "For a child, home is a space that gives them a sense of security, love and affection; a place where the child is nurtured and is the most relaxing place for a child.
The relationship between father and daughter is such that under the father's shadow, the daughter feels safe and secure."
The court convicted the man on May 19 under the POCSO Act for aggravated penetrative sexual assault, along with penal provisions for rape, unnatural offences, and criminal intimidation. Additional public prosecutor Arun K V argued against any leniency, highlighting that the convict had raped his daughter over a period of 20 days.
During the girl's summer vacation in June 2018, her father took her to the national capital. They initially stayed at her paternal aunt's house before moving to a separate rented room where the crime was committed.
The case came to light later in the month when the girl, who was 13 years old at the time and studying at a madrasa in Lucknow, disclosed the crime to a neighbour. The neighbour informed the police.
The court observed that the victim continues to suffer trauma, even years after the incident.

The court noted that children's most cherished place had become where they were "subjected to the most heinous crime within the four walls of her house by the person on whom she bestowed her utmost trust."
"After hearing the victim, it seems that this ordeal is never-ending for her. She was subjected to the most heinous offence and was not only raped but was also subjected to unnatural sexual assault. However, even after the passing of seven years, the victim is still afraid that if her father is sentenced to jail, she will be blamed by everyone in society," the court said.

Hearing the child's cries, villagers nearby reached the spot. However, the accused managed to flee by then. 1 2 3 Kochi: The drowning incidents at the district's beaches, including of two Yemeni students at Valappu on Monday, have raised serious safety concerns and once again highlighted the need for adequate deployment of swimmers or divers near prominent beach destinations. The 13 major and minor beaches in Ernakulam, where lifeguards are insufficient, have been witnessing repeated drowning incidents. The Yemenis — on an excursion from a Coimbatore college — went missing after venturing into the sea to take a bath around 12.30pm on Monday. A 21-year-old, part of a three-member group, drowned at Puthuvype while another two persons, belonging to an 11-member group, went missing at Cherai. "The rising drowning incidents are mainly due to a lack of awareness about the dangers of sea swimming," said Sebastian of Kochi-Chellanam Janakeeya Vedi. "Groups of young people often visit beaches and many of them who are under the influence of alcohol ignore local residents' warnings," he said. District tourism promotion council secretary Lijo John said tourism authorities have posted 32 lifeguards at Munambam, Cherai and Fort Kochi beaches, which have been officially declared as tourism destinations. He said tourism department cannot deploy lifeguards at other beaches as it is the responsibility of the coastal police and respective local bodies. The tourism department also plans to deploy lifeguards at Kuzhippilly Beach as it has become a major tourism destination. "We have put up signboards and banners at all major beaches aiming to prevent drowning accidents," said a source at the office of tourism deputy director, Ernakulam. Coastal police, meanwhile, said that while they have been deploying personnel at beaches, it is not practical to carry out continuous patrolling everywhere at all beaches simultaneously due to a shortage of adequate manpower. "For instance, since we are heading into a long weekend, we have deployed police personnel at all main beaches in the district. At the same time, it is important that visitors listen to the residents and other authorities. Deputy Director of the Women and Child Development Department Veeranagouda has said that child marriage is an age-old social evil practice and it should be eradicated from the route. He was addressing an awareness programme on women's safety and empowerment, the POCSO Act and the Prevention of Child Marriages Act, which was held at the government degree college in Yadgir for girl students leading at colleges. The programme was jointly held by the department, school education, and literacy department under the Mission Shakthi scheme. Mr. Veeranagouda said that child marriages can be strictly prevented only after the general public, especially young generation boys and girls, join their hands with the department. 'Anybody can dial the helpline numbers 1098, 112 and 181 to prevent child marriages or to protect women. Not only the child marriages, but underage pregnancy also can be prevented by collective measures,' he added. Nirmala, lecturer, said that the child marriages aren't prevented despite all possible awareness initiated over a decade. However, it can be prevented by continuous awareness programmes, she added.
