Middelburg court finds 32-year-old man guilty of statutory rape

Mlungisi Mbongeni Thabethe (32) was found guilty in the Middelburg Regional Court on a charge of statutory rape after he had sex with a 13-year-old girl. According to Middelburg Observer, the incident took place between June and September 2023.
The victim (who cannot be named due to the nature of the charges) testified that she and Thabethe had sex several times.
In his plea, Thabethe told the court that he was in a consensual relationship with the victim, and also formally admitted that she was 13 years old at the time of the offence.
He denied they had sex multiple times and said they only had sex once.
The victim testified that she met Thabethe in 2023, when he was visiting a friend in the same street as her. She said he asked if they could date, and she told him she was only 13 and was too young. Thabethe allegedly told the girl her age didn't matter to him.
The victim's parents pleaded with Thabethe to stay away from their daughter due to her age. When they realised their plea had fallen on deaf ears, they opened a case with the police. Thabethe was then arrested.
He testified to the court that he was under the impression the victim was 19 years old, as per her Facebook profile. The victim replied by saying that she only wrote that she was 19 so she could open a Facebook account.
Magistrate Deon Minnie stated that when the victim testified, she appeared to be a child under the age of 16, and did not give off the impression that she was older. 'This was so obvious that it must have been the same impression the accused had of the child's age as well,' he said.
He added that any reasonable person, under these circumstances, would have at least taken the steps to confirm the victim's real age despite her appearance, in light of knowing that having sexual relations with a person under 16 is an offence.
Thabethe was found guilty on the charge of statutory rape. It was stated that he was negligent for failing to enquire about exactly how old the girl was.
The matter was postponed to August for sentencing.

Municipal Manager Mandla Mnguni has responded to the shocking allegations that he awarded R1 billion in tenders to 'two associates' for electrification projects, saying the allegations are defamatory and false. He denied any involvement in tender irregularities and say that the municipality appointed 10 service providers for electrification projects, not two as the DA alleges. Mnguni says that the 2024/2025 capital budget amounted to less than R300 million, reflecting previous years. 'We don't have that kind of money,' he said. Mnguni says he's works tirelessly to expose corruption within the municipality, and suggests that this may be the reason for him being targeted with smear campaigns. According to the DA, a whistleblower accused Mnguni last week of awarding tenders to the value of R1 billion to two known associates, despite the the tender adjudication committee warning against a possible conflict of interest. The DA further alleges that Mnguni accepted a home and a farm as well as the use of a helicopter for his ambulance business, in kickbacks after the tenders were awarded. The DA furthermore alleges Mnguni ignored two legal opinions, warning against the awarding of the tenders. 'The tender and appointment documents prove otherwise, and I challenge the DA to provide concrete evidence to the contrary,' Mnguni just told Middelburg Observer. 'I have nothing to hide' he says. Mnguni's crackdown on corruption has already resulted in a slew of suspensions while forensic investigations were commissioned. The crackdown has also resulted in the recent resignations of the former Chief Financial Officer Mothiba Mogofe, former Execuive Director for Infrastructure Reginah Makgata and the former Director of Council and Administrative Support, Sbu Masilela. A while ago Mnguni also faced an internal complaint against him for interference with a management appointment process. Nothing has come of the complaint, which Mnguni also denied. Mnguni was unanimously appointed by council following the departure of Bheki Khenisa. 'We are cleaning house and someone prefers it dirty,' Mnguni says about the faceless whistleblower. The allegations has resulted in the Municipal Public Accounts Committee, chaired by the DA's Alderman Hennie Niemann to launch an investigation. Niemann says preliminary findings will be released within 21-days.

More than just highlighting their concerns, the event, held at Methodist Church on July 29, guided the elderly toward available resources and support. The forum's secretary, Mamoraka Mogane, emphasised the significance of the gathering. 'As the elderly, we have a lot of problems. So, when we are united like this, we are here to talk about our problems, to advise each other, and to show each other how we can tackle our challenges.' Mogane highlighted that seniors often face financial abuse. She said many rely on South African Social Security Agency (Sassa) grants, only to see their money siphoned off by their unemployed children. 'Children take their Sassa cards. So, today we gathered the elderly, so that, while we celebrate grandparent's day, we may be able to advise them.' 'We have different social workers who work with the elderly. When an elderly person comes to us with a specific problem, we are able to refer them to a social worker. The forum also urges seniors to join elderly organisations, and to speak up at meetings. 'If they keep quiet, the stress builds up. We want them to share so we can help.' For Mogane and the forum, the day was meant to demonstrate their support, and show available help for the seniors who are grappling with a myriad of challenges. A grieving family brought a dead body in a coffin into Capitec Bank at KwaDukuza Mall on Tuesday in protest over an alleged funeral insurance payout delay. North Coast Courier reports that, according to the family, they filed the claim last Wednesday and were initially told payment would be processed within 48 hours. They were later informed funds would only be available by August 22, nearly a month later. Feeling helpless, the family made the drastic decision to take the deceased to the bank to highlight the emotional and financial burden caused by the delay. The incident shocked shoppers and staff, drawing concern and sympathy from onlookers. A 43-year-old woman, sister of the 25-year-old deceased, expressed deep disappointment in the bank. 'We have to bury my sister this Saturday. Since they say they will only pay on the 22nd of next month, we brought her body to prove she has passed. I am worried because my whole family is insured with this bank.' This is not the first time such an incident has occurred in KwaDukuza. In 2019, a family from Madundube took a body to an Old Mutual branch under similar circumstances. Old Mutual said the claim had already been processed but acknowledged delays and apologised. KwaDukuza Mall management distanced itself from the matter. 'This was a private dispute between the family and Capitec Bank, which is an independent tenant operating within the mall premises,' said mall manager Siyabonga Tembe.
