SC issues notice to developers over transit rent delay in SRA project

MUMBAI: The Supreme Court on May 13, issued a show cause notice to two developers overseeing the slum rehabilitation project at Mori Road, Mahim (West). This came in response to the contempt petition filed by the legal heir of one of the hutments, who did not receive transit rent, as per the law.
On December 27, 2021, Sadiqa Ali Abbas requested the Slum Rehabilitation Authority (SRA) to record her name as the legal heir of her deceased grandmother, Sajadibegam Sayyad Majid, whose name was recorded in Annexure – II of the Slum Rehabilitation Scheme of Navkiran Co-operative Housing Society.
Annexure-ll of the scheme determines the eligibility of slum dwellers for rehabilitation, who are entitled to transit rent- a compensation for the temporary relocation during the redevelopment process.
Abbas filed a petition in the Bombay high court on September 7, 2022 claiming that despite submitting the required documents to record her name as the legal heir, no action was taken by the competent authorities and that the delay has resulted in not receiving the rent from the builder towards transit accommodation. The high court directed the competent authority to resolve the matter within six months.
Aggrieved by the order issued by the high court for unnecessarily delaying the process by granting a period of 6 months whereas the hut was already being demolished by the builder, Abbas approached the Supreme Court on October 17, 2022. The SC directed the SRA to take a decision within three months, adding, 'If the petitioner's name is entered in Annexure – II, she would be entitled to all other consequences as envisaged in law'.
Subsequently, the SRA issued a succession certificate to Abbas, and directed Omkar realtors and developers pvt. ltd. to deposit the outstanding rent amount, and Shree Nidhi concept realtors pvt. ltd., to deposit the rent arrears within 15 days.
On January 23, 2024, Balasahev Tidke-the Deputy Collector (Special Cell), Slum Rehabilitation Authority, issued a letter of appeal against the succession order stating that the documents produced for succession are not valid.
Due to the inaction of the authorities, Abbas approached the apex court once again in April 2025 through A A Siddiquie & Associates Advocates, urging it to initiate contempt proceedings against the respondents for not complying with its previous order passed by the SC in 2022.
After the perusal of the documents, the division bench of justices Surya Kant and Nongmeikapam Kotiswar Singh issued a show cause notice to the two developers- Omkar realtors and developers pvt. ltd. and Shree Nidhi concept realtors pvt ltd, seeking their response as to why the contempt of court proceedings should not be initiated against them.

Forest Minister Eshwar B Khandre said he has recommended action against two retired officers and two serving Indian Forest Service (IFS) officers, including the suspension of Additional Chief Principal Conservator of Forests R Gokul, in connection with the controversial attempt to denotify forest land held by Hindustan Machine Tools (HMT) in the media in Bengaluru, Khandre stated that although the land is currently under HMT's possession, it has not been converted to non-forest use and therefore continues to be classified as forest land as per the Forest Conservation Act, 1980 and various Supreme Court judgments. Despite this, the land has been alienated and is being used for commercial purposes, including the construction of residential complexes and film and television shoots. 'How this was allowed is questionable,' he to a question on the lack of action for seven months after notices were issued to officials involved in submitting an interlocutory application (IA) before the Supreme Court without cabinet approval, Khandre criticised the officials for bypassing protocol. 'This forest land is the property of seven crore Kannadigas. New Delhi: A damning inquiry report by a Supreme Court-appointed three-judge panel has reportedly indicted Justice Yashwant Varma of the Allahabad High Court, confirming serious allegations of misconduct. The panel's findings, submitted to then Chief Justice of India Sanjiv Khanna and forwarded to the President and Prime Minister earlier this month, recommend the removal of the judge. The inquiry, triggered by the discovery of a huge sum of burnt cash at Justice Varma's official residence in New Delhi following a fire on March 14, has laid bare troubling details, say sources. The three-member committee, comprising Punjab and Haryana High Court Chief Justice Sheel Nagu, Himachal Pradesh High Court Chief Justice G. S. Sandhawalia, and Karnataka High Court Justice Anu Sivaraman, meticulously examined the evidence and testimony of 55 witnesses over several weeks, sources added. In its report, finalised on May 3, the committee unequivocally stated that the cash was found in a storeroom at 30 Tughlak Crescent, the official residence allotted to Justice Varma, according to sources. Sources said the panel concluded that access to the storeroom was under the 'covert or active control' of Justice Varma and his family, thereby establishing a direct link between the judge and the cache of cash. The report further states that strong inferential evidence indicates the burnt cash was removed from the storeroom in the early hours of March 15, hours after the fire, sources informed. The committee, weighing 'direct and electronic evidence on record,' expressed a firm view that the allegations of misconduct raised in the letter from the then Chief Justice of India dated March 22, 2025, are 'sufficiently substantiated' and serious enough to call for the initiation of removal proceedings against Justice Varma, sources said. Throughout the inquiry, the panel examined a broad spectrum of witnesses, including 11 officials from the Delhi Fire Services, multiple police personnel ranging from rank-and-file officers to top brass, three personal security officers assigned to Justice Varma, CRPF static guards, and domestic as well as court staff. Notably, the judge's daughter, who was present during the fire, and Justice Varma himself were questioned extensively. Significantly, ten eyewitnesses testified about the presence of cash in the storeroom, corroborating the central allegation that Justice Varma's residence housed a large amount of currency under questionable circumstances, sources said. The report's implications are stark: the presence of such unexplained cash in a judge's official residence, coupled with his failure to provide a satisfactory explanation for its source, strikes at the very core of his integrity, say sources. The panel's recommendation to pursue removal proceedings underscores the seriousness of the misconduct and sends a clear message that the highest standards of probity must be upheld within the judiciary, say analysts.
