Soldier's killers found not guilty
Co-accused, Reevek Ramlall and Durell Govender, were found not guilty of the murder of SA National Defence Force trainee officer, Vishay Singh.
Govender (24) and Ramlall (35) were arrested on January 11, 2021, for allegedly driving over Singh.
The men were given bail on March 8, 2021, and they both pleaded not guilty to the charge of murder.
On Tuesday last week, Regional Magistrate Garth Davis handed down judgement in the Port Shepstone Regional Court.
Singh was run over outside his home in Ferndale Road in Palmview, Marburg on January 9, 2021.
For six months, Singh who was on life support, was admitted and transferred to various hospitals for treatment in KwaZulu-Natal.
He was then taken to a military hospital in Pretoria, where he died on June 23, 2021.
A medical legal post-mortem examination revealed the cause of death as blunt force trauma to the head and related complications.
Davis handed down a lengthy judgement.
'With the versions that are before the court and not losing sight of the performance of the witnesses who testified, their evidence can be criticised on the basis of it being at times contradictory and prone to embellishment and improbable. But, when seen in light of the contradictory evidence tendered by the state that directly impacts upon their reliability, there are serious doubts as to its reliability.'
He further said the more one examines the evidence of the state, including comparisons with the evidence admitted by the two eye-witnesses, Brady Govender and Avinash Manilal, the more it does not survive scrutiny.
In conclusion, the state's evidence is contradictory of the evidence led by Singh's family as to how he was killed is repudiated by the state's own evidence contained in the evidence of Manilal and Brady Govender.
'There are two mutually exclusive and destructive versions placed before the court in the state's case; the evidence is therefore unreliable and not credible,' he added.
* Side note: Brady Govender is now deceased, and the state was unable to secure Manilal's attendance at court.

Life in prison for Polokwane paramedic who raped girl (14)
POLOKWANE – The Polokwane Regional Court has sentenced a 56-year-old paramedic to life imprisonment for the rape of a 14-year-old girl. The sentence was handed down last Monday following his conviction on rape charges. According to Limpopo police spokesperson Brig Hlulani Mashaba, the victim was at her homestead on the afternoon of April 12, 2023 when she was attacked by the accused, who was known to the family as a friend. Mashaba added that the victim was changing from her school uniform in her bedroom, when the accused entered and raped her. Following his arrest, the accused, who at the time worked in the city was released on bail and ultimately convicted and sentenced following thorough investigation and prosecution. In addition to the guilty verdict, the court found that the man was unfit to possess a firearm, and a search and seizure of all firearms in his possession was ordered. It was ordered that his particulars be included in the National Register for Sexual Offences and Sex Offenders. He was also found to be unsuitable to work with children and his particulars must be included in Part B of the National Child Protection Register. Provincial police commissioner Lt Gen Thembi Hadebe commended the successful conviction and the victim for her courage in reporting this crime. Hefty sentence for pastor convicted of robbery
A pastor convicted of robbery with aggravating circumstances was this week sentenced to 15 years' direct imprisonment by the Molopo Regional Court. The court heard that Petrus Phuthego Gasengake (48), a pastor at a local church, visited the home of a female congregant in Ramosadi Village near Mmabath, in the North West Province, on 4 April 2021. At the time, the victim was in the company of a male congregant. Upon arrival, Gasengake bypassed them and proceeded directly to the victim's bedroom. ALSO READ: Richards Bay pastor faces sexual assault charges, granted bail An argument ensued in the bedroom, during which he choked the victim and threatened her with a knife. Driven by rage, he stole R4 000 in cash, as well as bank cards and the keys to her car, which he then used to flee the scene. The court further heard that after leaving the victim's home, Gasengake drove to his house in Lichtenburg, where he stabbed his wife without provocation, and fled. Cases of robbery and attempted murder were subsequently opened. Details of the stolen vehicle were circulated, and Gasengake was arrested in Vryburg two days later. He was positively identified by the victim. Gasengake was in November 2022 sentenced to 10 years' imprisonment for the attempted murder of his wife. Despite pleading not guilty to the robbery charge, Gasengake was convicted based on compelling evidence led by the prosecution. In aggravation of sentence, State Advocate Ntebaleng Mabale emphasised the prevalence of gender-based violence in the region and highlighted the importance of strong court action in protecting victims and communities. He argued that there were no substantial or compelling circumstances to warrant deviation from the prescribed minimum sentence of 15 years. In delivering judgment, Magistrate Ndade Maphango cited the aggravating nature of the offence, and noted that the accused showed no remorse and failed to apologise to the victim. Operation Shanela nets 151 suspects
SEDIBENG. – A powerful, coordinated police operation delivered significant results in the fight against crime. Police spokesperson Sergeant Thembeka Maxambela said Operation Shanela 2, conducted on May 29 in Heidelberg and Ratanda under the Sedibeng District, resulted in multiple arrests, numerous traffic fines, and the recovery of illicit goods.
