Ban today, black market tomorrow: Re-thinking the vape crackdown

Focus Malaysia6 days ago
THE government's move to ban open-system vape devices under the Control of Smoking Products for Public Health Act 2024 (Act 852) raises serious concerns.
While public health risks are real โ€“ with 80% of seized vape products reportedly containing banned substances โ€“ an outright ban may worsen the situation instead of resolving it.
A better approach is to regulate, tax and monitor the industry under a clear legal framework.
Using today's debate to ask tough questions
In Parliament yesterday (July 28), Health Minister Datuk Seri Dr Dzulkelfy Ahmad announced that enforcement would begin immediately against open-system vape devices, citing concerns over how easily they can be modified and refilled.

Authorities are right to be alarmed by the presence of substances like methamphetamine and cannabinoids in some of these products, especially among youth.
But pushing the industry underground will not eliminate these threats. It will simply make them harder to trace and control.
Singapore's experience shows the limits of prohibition
Singapore banned vaping in February 2018. Yet illegal products are still widely available, often sold through encrypted apps like Telegram and WhatsApp. Even more worrying is the rise of counterfeit vape liquids laced with synthetic drugs.
If a high-compliance country like Singapore cannot eliminate its black market, Malaysia is unlikely to fare any better using the same approach.
Prohibition risks strengthening the black market. Malaysia already loses over RM5 billion annually to illicit cigarette sales. A vape ban could drive consumers further toward dangerous, unregulated products.
Enforcement may also be misdirected. Authorities will be forced to target small retailers and informal sellers instead of focusing on major public health threats. Meanwhile, adult smokers looking to quit may find themselves pushed back to cigarettes or left to navigate an unregulated vape black market.
Why ignore revenue in a tight fiscal climate?
Malaysia has repeatedly cited limited fiscal space to justify subsidy reforms and tax hikes. Yet the vape sector remains largely untaxed and unregulated. This is a missed opportunity.
By taxing vape products based on nicotine content, the government could generate revenue, discourage high-risk use, and create a level playing field with the tobacco industry. A well-structured excise system would strengthen oversight while funding healthcare and anti-smoking campaigns.
Why go through all the trouble of expanding the Sales and Services Tax (SST) if we continue to ignore other obvious and efficient sources of revenue like vaping? Let's not waste the opportunity to get this right.
Use Act 852 as intended
The Control of Smoking Products for Public Health Act (Act 852) already contains the tools needed for effective regulation. These include product registration, licensing, advertising restrictions, and age limits.
Rather than bypass these mechanisms, the government should use them. Enforce mandatory product testing, introduce tiered excise taxes, license retailers with strict age-gated access, regulate advertising and collaborate with online platforms to curb digital black markets.
Public education must also be stepped up, especially targeting youth and parents.
The presence of banned substances in vape products is alarming, but a blanket ban is not a sustainable solution. It risks losing control of the market while also forfeiting harm reduction and revenue opportunities.
Malaysia already has the legal and policy framework to manage this sector responsibly. What it needs now is the political will to do so. Prohibition may sound tough but effective regulation is what truly protects public health.
Tax it. Regulate it. Control it. Let's not waste this opportunity to get it right. โ€“ July 29, 2025

Russian attack kills three in Zaporizhzhia region, governor says

(Reuters) -A Russian attack killed three people in southeastern Zaporizhzhia region on Sunday, the regional governor said, as Moscow's forces press on with their slow advance westward along the 1,000-km (620-mile) front line with Ukraine. Governor Ivan Fedorov, writing on the Telegram messaging app, said the three people were killed in the daytime strike on the town of Stepnohirsk. Private homes were destroyed. Reuters could not independently confirm the report. In Kamianske, a town a few kilometers south of Stepnohirsk on the Dnipro River in Zaporizhzhia region, a military spokesman said on Saturday that Ukrainian troops were holding on to their positions despite Russian attempts to take control. Fedorov's account came amid reports in recent days of new Russian military action in Ukraine's east and southeast. Ukraine's top commander said Moscow's forces were changing their tactics, using smaller sabotage units in a bid to push forward with their drive through eastern Donetsk region. Russian forces have focused their drive on parts of Donetsk region, particularly the logistics center of Pokrovsk, under Russian attack for months. Russia's Defence Ministry said on Thursday its forces had scored a major gain by capturing the town of Chasiv Yar, to the northeast, after months of fighting, though Ukraine has not acknowledged this. Russia's Defence Ministry on Saturday said it had taken control of another village closer to Pokrovsk. Denis Pushilin, the Russia-installed head of parts of Donetsk region under Moscow's control, said in a video posted online on Sunday the capture of Chasiv Yar, located on high ground would enable them to make further gains. Oleksandr Syrskyi, Ukraine's top commander, writing on Facebook on Saturday, said his forces faced the fiercest fighting around Pokrovsk and in two other sectors. "At the same time, the Russians are resorting to the tactic of 'total infiltration' with the increase of sabotage actions in our rear," he wrote. "It is in this way that they are trying to enter Pokrovsk." Ukrainian forces, he said, had set up "counter-sabotage reserves, whose task is to seek out and destroy enemy reconnaissance and sabotage groups." TELUPID: Any incumbent of a State Legislative Assembly seat previously won will continue to represent GRS in the upcoming 17th State Election, said Deputy Chief Minister Datuk Seri Dr Joachim Gunsalam. He said GRS remains a stabilising force in Sabah as it is a coalition of eight local parties committed to the state's development. Umno open to post-election cooperation in Sabah: Zahid

Published on: Sunday, August 03, 2025 Published on: Sun, Aug 03, 2025 By: Winnie Kasmir Text Size: SANDAKAN: Deputy Prime Minister Datuk Seri Ahmad Zahid Hamidi ( pic ), also Umno president, has reaffirmed the party's commitment to serving the people and remaining open to political cooperation in the post-election landscape for the benefit of Sabah. Speaking here on Sunday, he said post-state election collaboration among parties was possible, emphasising that political alliances are not permanent and should serve public interest. He made the remarks while officiating the 22nd Libaran Umno Division delegates meeting, where several national and Sabah Umno leaders were also present. Ahmad Zahid urged all parties to prioritise resolving pressing issues faced by the people, particularly the longstanding electricity and clean water supply problems. He said any incoming government must focus on delivering quality public services as a core responsibility to the people. To support development goals, he called for capable and credible leaders to take charge, warning that a stable government cannot be formed with weak leadership. He also outlined key proposals for the upcoming state election manifesto, including resolving power and water supply issues, accelerating Pan Borneo Highway upgrades, and expanding TVET education to boost job opportunities. * Follow us on our official WhatsApp channel and Telegram for breaking news alerts and key updates! * Do you have access to the Daily Express e-paper and online exclusive news?
