Asencio, now 22, was not present during the encounter, does not appear in the footage, and is not accused of recording it. His alleged role came later, when he received the video and showed it to a friend — despite prosecutors saying he knew it had been filmed without consent and that one of the girls involved was a minor.
The footage was allegedly recorded by three former Real Madrid youth players during a sexual encounter at a beach club in Gran Canaria in June 2023. One of the girls was under 16, while the other was 18. According to court documents, the recording was made secretly and shared in multiple WhatsApp groups, including one titled 'Whatever Ferran Wants'.
Prosecutors say Asencio asked for the footage to be sent to him on June 23 — more than a week after the incident — and received it in a single-view format. He is accused of showing it to a third party while in Las Palmas, despite knowing the victims had requested it be deleted.
He has been charged with two offences: disclosure of secrets and child pornography. The public prosecutor is seeking two years, six months and one day in prison, along with a €100 daily fine over 24 months and €10,000 in compensation for the victims.
The lawyer representing the underage girl has demanded a tougher sentence. In a separate legal submission, the private prosecution is requesting a four-year prison term for Asencio and urging the court to treat him as equally responsible as the players who filmed and circulated the video.

While the sentencing requests differ, this is standard in Spain's legal system. The Prosecutor's Office represents the state and proposes sentences based on its interpretation of the law. A private prosecution, acting for the victim, can argue for a harsher penalty if it believes the harm has not been fully addressed.
The three players accused of filming and distributing the footage — Ferran Ruiz, Juan Rodriguez and Andres Garcia — face a proposed sentence of four years and seven months, as well as restraining orders and €25,000 in compensation for each of the two victims.
None of the men involved have been convicted, and the investigation remains ongoing.
Real Madrid have not publicly commented on the case. The three players who allegedly filmed the footage no longer belong to the club.

And today Police Scotland again asked the public for assistance in tracking her down. The force said she vanished from Kilmarnock at around 8.15pm last Friday. The last sighting of the 36-year-old was in the East Ayrshire town's North Hamilton Street, and officers want locals to review CCTV footage or doorbell camera for any clues. A picture of Michelle, wearing a pink top, was posted on the Police Scotland Ayrshire Facebook page. The post said she is 5ft 5ins tall and is of medium build. The force said she also has long brown/blonde hair and that she has a distinctive tattoo on the left-hand-side of her face, which is a star design. The tattoo can be seen in the picture of her posted alongside the missing person appeal. The tattoo is two stars and sits underneath her eye, just above her cheek. Thomas Partey on verge of joining Villarreal despite rape charges
Thomas Partey, who is due in court this week to face rape charges, is close to signing for Villarreal. The Spanish club hope to announce a deal, believed to be for one year with the option of a further 12 months, in the next few days. Villarreal will face Partey 's former club Arsenal in a friendly at the Emirates this week. Partey has already passed a medical at the La Liga side with terms being agreed. The 32-year-old is due in court on Tuesday, the day before Arsenal host Villarreal, after being charged with five counts of rape and one count of sexual assault. Partey was charged on July 4, four days after his contract with Arsenal expired, although the alleged offences took place while he was playing for them. The Ghana international had been the subject of an investigation that started in February 2022 after police first received a report of rape. He will make an initial appearance at Westminster Magistrates Court and denies the charges against him, which relate to three women who reported incidents between 2021 and 2022. Arsenal were in talks to extend the midfielder's career at the club, having joined in 2020 from Atletico Madrid for €50m (£45.4m). Partey went on to make 167 appearances for Arsenal with manager Mikel Arteta suggesting they offered him a new contract because he is a 'really important player for us'. However, no agreement could be reached and Partey left as a free agent, allowing him to join another club without a fee being paid. During Arsenal's recent tour to the Far East and following Partey being charged, Arteta said he was '100 per cent' comfortable with the way that the club handled the case. On the day the charges were announced, they released a statement which noted Partey's contract with them had ended and that, because of 'ongoing legal proceedings', they were 'unable to comment on the case'. Speaking publicly about the matter for the first time, Arteta said on Monday: 'I think the club was very clear in its statement. There are a lot of legal matters that are very complicated so I cannot comment on any of that.' It was then put to him: 'A lot of fans have questions over the way in which the matter was handled by the club. Do you feel confident and comfortable that the club followed all the right processes in that?' Arteta answered: '100 per cent, yes.' Villarreal, who played Leeds United last Saturday as they prepare for the new season with a tour of England, have qualified for the Champions League which has clearly been a factor in Partey agreeing to join them who also wanted to return to Spanish football.
