Lawyer's bid to prosecute journalist over Sophie Toscan du Plantier case dismissed

A FORMER State solicitor who was involved in the case against Ian Bailey has failed in a legal bid to privately prosecute a journalist who wrote a book about the 1996 murder of Sophie Toscan du Plantier.
Robert Sheehan, who worked with the Director of Public Prosecutions (DPP) in 2001, sought to bring a case against journalist and author Senan Molony, alleging professional vilification through comments made in Sophie: The Final Verdict , a book published in 2024.
Mr Sheehan also alleged that comments made by Taoiseach Micheál Martin at the book's launch had damaged his reputation. During the event, Mr Martin reportedly questioned aspects of the Irish justice system's handling of the Bailey case.
This week, Judge Ann Watkin of the Dún Laoghaire District Court declined to issue a summons against Mr Molony. The judge found that the journalist's criticisms were directed at the legal process more broadly and did not provide grounds for a criminal prosecution.
The DPP had previously determined that the material submitted by Mr Sheehan did not disclose any offence that could be prosecuted in the courts.
Mr Sheehan has indicated that he may appeal the decision to the Circuit Court or to the European Court of Human Rights.
His complaint centred on remarks in the book and at the launch event that he believes called into question his actions and conclusions while working on the Bailey case.
Speaking at the launch in September 2023, Mr Martin is understood to have expressed concern at how the case was handled, saying it was difficult to understand why authorities had not pursued a prosecution.
Sophie Toscan du Plantier, a French film producer who was found dead outside her holiday home in West Cork in December 1996.
Ian Bailey, a journalist who was long considered the main suspect by gardaí, was never charged in Ireland despite being arrested and questioned twice. In 2019, a French court convicted him in absentia and sentenced him to 25 years in prison. The Irish State declined to extradite him.
Mr Bailey died in January 2024 in Co. Cork, at the age of 66. He always totally denied any involvement in the case.
More recently, director Jim Sheridan premiered a dramatised film based on the case— Re-Creation —at the Tribeca Film Festival. Mr Sheridan has publicly expressed supreme doubt over Mr Bailey's guilt, describing the situation as a 'double injustice' in which both families had suffered. While acknowledging Mr Bailey's history of domestic violence, Mr Sheridan maintained that this should not be conflated with responsibility for the murder.
The murder of Sophie Toscan du Plantier, a French film producer found bludgeoned outside her holiday home in West Cork in December 1996, remains one of Ireland's most infamous unsolved crimes.

Speaking close to the scene of the collision, Dayle Knights, Bailey's mum, said through tears "no words can express how absolutely devastated we are." The teenager's heartbroken stepdad, Daniel Horler, made an emotional plea to the driver to "do the right thing" and speak to the police. "He was a well-loved, popular young man with a lifetime of adventures ahead of him. "Now this is all gone." In a post online staff said: "The most loveable, caring, trustworthy, happy, smiley, beautiful young man we have ever had the honour of working with. A true gentlemen and friend." Flowers and tributes have been left close to where he was struck, including a Sheffield Wednesday flag and scarf - the football team he followed. One card said: "Light up the sky , you gorgeous, gorgeous boy. Love you always." Another said: "A lovely funny lad. So sad." The detective said detailed investigations are under way, including using CCTV footage, and there are a number of lines of inquiry. She said: "As the driver, this is your opportunity to come to us before we come to you. EMMANUEL MACRON AND his wife, Brigitte, filed a defamation lawsuit on Wednesday against a right-wing US podcaster who claimed the spouse of the French president used to be a man. The 218-page complaint against Candace Owens, who has millions of followers on X and YouTube, was filed by the Macrons in Delaware Superior Court and seeks a jury trial and unspecified punitive damages. In a statement released by their lawyer, the Macrons said they filed the lawsuit after Owens repeatedly ignored requests to retract false and defamatory statements made on an eight-part YouTube and podcast series called 'Becoming Brigitte.' 'Owens' campaign of defamation was plainly designed to harass and cause pain to us and our families and to garner attention and notoriety,' they said. 'We gave her every opportunity to back away from these claims, but she refused. Advertisement 'It is our earnest hope that this lawsuit will set the record straight and end this campaign of defamation once and for all.' The suit accuses Owens of using her popular podcast to spread 'verifiably false and devastating lies' about the Macrons including that Brigitte Macron was born a man, that they are blood relatives and that Macron was chosen to be France's president as part of a CIA-operated mind control program. 'If ever there was a clear-cut case of defamation, this is it,' Tom Clare, a lawyer for the Macrons, said in a statement. 'Owens both promoted and expanded on those falsehoods and invented new ones, all designed to cause maximum harm to the Macrons and maximize attention and financial gain for herself.' Brigitte Macron, 72, has also taken to the courts in France to combat claims she was born a man. Two women were convicted in September of last year of spreading false claims after they posted a YouTube video in December 2021 alleging that Brigitte Macron had once been a man named Jean-Michel Trogneux – who is actually her brother. The ruling was overturned by a Paris appeals court and Macron appealed to the highest appeals court, the Court de Cassation, earlier this month.

Kenneth Fitzsimons (45) and his 26-year-old son, Dean Fitzsimons, of Castlecurragh Vale, Mulhuddart, Dublin 15 are also charged in relation to the alleged assault. All five are charged with false imprisonment, intentionally or recklessly causing serious harm and with participating in or contributing to the activity of a criminal organisation by assaulting the alleged victim, causing him serious harm. The offences are alleged to have happened on February 12, 2025 at a house in Sheephill Avenue, Blanchardstown in Dublin 15. Jason Hennessy Jr is further charged with threatening to damage property and producing a branding stamp to intimidate another person during a dispute or a fight on the same date and at the same location. Brandon Hennessy is charged with producing a "steel breaker bar" in a manner likely to intimidate another person while committing or appearing to be about to commit an assault. Devon Hennessy is charged with producing a metal branding stamp. Dean Fitzsimons is charged with making a threat to kill or cause serious harm to the alleged victim and producing a metal branding stamp and a steel breaker bar. Kenneth Fitzsimons is charged with producing a steel breaker bar and an axe during the course of a dispute or fight. A solicitor for the Director of Public Prosecutions today applied to have the five men tried before the three-judge, non-jury Special Criminal Court.
