
Separation of church and state dodges a bullet — for now
A bedrock of American exceptionalism has been the prohibition on using tax dollars to support religion. In America's 'melting pot,' public schools must be open to all without any religious preference or indoctrination.
In a 4-4 decision (with Justice Amy Coney Barrett recusing herself for an apparent conflict), the Supreme Court rejected an effort to demand tax dollars to create a Catholic public charter school. The planned public school in Oklahoma would have required attendance at Catholic Mass, indoctrinated students in Catholicism and apparently discriminated in hiring and admissions.
But when Barrett participates in a future case, without some reconsideration, it is highly likely that the current court will permit taxpayer-funded public schools controlled by a particular church. If so, every church will be able to demand equal access to taxpayer dollars.
This should concern all Americans.
The First Amendment prohibits government establishment of religion, but what exactly does that mean?
At a minimum, it should prevent the government from picking what is the 'correct' religion. As the Supreme Court explained, the First Amendment prohibits the 'State or Federal government' from giving 'official support' to 'the tenets of one or of all orthodoxies.'
But that is exactly what the teachers and administrators at the proposed St. Isidore's would have done. These government employees, paid with tax dollars, would use government funds to endorse and advance Catholicism.
Oklahoma Superintendent Ryan Walters has tried to normalize this government endorsement of religion. He argues misleadingly that 'individuals have the right to express their religious beliefs. That does not stop in a school building.'
That is true for private individuals. But teachers, serving in a public classroom, are government officials and stand in the stead of the government. On their own time, they can support any religion they like.
On its face, this seems like the clearest possible violation of the First Amendment.
The first Supreme Court case on religious establishments unanimously endorsed Thomas Jefferson's 1802 declaration that the Constitution imposed a 'wall of separation between church and state.' Jefferson explained that when officials assume 'dominion over the faith of others, setting up their own opinions and modes of thinking as the only true and infallible, and as such endeavoring to impose them on others,' they violate religious freedom.
Eighteenth-century evangelicals emphatically agreed. Supported by James Madison's Memorial and Remonstrance Against Religious Assessments, they rejected even non-discriminatory aid for all Christian religions. They warned that blending church and state taints both entities.
Baptist minister Lewis Lunsford explained that 'the unlawful cohabitation between Church and State, which has so often been looked upon as holy wedlock, must now suffer a separation and be put forever asunder.'
The wall of separation between church and state has been broadly endorsed by Americans and the courts. Yet, in recent years, conservative justices have sought to advance a political agenda to circumvent that wall.
Now, some conservative judges and Christian nationalists have settled on a new tactic to undermine the separation of church and state: nondiscrimination.
Their argument goes like this: Since private secular schools get government funds, assistance for playground equipment, for example, failing to provide taxpayer dollars to religious schools is discrimination and violates other provisions of the First Amendment, the 'free exercise' and 'free speech' clauses, they argue.
But there are several problems with extending the nondiscrimination argument to a public charter school. The school itself will be a public school, funded by taxpayer dollars. It does not have a 'free exercise' right to practice a particular religion; no governmental entity does.
Supporters of the Catholic school cite instances in which the court has permitted private schools to preach religion to students. But those cases are fundamentally different: Those schools are private; even when they receive some government voucher funds from students, they are not public schools fully funded by tax dollars. In private schools, teachers do not speak for the state.
Second, the Catholic charter school has been clear that it would seek an exemption from standard non-discrimination and other requirements based on religion. This is seeking to exploit another breach in the wall of separation that conservatives on the court encourage, claiming that neutral government laws can be ignored if they conflict with a claimed religious belief, a self-defined right to an exemption from virtually any law.
This view has been soundly rejected by Jefferson and the late Supreme Court Justice Antonin Scalia, for example.
Sadly, once a new case arises and Justice Barrett participates, there is a strong indication that the court will permit a Catholic school to operate with taxpayer dollars, a point that Oklahoma Gov. Kevin Stitt (R) is trumpeting.
But this dramatic expansion of the non-discrimination argument has enormous implications. Obviously, Mormon, Episcopalian, Islamic, Jewish and Buddhist charter schools will be able to demand government funding.
Even more broadly, if the government establishes an organization to engage in scientific or medical research, will churches complain that it should also create Presbyterian, Islamic or Buddhist organizations so as not to discriminate?
Beyond the First Amendment, charter schools are an assault on the broad public education that has been the great American equalizer, assimilator and opportunity. Charter schools notoriously fail to deliver on improved education and, as with similar voucher programs, tend to benefit the rich.
If the court eventually accepts a religious charter school, the legislature should end the whole charter school program (and vouchers while it is at it).
Justice Sandra Day O'Connor, appointed by President Ronald Reagan, got it right: 'Those who would renegotiate the boundaries between church and state must therefore answer a difficult question: Why would we trade a system that has served us so well for one that has served others so poorly?'
The simple answer is that we shouldn't want that. Christian nationalists want to impose their religious beliefs on the nation, and we shouldn't let them.

DHS ends temporary protections for 530K immigrants from these countries
WASHINGTON – The Department of Homeland Security revoked temporary work and residency authorizations for more than 530,000 immigrants under a program the Supreme Court allowed the Trump administration to end in a late May ruling. The program protected immigrants from Cuba, Haiti, Nicaragua and Venezuela from deportation and provided them work permits. The program is often referred to as CHNV, an acronym that references the immigrants' countries of origin. Tricia McLaughlin, an assistant secretary at DHS, said immigrants were 'poorly vetted' through 'disastrous' programs that allowed them to compete for jobs against American workers. 'Ending the CHNV parole programs, as well as the paroles of those who exploited it, will be a necessary return to common-sense policies, a return to public safety, and a return to America First,' McLaughlin said. The program is one way the Trump administration is restricting entry into the United States. Other strategies include suspending asylum applications, hardening barriers along the southern border, deporting undocumented immigrants and restricting travel from 12 countries. The Biden administration created the program in 2022. But DHS Secretary Kristi Noem announced in March she was canceling the program because of concerns the immigrants would compete for government services and jobs, and because, she said, some of them were criminals. At least three lawsuits challenged Noem's decision. But the Supreme Court ruled May 30 that Noem could end the program. The impact of the decision is uncertain because immigrants could apply for legal status under other programs. DHS is notifying immigrants known as parolees, because their status is temporary, that if they no longer have a lawful status to remain, they must leave the country immediately. If they get stopped, they could be deported. Choking back tears, Sen. Alex Padilla details his LA handcuffing
WASHINGTON – Sen. Alex Padilla delivered an emotional floor speech June 17, his first remarks on the Senate floor since the California Democrat was dragged out of a press conference in Los Angeles held by Homeland Security Secretary Kristi Noem, pushed to the floor, and handcuffed. "You've seen the video. I was pushed and pulled. Struggled to maintain my balance. I was forced to the ground, first on my knees and then flat on my chest," Padilla said as he choked back tears. "If that is what the administration is willing to do to a United States senator for having the authority to simply ask a question, imagine what they'll do to any American who dares to speak up." Federal law enforcement agents forcibly removed Padilla from Noem's June 12 press conference after he interrupted the event amid mass protests over the administration's immigration crackdown. Alex Padilla was hauled out of Noem briefing Noem's agency oversees Immigrations and Customs Enforcement, which had been carrying out raids in Los Angeles. Protesters flooded the nation's second most populous city's downtown for days, some of which devolved into violence as protesters burned cars and looted buildings. Padilla said that he had gone to the federal building in Los Angeles where Noem was holding the press conference that day because he had a briefing with a four-star general about the military deployment in the city. His briefing was delayed by Noem's press conference, he said, so he asked an FBI agent and a national guardsman whether he could attend. They escorted him to the press conference, where he listened until Noem began speaking about plans to "liberate" Los Angeles. 'We are not going away. We are staying here to liberate this city from the socialist and the burdensome leadership that this governor and mayor have placed on this country,' Noem said. Padilla started asking: 'Madam Secretary I want to know why you insist on –' before he was grabbed by security guards. During his floor speech, Padilla said the administration planned "to somehow liberate us from the very people we democratically elected to lead our city and our state. Let that fundamentally un-American mission statement sink in." "Are we truly prepared to live in a country where the president can deploy the armed forces to decide which duly elected governors and mayors can lead our constituents?" he continued. Noem said during the press conference that she didn't recognize the two-term Padilla and that he hadn't requested a meeting with her. They met for for 15 minutes afterward, according to the Department of Homeland Security. Tricia McLaughlin, a Trump DHS official, wrote on X that Padilla's actions were "disrespectful political theatre" and claimed that the Secret Service believed he was an attacker. Republicans in Congress similarly put the blame on Padilla. House Speaker Mike Johnson, R-Louisiana, told reporters shortly after the event that Padilla's actions were "wildly inappropriate" and said he should be censured. Democrats were furious upon viewing the viral video of Padilla being forced to the ground. "Anybody that looks at that video will understand that this amounts to an assault, a felony," said Rep. Supreme Court Asked to Hear Challenge to Trump's Global Tariffs
(Bloomberg) -- Two family-owned toy companies are asking the US Supreme Court to consider striking down many of President Donald Trump's sweeping tariffs, putting a high-stakes fight with worldwide economic implications before the justices for the first time. The filing asks the justices to take the unusual step of considering the case without waiting for a federal appeals court to rule. Learning Resources Inc. and hand2mind Inc. said the issue of Trump's tariff authority under the 1977 International Emergency Economic Powers Act is so economically weighty that the justices should intervene immediately. 'In light of the tariffs' massive impact on virtually every business and consumer across the nation, and the unremitting whiplash caused by the unfettered tariffing power the president claims, challenges to the IEEPA tariffs cannot await the normal appellate process,' the Chicago-area companies argued. A federal appeals court in a separate case has said the tariffs could stay in effect until that panel hears arguments July 31. Trump has portrayed tariffs as critical to leveling the playing field for American businesses and workers amid chronic trade deficits. 'The Trump administration is legally using the powers granted to the executive branch by the Constitution and Congress to address our country's national emergencies of persistent goods trade deficits and drug trafficking,' White House spokesman Kush Desai said. 'If the Supreme Court decides to hear this unfounded legal challenge, we look forward to ultimately prevailing.' The filing comes in what until now had been a relatively low-profile case. US District Judge Rudolph Contreras in Washington said Trump exceeded his authority under IEEPA, though the judge limited the May 29 ruling to the two companies pressing the suit. Fast Track The Trump administration then appealed, and the companies are now asking the Supreme Court to directly review Contreras' ruling. The companies suggested the justices decide before their summer recess starts in about two weeks whether to hear the case, with arguments in September or October. The US Court of International Trade declared Trump's global tariffs unlawful in May in a separate case that also centers on the president's powers under IEEPA. The law says the president may 'regulate' the 'importation' of property when needed to 'deal with' an emergency. Contreras said that language doesn't authorize the president to impose import taxes. 'The power to regulate is not the power to tax,' he wrote. Both court clashes cover Trump's April 2 'Liberation Day' tariffs — which combine a universal baseline levy of 10% with potentially much bigger rates for various trading partners. Each suit also concerns separate import taxes over fentanyl trafficking. The toy-company case challenges trafficking tariffs imposed against China, while the Court of International Trade case also concerns similar taxes on imports from Canada and Mexico. Supply Chain The toy companies' chief executive officer, Rick Woldenberg, said in an interview that his businesses were now having to devote 30% of their office staff to navigating tariff issues. 'We've had extraordinary expenses, dramatically shifting our supply chain basically overnight — a supply chain we built over 40 years,' he said. 'I feel like a refugee from a war, where we're sort of loading everything up in the donkey cart and going to a safer place, not really knowing if the safer place we're going to is really safe.' The April 2 tariffs represented the biggest increase in US import taxes since the 1930 Smoot-Hawley levies, taking the country's average applied tariff rate to its highest level in more than a century. Global markets have fluctuated wildly since Trump's tariff announcement. Since then, trillions of dollars in market value have been shed and regained amid weeks of delays, reversals and announcements about potential trade deals, particularly with China. Trump's own 90-day pause on most of his sweeping 'reciprocal' tariffs is set to expire on July 9, when rates would increase drastically for many nations, absent trade deals or a further extension. Goods from the European Union, for instance, are facing a 50% levy. Trump's tariffs on steel, aluminum and automobiles were imposed under a different law, so are not directly affected by the case now before the Supreme Court. Administration officials have publicly downplayed the impact of the litigation by saying that most of the tariffs can be imposed by other means. The case is Learning Resources v.
