
SC Sets Aside Telangana HC Order, Gives Speaker 3 Months On BRS MLAs Defection Case
The Supreme Court on Wednesday directed the Telangana Legislative Assembly Speaker to decide within three months on the disqualification petitions filed against ten Bharat Rashtra Samithi (BRS) MLAs who had defected to the ruling Congress party.
A bench led by Chief Justice of India BR Gavai observed that political defections remain a pressing issue in the country and have the potential to destabilise democratic processes if left unchecked. The court allowed the appeal filed by BRS leader Padi Kaushik Reddy, who had sought a direction to the Speaker for a time-bound decision on the pending disqualification pleas.
Setting aside the Telangana High Court division bench's order from November 22, 2024, which had interfered with an earlier single judge ruling, the apex court emphasised the need for prompt resolution in such matters. 'We have referred to various parliamentary speeches, including those by Rajesh Pilot and Devendra Nath Munshi, to emphasise that entrusting disqualification proceedings to the Speaker was aimed at avoiding delays that may occur before courts," Chief Justice Gavai noted while reading the judgment.
The court made it clear that the Speaker, while adjudicating disqualification petitions under the Tenth Schedule, acts as a tribunal and does not enjoy constitutional immunity. It further directed the Speaker not to permit the MLAs to delay the proceedings and said that adverse inferences could be drawn if any attempts to protract the process are made.
The verdict was reserved on April 3, and a detailed judgment is expected to follow.

CHENNAI: The Madras High Court on Thursday refused to restrain the state government from rolling out the 'Nalam Kaakkum Stalin' scheme — which provides comprehensive health checkups for the public — but emphasised that the Supreme Court guidelines on using leaders' photos and names in government's publicity content must strictly be adhered to. The state government has proposed to launch the scheme on August 2. The plea for an interim injunction against the launch of the scheme was made by senior counsel Vijay Narayan, representing former AIADMK minister C Ve Shanmugam, before the first bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan, during the hearing of the petitions filed by the latter and an advocate, Iniyan, praying for orders to injunct the government from using the name 'Stalin' in the 'Ungaludan Stalin' scheme. Shanmugam also sought the court to issue directions to the Election Commission of India (ECI) and the Committee on Content Regulation in Government Advertising to take necessary action against the DMK under Paragraph 16A of the Election Symbols (Reservation and Allotment) Order, 1968, and consequently forbear the Tamil Nadu Public Secretary from using the name 'Stalin' in relation to the activities of the scheme emanating from the GO dated June 19, 2025.

BRS hails SC's decision on defected MLAs; asks Rahul to speak his mind
Hyderabad: Welcoming the Supreme Court's decision, BRS (Bharat Rashtra Samithi) working president KT Rama Rao on Thursday demanded that the Assembly Speaker disqualify the BRS MLAs who shifted loyalties. He also urged Congress leader Rahul Gandhi to demonstrate his commitment to his 'PaanchNyay' by ensuring the disqualification of MLAs who defected to the Congress. Rama Rao asserted that the Supreme Court's judgment should be respected, and the Speaker should promptly disqualify the defected MLAs. He emphasised that Rahul Gandhi, who often speaks about constitutional values, must adhere to his own words regarding defections. 'There is no need for further inquiry. The Speaker should immediately disqualify the MLAs, paving the way for by-elections in 10 constituencies. The BRS cadre is ready to win these elections. Ultimately, truth and righteousness have prevailed,' said Rama Rao. KTR expressed his gratitude to the Supreme Court for upholding the country's democratic system, proving that the malicious methods adopted by some public representatives cannot undermine India's democratic foundations. He also alleged that the Congress party's attempts to mislead the courts had been thwarted, and truth had ultimately triumphed. KTR criticised the Congress for what he termed their 'unethical and anti-constitutional politics of defections,' using the Speaker's position, stating that the Supreme Court's verdict was a 'slap in the face' to such practices. Demanding the immediate implementation of the Supreme Court's order, KTR challenged Rahul Gandhi to prove his sincerity and commitment on this matter. He reminded Gandhi of his 'PaanchNyay', which advocated for automatic disqualification upon defection, and urged him to welcome the Supreme Court's decision. 'I hope Rahul Gandhi, who in his PanchNyay advocated for stronger anti-defection laws and automatic cancellation upon defection, will welcome this decision. I dare you to stand by your own preachings, Gandhi. And I hope you and your party don't use the honourable Speaker's position to make a mockery of the Indian constitution, any further,' KTR stated on X (formerly Twitter). KTR questioned the Congress party's opportunistic stance on defections, maintaining different standards when in opposition versus when in power. 'It doesn't need much investigation to accept that all these 10 MLAs switched to Congress illegitimately and have been participating in the official programmes every single day!' KTR emphasised in his tweet.

Himachal revenue minister holds meeting with farmer and orchardist organisations
A high-level meeting was held on Thursday between representatives of the Seb Utpadak Sangh, Sanyukt Kisan Manch and Kisan Sabha with revenue minister Jagat Singh Negi and to address various challenges being faced by farmers and horticulturists across the state. The representatives urged that land in villages registered under individual's names in revenue records should not be treated as forest land. They further stated that Supreme Court in several judgments has directed to carry out proper demarcation before eviction and only after completing the due process should eviction be done. 'This is not just about apple growers. It's about farmers' rights, economic justice, and Himachal's future. Each block of the state will witness demonstrations,' said Rakesh Singha, convener of the Apple Federation of India and former MLA. Singha added, 'No other state in India is in such a dire position where the government cannot allocate even one inch of land. Today's meeting was a preliminary step to discuss how Himachal's survival as a state depends on resolving land rights and disaster rehabilitation.' After the meeting, Harish Chauhan, convener of Sanyukt Kisan Manch, said, 'The meeting with various farmer organisations was primarily to discuss the Supreme Court's stay on the felling of trees.' 'With the ongoing conflict in Iran, there might be reduced apple imports. Indian consumers are already preferring domestic produce. We must ensure our apples reach the market at the right time and quality to gain fair returns,' said Chauhan. The revenue minister has assured all possible support from the state government. He said that the government is committed to protect the interests of farmers and horticulturists and appropriate decisions will be taken in their favour. He further said that the additional chief secretary (Forest and Revenue) will soon hold a detailed meeting with representatives of these organisations to discuss each issue thoroughly.
