Poll: Data reveals developers exploited contributions loophole

New data shows property developers saved more than $33 million by exploiting a loophole the Selwyn District Council is powerless to close.
Data from the district council shows that in June last year, 2578 lots of development contributions (DCs) were applied for, right before increased DC rates were signed off in the council's Long Term Plan 2024-34.
DCs are paid by developers or property owners to the council, primarily to offset any additional infrastructure that might be needed to support the new homes they are building.
DCs help the council pay for the cost of new community facilities, roading upgrades, water and sewerage, and reserve upgrades. Costs vary around the district.
DCs are invoiced at the time of resource consent applications.
The council began consulting on the LTP, which included the DC rates, in April 2024. The following month, 809 lots of DCs were applied for, followed by 2578 in June, compared to an average of 80 DC applications a month from December 2023 to April 2024.
The LTP came into effect in July 2024. Applications for DCs prior to July paid rates set in 2021. While an inflation adjustment had been carried out, the rates did not take into account large cost increases for infrastructure.
For example, a sewage connection DC cost $4809 in the 2021 financial year, $5772 in 2023 and $12,917 from July 2024.
Of the June 2024 applications, the majority came from 15 applicants.
The council was effectively shortchanged about $33.9m.
It has given assurances that the shortfall will be paid for by future development and not ratepayers.
But outgoing Springs Ward councillor Grant Miller said in the council's finance and performance committee last week that developers were rorting the system.
'They might think it is clever business, but they have taken advantage of the system in not paying their fair share, and it should be flatly put to them, you are not paying your fair share,' Miller said.
He said developers who took advantage of the loophole were just passing on the cost.
'So future section owners, instead of paying, let's say $13,000, are going to pay $15,000 or $16,000 to make up what these beggars haven't paid now.'
Other councillors spoken to by Selwyn Times agreed with Miller. They also acknowledged they were powerless to stop it due to the need to consult on price increases before they are implemented.
Mayor Sam Broughton said growth should pay for growth, but was less concerned about the shortfall.
'Uncollected development contributions from this year are recovered from developers later, not from ratepayers. Likewise, if more had been collected than budgeted, future charges could drop. It's purely timing, and council cannot control when a development happens.'
Construction analyst Mike Blackburn said if developers did not take advantage of the loophole they wouldn't be very good at business.
'It's standard business practice; if you didn't do that, you wouldn't be a good businessman.'
Blackburn said generally it is the property owner who pays in the end.
'From a developer's point of view, development contributions are a zero net sum because they pass those fees onto the buyer.'
He said new development also provides councils with more money in rates. In Selwyn, rates rose by an average of 14.2% in July, but the council's rates take is expected to be about 19% higher because of growth.
Of the applications lodged in June, 844 came from Darfield between two applicants.
Malvern Ward councillor Lydia Gliddon was concerned about what it meant for the Darfield Indoor Courts, which is budgeted to cost $9m with 47% paid for by DCs.
Because the council had not consulted on the project prior to the 2024-34 LTP, none of the DCs collected before July 2024 can be put towards it.
'We were reliant on those sections to pay into that. To me, that project is quite compromised now,' Gliddon said.
The Government has proposed replacing DCs with development levies, which are designed to be fairer for councils, but they are not expected to take effect until about 2027.
Broughton supports the new system and also wants the Government to make changes to give 50% of the GST on new builds back to councils.
'For Selwyn, this would have meant $48 million extra last year, reducing rates.'

'A lot of our population was born overseas, and that proportion is growing all the time,' says Broughton. Last month, the mayor attended a celebration of citizenship at the Dunsandel Community Centre. 'Over 100 people,' he tells Frank Film. 'All new people in Selwyn, and all new people to New Zealand and they're all becoming citizens.' The appeal of the district, according to Broughton, also lies in its booming agricultural, industrial, manufacturing and construction industries. He points to the new homes being built, the new library and the industrial park currently providing 1200 jobs, many for people commuting from Christchurch. 'This has turned into the place where New Zealanders want to be, where things are happening, where jobs are available,' he says. But population growth has its complications. In 2000, the number of dairy cows in the Selwyn district was 59,900. That number almost tripled in under 25 years, reaching more than 176,000 last year. Selwyn is undergoing rapid transformation and is described as "the place where things are happening". Photo / Frank Film 'I think that the intensification of land use has both positive and adverse effects,' says Broughton, acknowledging the impact of dairying on the district's waterways. Selwyn District Council is currently investing $5 million into finding low-nitrate water sources to supply the district. Selwyn is also home to some of the most productive soil in the country, land Broughton warns is irreplaceable. 'If we lose that to housing, then it's gone,' he says. But that decision no longer comes down to local government. 'We sort of had red lines drawn around our towns about where growth would and wouldn't happen', Broughton says. In July 2024, the Government's National Policy Statement on Urban Development changed the requirements for councils to free up land for housing. 'The Government changed the rules and basically said, 'If you've got land on the edge of an existing town and the infrastructure is there to provide capacity for urban growth, then that urban growth can occur',' he says. Photo / Frank Film Other aspects of Selwyn's growth are also in the hands of central Government. 'What's missing in that planning, and local council doesn't have control over it, is where schools go and where new hospitals and GPs are,' he says. Even today, with its burgeoning population, the district still does not have its own hospital. 'Sure, community needs new roads and it needs water supplies, but a great community has also got those other social services that are the central Government's responsibility.' He compares Rolleston to Timaru, which, despite having a smaller population, has four high schools. Rolleston has one. 'We need more classrooms here,' says Broughton. 'There's a second campus being built at the moment, but I think we also need a second school or provision for that.' The population of Selwyn is expected to almost double in 30 years. Photo / Frank Film When it opened seven years ago, Rolleston College had 225 kids. 'Now, we've got just under 1900,' says principal Rachel Skelton. Lincoln University is also growing quickly, receiving a record-breaking 5500 enrolments this year. Broughton was 35 when he was first elected mayor in 2016. Raised on a farm near Darfield, job opportunities then, he says, were 'always elsewhere'. Now, he recognises the university as playing a pivotal role in shaping Selwyn's increasingly diverse population. 'I've seen a massive change in the ethnic make-up of Selwyn. It's really exciting, and I think the centre of that was around Lincoln University, people being attracted internationally to come and study, and then found out how good Selwyn was and decided to stay.' One resident who immigrated from India says living in Selwyn has brought him 'peace of mind'. 'It's such a lovely place, and community, and relaxed environment,' says another resident from Chile. 'The only thing that I can say from my perspective as a foreigner is just that we have to look after what is provided to us, because sometimes we take things for granted here.'

Brasilia, Monday, August 4, 2025:- Responding to reports that PR company Edelman, which handles the global PR account for fossil fuel giant Shell, has won a contract to provide COP30 media services to the Brazilian presidency, Global Climate and Health Alliance Executive Director Dr Jeni Miller said: 'Hiring a PR company that earns millions from downplaying the fossil fuel industry's role in the climate crisis, to handle communications for this year's UN climate conference where countries come together to negotiate global climate action presents a serious conflict of interest. Climate change is already causing terrible impacts to livelihoods, health and wellbeing around the world, with health systems being pushed to the brink.' 'With disinformation developed by PR agencies for fossil fuel companies driving decades of delayed action, allowing the climate crisis to worsen dramatically, COP host countries must take every step possible to keep fossil fuel influences out of these crucial climate talks.' Recognizing the profound threat that disinformation poses, just this month, Brazil joined four other countries declaring an 'ethical and political imperative' to tackle disinformation and other threats to democracy (English translation here) 'Naming the problem is vital. The next step must be to align action with those words', added Miller. 'Brasil should reconsider its contract with Edelman, and future host countries should take a clear stand that will avoid this kind of conflict of interest and prevent the influence of the fossil fuel industry on negotiations to deal with the problem that industry created.' GCHA is calling on Australia and Turkey, the countries vying to host next year's COP, to set a new standard for hosting countries by committing to: Not hire PR or communications firms that also have fossil fuel industry clients. No fossil fuel industry sponsorships. No fossil fuel industry representatives or former representatives in the presidency team. No fossil fuel industry representatives or former representatives in the host country's own delegation.
