Former CNBC analyst James Arthur McDonald Jr., who betrayed investors, sentenced in multimillion-dollar fraud scheme

A former television financial analyst accused of defrauding investors out of millions of dollars and spending years on the run was sentenced to five years in prison, the Justice Department said Monday.
James Arthur McDonald Jr., 53, is also expected to be ordered to pay restitution to his victims following his April 7 guilty plea for securities fraud.
'To his victims, [McDonald] seemed to embody the American Dream,' prosecutors argued in a sentencing memorandum. 'But looks can be deceiving, and as [McDonald's] victims learned, their trust had been betrayed.'
McDonald, who frequently appeared as a guest on CNBC as a financial analyst, was arrested in June 2024 at his Florida home after spending years on the run and extradited back to California, where he was the CEO and chief investment officer of Los Angeles-based Hercules Investments LLC, and Index Strategy Advisors Inc.

Prior to fleeing, McDonald also appeared to have terminated his previous phone and email accounts and told one person that he planned to 'vanish,' according to court documents.
In 2020, McDonald 'lost tens of millions of dollars of Hercules client money after adopting a risky short position that effectively bet against the health of the United States economy in the aftermath of the U.S. presidential election,' prosecutors said.
He misrepresented how the funds would be used and failed to disclose the 'massive losses' Hercules previously sustained.

'He misappropriated most of those funds in various ways, including spending $174,610 at a Porsche dealership and transferring $109,512 to the landlord of a home McDonald was renting in Arcadia,' the Justice Department said.
In total, McDonald lost around $3 million of his clients' money, prosecutors said.
With his other company, McDonald allegedly sent clients 'false account statements, including for one client who invested approximately $351,000, later needed the money to make a down payment on a home, was informed by McDonald that much of the money had been lost, and never got his full investment back.'

In total, the US Securities and Exchange Commission said McDonald 'raised more than $5.1 million from 23 investors and clients, and misappropriated more than $2.9 million of those funds for personal expenses and Ponzi-like payments to earlier investors.'
A federal arrest warrant was issued for McDonald in 2022 after he was charged with securities fraud.

The case drew national headlines, fuelled by speculation over a list of high-profile clients. The list remains sealed to this day. Plaza has been gradually returning to public life following Baena's death by suicide. In February, she appeared on SNL50: The Anniversary Special, wearing a pink tie-dyed T-shirt - a subtle tribute to the couple's wedding-day attire. The pair had been together for more than a decade, but had separated in the months before Baena's death.

U.S. soldier accused of trying to give Russia sensitive Army tank info for citizenship

Federal authorities have arrested an American soldier who allegedly tried to share classified information about the Army's M1A2 Abrams tank with Russia, the Justice Department said. Taylor Adam Lee — a 22-year-old active-duty Army member stationed at Fort Bliss in Texas — was arrested Wednesday and charged under the Espionage Act with attempted transmission of national defense information to a foreign adversary, federal prosecutors said in a statement. He was also charged under the Arms Export Control Act. The Justice Department claimed Lee "transmitted export-controlled technical information on the M1A2 Abrams Tank online and offered assistance to the Russian Federation." Prosecutors accused Lee of trying to swap the information for Russian citizenship. Lee — who held a top secret security clearance — allegedly wrote online earlier this year, "the USA is not happy with me for trying to expose their weaknesses," and, "At this point I'd even volunteer to assist the Russian federation when I'm there in any way." During a July in-person meeting, Lee allegedly handed an SD card with technical data and other information on Abrams tanks to a person who he "believed to be a representative of the Russian government." He also allegedly discussed giving Russia a piece of hardware from the tank, and appeared to deliver the hardware to an El Paso storage unit last week. "Mission accomplished," Lee messaged the person, the Justice Department said. A warrant for his arrest was filed in El Paso federal court on Tuesday. He was arrested and made his initial court appearance the following day. A criminal complaint did not appear to be filed in court as of Wednesday, and it's unclear if Lee is represented by an attorney. "This arrest is an alarming reminder of the serious threat facing our U.S. Army," Brig. Gen. Sean F. Stinchon, the commanding general of Army Counterintelligence Command, said in a statement. Lee's arrest comes as the military grapples with online espionage and leaking threats. Chinese intelligence agents have tried to target U.S. service members online and entice them into offering up sensitive information in exchange for pay, a trend some counterintelligence officials call "virtual espionage," CBS News reported earlier this year. Separately, former Air National Guardsman Jack Teixeira was sentenced to 15 years in prison last year for sharing classified documents about the Russia-Ukraine war on the messaging platform Discord. And a retired Army officer who worked as a civilian Air Force employee pleaded guilty last month to sharing Russia-Ukraine war information on a dating app.
