Calcutta HC orders interim stay on notification of OBC list in W.B.

In a setback to the West Bengal government, the Calcutta High Court on Tuesday directed an interim stay on the preparation of a new list of Other Backward Caste (OBC) communities.
A Division Bench of Justices Rajasekhar Mantha and Tapabrata Chakraborty issued the interim stay till the next date of hearing on July 31. The order was passed by the Division Bench following a petition seeking intervention of the High Court.
The court also put a stay on the State government's decision to open a portal for submission of caste certificates for the purpose of addition of OBC communities in the new list.
The Calcutta High Court in May 2024 had cancelled the OBC reservation awarded to 77 categories, highlighting a complete lack of legislative policy within the 2012 scheme to classify any group as OBC. The State government has approached the Supreme Court and the matter is pending before it.
On June 10, the West Bengal government tabled a new OBC list in the State Assembly with minor changes compared to the previous list.
Question posed
During the proceedings in the court, the Division Bench asked why the new OBC list had been finalised by introducing amendments to the 2012 Act.
The High Court's order came on a day when the State government opened a portal for admission in colleges and universities based on the new OBC list. There seems to be no clarity on the fate of the admission process particularly for those availing admission under the OBC category.
Decision welcomed
Leader of Opposition in the West Bengal Assembly Suvendu Adhikari in a social media post welcomed the order 'to stay the inclusion of 76 Muslim classes in the new OBC list prepared by the Mamata Banerjee government'.
The Bengal BJP leadership had accused the Trinamool Congress government of 'appeasement politics' for including Muslims in the OBC list. Mr. Adhikari said contrary to the claims of the State Advocate General that the Opposition has not opposed the OBC list tabled in Assembly, he had raised objections to the fresh OBC list tabled by the Chief Minister.

He went on to cite the killing of 26 Indians in a terror attack in Poonch, the prolonged violence in Manipur, and the Morbi bridge collapse in Gujarat that killed 140 people, alleging that BJP leaders neither resigned nor initiated credible probes in those cases. 'In Manipur, the Chief Minister clung to power for 20 months as the state burned. In Gujarat's Morbi, 140 died when a bridge collapsed. In January, 30 pilgrims were killed at Mahakumbh. Where was BJP's outrage then?' Siddaramaiah asked. Taking a swipe at BJP's leadership, the CM said, 'Did we ask PM Modi to resign after the Poonch terror killings? No. We demanded a special Parliament session, which was also denied. Till now, not a single perpetrator has been identified. Who should resign for that failure — Pandit Nehru? Rahul Gandhi?' Reiterating his government's commitment, Siddaramaiah said, 'Our government is accountable to 7 crore Kannadigas. We have already acted against those found prima facie negligent in the stampede. The judicial commission's report will guide us further, and we won't hesitate to take tough action.'

This order is a big setback for the Mamata government. A division bench comprising Justice Tapabrata Chakraborty and Justice Raja Sekhar Mantha passed the interim order while hearing petitions challenging the state's classification of communities under the Other Backward Classes (OBC) category. Judges said that necessary steps should be taken regarding the 66 communities belonging to the OBC category. In this latest OBC notification there are listed 140 communities. However, OBC certificates issued before 2010 under the 1993 law remain valid for employment and admissions. The bench warned that the executive cannot bypass legislative procedures, stating that half the process was followed and the rest done unilaterally. Petitioners claimed the survey was flawed, with limited samples and negligible changes from the earlier list. The state admitted that college admissions and recruitment are stalled due to the case. During the hearing, Solicitor General Ashok Chakraborty, representing the Centre, pointed out that the National Commission for Backward Classes (NCBC) had sought clarification from the state on how Muslim and OBC classifications were identified. The NCBC minutes mentioned that several communities had converted from Hinduism to Islam, complicating census data. Justice Rajasekhar Mantha raised the question to state, saying, "You have done half the work according to the 2012 OBC Act. Then you have gone back to the 1993 Act. Why is this? Why didn't you amend the 2012 Act? You have been providing benefits for the last 15 years. The law says that a survey has to be done after 10 years. That survey has not been done.
