
No bike taxis in Karnataka from Monday as HC refuses to stay single-bench order suspending their operations
In a setback to bike taxi aggregators, the Karnataka High Court on Friday refused to stay a single-bench's order suspending the services of bike taxis in the state. The division bench of Acting Chief Justice Kameswar Rao and Justice Sreenivas Harish Kumar directed the petitioners – Ola, Uber and Rapido – and the respondent (transport department) to file their submissions by June 20, while the matter was adjourned to June 24.
However, the April 2 single-bench order by Justice Shyam Prasad will continue to be in effect till then, with the two-judge bench refusing to provide any interim relief to the aggregators.
Justice Rao observed that an interim relief could have been given to aggregators, provided the state government considered drafting a bike taxi policy. 'However, in this case, the state government has clearly made a policy decision (of not being interested in framing a bike taxi policy),' he noted.
The aggregators had appealed to the division bench seeking a stay on the single-bench's order and an extension of the deadline to suspend bike taxis operations in the state. This comes after the high court granted an extension for suspending bike taxi operations by another four weeks from May 14, modifying the single bench order. The deadline will now end on June 15, Sunday.
The petitioners argued that in the absence of rules by the state, the guidelines issued by the central government under the Motor Vehicles Act should apply. However, the state government countered that the Centre's guidelines are persuasive and not binding unless adopted by the state.
The absence of an interim relief is likely to hit operations of bike taxi aggregator Rapido and others in the field like Ola and Uber. The April 2 order had directed all bike taxi operators to suspend their operations, pending formation of rules by the state government under Section 93 of Motor Vehicles Act.
Rapido had argued that a blanket ban in the absence of regulation would directly impact the livelihoods of over 6 lakh people across Karnataka. The company also submitted that it had disbursed over Rs 700 crore to captains and paid over Rs 100 crore in GST contributions across categories in Bengaluru over the last years.
Rapido stated that over 75 per cent of bike taxi riders use the platform as their chief source of livelihood, earning an average of Rs 35,000 per month. The company also said that using two-wheelers as contract carriages had been legal since the inception of the Motor Vehicle Act 1988, with an advisory to this effect issued by the Centre reiterating this position in law.

BENGALURU: The state government on Friday informed the High Court of Karnataka that it has taken a policy decision not to frame rules and guidelines to allow bike taxi services through Ola, Uber and Rapido. Advocate General K Shashikiran Shetty made this submission before a division bench of acting Chief Justice V Kameswar Rao and Justice Sreenivas Harish Kumar. 'As a policy, we do not want to frame rules for operation of bike taxis' and only eight states have permitted bike taxis in the country. The court was hearing the appeals filed by Uber India Systems Pvt Ltd, ANI Technology Pvt Ltd, Varikruti Mahendra Reddy, and others. They offer bike taxi services through Ola, Uber and Rapido. They had appealed against the order passed by a single judge on April 2. The single judge declared that unless the state government notifies guidelines under Section 93 of the Motor Vehicles Act and Rules, the petitioners cannot operate as aggregators offering bike taxi services and the transport department cannot issue directions to register motorcycles as transport vehicles or issue contract carriage permits.

Despite efforts from stakeholders, bike taxis will stop plying on roads post June 15 as the Karnataka High Court on Friday refused to stay a single judge's order prohibiting the use of such taxis until a formal policy is introduced. The appeal was filed by ANI Technologies ( Ola ) and Uber India , challenging Justice B Shyam Prasad's order to suspend services. The division bench of acting chief justice Kameswar Rao and Justice Sreenivas Harish Kumar on Friday directed Ola, Uber and the transport department to file their submissions on merit by June 20. The matter was adjourned to June 24. The IT industry body, Nasscom , on Thursday wrote to the Karnataka government urging it to defer the June 15 deadline, warning of large-scale livelihood disruptions. Nasscom said the role of tech-enabled mobility, such as bike taxis, boosts last-mile connectivity, eases traffic congestion, and supports gig workers. 'The ecosystem not only offers affordable and efficient mobility but also sustains lakhs of gig workers across the state, including students, women, migrants from other parts of Karnataka and those recovering from the post-pandemic economic crisis,' the industry body noted in its letter. Nasscom requested the state government to provide interim relief while simultaneously initiating a consultative process to develop a balanced regulatory framework for a long-term solution. It suggested that existing models in states like Delhi, Telangana and Rajasthan should be reviewed to formulate rules. Nasscom reiterated its commitment to work closely with the government to craft a forward-looking policy that supports innovation and ensures commuter safety. Ride-hailing services and the state government had been at loggerheads after Karnataka, in March last year, banned the operation of bike taxi services owing to what the government saw as a lack of encouraging response from ride-hailing platforms to offer services with electric two-wheelers (E2Ws). The government withdrew the Karnataka Electric Bike Taxi Scheme that it had notified on July 14, 2021. The sources in the government argued that the transport department was not inclined to allow bike taxi operations, as 1.7 lakh autos and cabs in Bengaluru paid taxes every quarter. However, bike taxis had no compulsion for such taxes as they are meant for private use, paying only a lifetime tax.
