
BBC security manager spent 12 hours studying CCTV to find who left kitchen mess
Mohammad Rakib worked at the BBC Wales headquarters on behalf of the security contractor Mitie, but was sacked for gross misconduct for his 'superfluous' use of CCTV.
Mr Rakib was accused of breaching data protection rules by looking through CCTV without having the correct licence in May 2023.
He allegedly gave 'multiple' explanations for trawling the footage – including that he was trying to help someone find a lost bag – as well as claiming he could not remember the reason.
But another security worker told investigators Mr Rakib had told him he spent 12 hours viewing the tapes 'to catch who had made a mess in the kitchen'.
Mr Rakib claimed he was unfairly dismissed after Martyn Barrass, Mitie's investigator, informed Joel Adlington, the BBC's corporate security manager, of the issue.
In a letter to Mr Barrass, Mr Adlington said: 'The use of the BBC CCTV systems by a non-licenced staff member, without a DPA request or any oversight for what appears to be personal benefit or superfluous use is unacceptable and may put us in breach of ICO regulations and GDPR legislation.
'I must put on record that it is a significant breach of trust between the staff member and the organisation and you have my full support in your assessment of gross misconduct.'
Unfair dismissal
Mitie held a disciplinary hearing over the alleged CCTV misuse and Mr Rakib, who had relocated from London to Cardiff to take the role and worked for the company for eight years, was sacked. When his firing was upheld after an appeal, he went to an employment tribunal and won his case for unfair dismissal.
Judge Rachel Harfield said there was no indication in place in the company guidelines that the CCTV offence would amount to gross misconduct.
She said: 'There was no clear picture before the respondent as to what the claimant's training was, and they had not given him any training themselves or any standard operating procedures on CCTV usage for example.
Judge Harfield said Mr Rakib was now only earning the minimum wage as a security officer at SGD Guarding.
She said: 'It took the claimant eight years and a move to Cardiff to get promoted. The claimant says he is now at back of the queue at SGD Guarding in terms of promotion opportunities. He says he thinks it will take another five years.'

Mercedes driver admits killing young woman in 140mph Christmas Day crash
A Mercedes driver has admitted killing a 22-year-old woman in a 140mph crash on Christmas Day in 2022. Evan Forde, 32, of Bedford, was behind the wheel of a black Mercedes car when he crashed into the back of a BMW early on December 25 2022. Brazilian Maria Carolina Do Nascimento, who was a passenger in the BMW, died at the scene in Brent Cross, north London. The accident happened on a 40mph stretch of Hendon Way at around 3.45am after Forde had reached speeds of more than 140mph. Shortly beforehand, police officers on patrol in a marked vehicle had indicated for Forde's car to stop. However, the vehicle drove off from police and there was no pursuit, Scotland Yard had said. A short time later police were informed the same car had been involved in a collision with another car. The occupants of the Mercedes did not stop for police and fled the scene on foot, police had said. London Ambulance Service attended but Ms Nascimento died at the scene. On Tuesday, Forde appeared at the Old Bailey and pleaded guilty to causing Ms Nascimento's death by dangerous driving. Members of the victim's family wept in court after he admitted the offence. Defence barrister Tasmin Malcolm said Forde had 'always accepted' he was driving the Mercedes. She said: 'Undoubtedly the speed Mr Forde was driving will be an aggravating feature to the court. 'It is important we are satisfied of the accuracy of the material relied on by the Crown.' Prosecutor Frederick Hookway observed that small variations of the speeds involved in the case were unlikely to have an impact given the defendant had reached 'top speeds of over 140mph'. Judge Anthony Leonard KC adjourned sentencing until October 22 and granted Forde continued conditional bail. He told him: 'You have pleaded guilty to a very serious charge. There was perhaps no option other than to do so given the state of the evidence. 'However, the fact you pleaded at this stage will be taken into account at sentencing. 'You must understand the most likely result – if not the inevitable result – will be you sent to prison.' Previously the Metropolitan Police said it had made a referral to the Independent Office for Police Conduct as is routine in such circumstances.

Gerry Adams donates to ‘good causes' after BBC pays 100,000 euro damages
Gerry Adams has said he has made donations to 'good causes' after the BBC paid the former Sinn Fein president 100,000 euro (£84,000) in defamation damages. The broadcaster lost a defamation case earlier this year after Mr Adams took them to court over a 2016 episode of its Spotlight programme and an accompanying online story.
