Suvendu Adhikari targets WB Government over OBC reservation

Leader of Opposition Suvendu Adhikari on Thursday (May 22, 2025) targeted the West Bengal government over the issue of OBC (Other Backward Classes) reservation, citing an order by the Calcutta High Court where the court stated that only those included in category before 2010 will receive the benefit.
In May 2024, the Calcutta High Court cancelled all Other Backward Classes (OBC) certificates issued in West Bengal since 2010.
Mr. Adhikari cited a recent order of Justice Kaushik Chanda of the Calcutta High Court, where he pointed out that the caste of the candidate is included in the OBC list. Introduced by the Backward Class Department of the State prior to 2010, only they shall receive the benefit of OBC reservation.
The West Bengal government has approached the Supreme Court against the Calcutta High Court order and the matter is pending before the apex court.
'The State Government getting under the scanner is now a routine affair. Today, the Hon'ble Justice Kausik Chanda has directed immediate implementation of the OBC reservation order passed by the Hon'ble Division Bench. The plea of the State regarding the issue pending before the Hon'ble Supreme Court of India has been thwarted stating that the State has failed to obtain any stay on the Hon'ble Division Bench order,' the BJP leader said in a social media post.
Since OBC reservation affects lakhs of candidates and students seeking admissions in academic institutions there has been lot of confusion. Legal experts point that since the West Bengal government has not obtained any stay against the Calcutta High Court order, the admissions will be carried out on the basis of the situation prevailing before 2010.
While striking down the OBC list of the West Bengal government in 2024, the Calcutta High Court highlighted a complete lack of legislative policy within the 2012 scheme governing the State's authority to classify any class as OBC. The court ordered the State to establish a clear legislative policy before delegating such authority.

Kolkata: Persons suffering from rare diseases should be treated as a "class of themselves", the Calcutta High Court observed while suggesting the state increase the monthly stipend from Rs 1,000 to Rs 5,000. The division bench of Chief Justice TS Sivagnanam and Justice Chaitali Chatterjee (Das) has now requested Additional Solicitor General (ASG) Ashoke Kumar Chakraborti to examine the policy by the central govt on the establishment of more than one centre of excellence for rare diseases in a state. There is only one centre of excellence for rare diseases in the eastern region — IPGMER. The division bench was hearing a PIL filed by parents of children suffering from muscular dystrophy, a rare disease. On the court's inquiry, the state informed that they pay a monthly stipend of Rs 1,000 to people suffering from rare diseases, the same as the amount paid to persons with disabilities. "...Assist the court as to what directions can be issued so that another centre of excellence can be established in Bengal since the court is informed that not only patients from Bengal come here but also from the neighbouring states" the CJ told ASG. "So far as persons suffering from rare diseases are concerned, they cannot be equated to a person who is normally classified as a person with disability. Though the person suffering from rare diseases is undoubtedly a person of rare disability, the disability is more severe as it is a degenerative disease," the bench observed. The court suggested that the tablet "Deflazecort," which is the approved therapy for DMD, be given to the patients to cover the dosage for a minimum of two months. If the tablets dispensed are for a lesser period, then each time the patient needs to travel to the hospital, which is a herculean task for persons suffering from rare diseases. One of the parents of the patients in court, who happens to be an employee of the High Court, stated that his son recently became very sick, and since no ICU bed was available, he admitted his son to a private hospital. He was kept in the ICU for 10 days, and the cost incurred was very high and unmanageable. The state was directed to submit a report on June 27 on the establishment of three ICU units in the police hospital, which will provide exclusive care to persons suffering from rare diseases, apart from the facility available in the SSKM hospital and the other hospitals situated in and around the police hospital. "This is so required because high-speed oxygen is required for the patients, and in the event there is no bed available in the SSKM hospital main campus, then the patient will be put to irreparable hardship," CJ stated. The state was also directed to take expeditious decisions and ensure that the five mechanised wheelchairs are procured and supplied to the hospital no later than June 13. The court also asked the state whether a subsidy can be given for the purchase of a mechanised wheelchair.

A Kolkata judge only denied bail to Sharmistha Panoli, a social media influencer accused of making communally-charged statements in a video. This enraged many, and they now want to issue a death warrant against the the bail rejection on June 3, anonymous accounts on X went after Justice Partha Sarathi Chatterjee of the Calcutta High Court — going so far as to say he deserved 'unknown gunmen'. This, of course, was a reference to Luigi Mangione, the American man accused of shooting and killing Brian Thompson, the CEO of UnitedHealthcare, in December last X user called Toshali wrote, "This scum bong - Partha Sarathi Chatterjee - deserves kambal some unknown need their unknown gunmen in that fear to seep in to such cretin judges." Another account with the username rohitkumar23595 replied, saying, "Kill Partha Sarathi Chatterjee." India Today Fact Check looked at the various threats being issued to the judge on X and found a common thread: these accounts were anonymous. They had no real profile pictures, using photos of animated characters, sportspersons, and even coins. Some of these accounts were created mere days ago in some accused the judge of corruption and alleged ties with West Bengal's ruling party, the Trinamool Congress, others crossed the line into explicit threats and attempts at account going by the name of Adi shared a link from the National Green Tribunal website containing the judge's bio. He wrote: 'Let's see if we can find his home address.' While the account claimed it was based in New York, we could not find any posts about the US city. All the posts seemed to be about Indian account, going by the name Rupesh Reddi, posted, 'Anyone know his address? Or mobile number? A major controversy has erupted in the First Year Junior College (FYJC) admission process in minority trust-run junior colleges in Maharashtra this year after the government admission portal showed a sharp decline in the number of seats available for general category students. This change, sources at minority institutions said, was because seats from the general or open category were allocated to SC/ST/OBC-category students. A government official said that the only communication in this regard is a Government Resolution (GR) issued on May 6 on the FYJC admission process. The sentence from the GR that the officer referred to deals with vacant seats under the minority quota after three rounds of admissions. 'If admissions are lower than the intake capacity in minority quota, admissions can be given as per interchanging between linguistic and religious minority groups. Even after that, if seats remain vacant, those surrendered vacant seats will be filled based on the centralised admission process where all social and parallel reservations are applicable,' the GR states. As per the established practice, 45 per cent of the total intake in minority institutions is kept open to all students, irrespective of category, after reserving 50 per cent for the particular minority, and 5 per cent for management quota. However, this year, the admission portal is reflecting only around 14 per cent of such open seats, senior officials at several minority institutions said. This has sparked widespread confusion among junior colleges run by minority institutions, as they say the Supreme Court has explicitly prohibited such reservation in minority institutions, as it would increase the number of quota seats to beyond 80 per cent. Authorities at the minority colleges are also irked that there was no clear communication on the change, as most of them only noticed it on the admission portal. According to sources, the May 6 GR effectively means that constitutional reservation will apply to seats left vacant in the minority quota. 'But nowhere does the document mention that the state has decided to implement the constitutional reservation to 45 per cent seats in minority quota, which were until now open for all to be filled only on the basis of merit,' the principal of a minority trust-run college said, adding that there was no discussion or meeting in this regard. However, the government official insisted that though the particular sentence in the GR pertains to leftover seats under the minority quota, 'it is implied here that the other remaining seats will see application of reservation'. 'That is the point of conducting centralised admission process so that the system is the same in all colleges. There should not be any confusion over this,' the official added. Emphasizing that this will leave hardly any seats for candidates coming from open category, principal from another minority run college said, 'Percentage of reservation under SC/ST/OBC combined can go over 30 percent, then there is 50 percent already reserved for minority and five percent of seats going to management quota. This essentially means reservation on over 85 percent of seats.'
