Louisiana execution recharges debate on death by nitrogen gas

The Hill08-03-2025

A death row inmate slated to become the first person to be put to death by nitrogen gas in Louisiana is seeking to halt the execution, citing constitutional concerns over the controversial killing method.
Jessie Hoffman is set to be executed March 18, but his attorneys are asking a judge for a preliminary injunction to prevent it due to the secrecy of how the execution will be carried out.
The inmate will present his arguments during a hearing on Friday, during which he is expected to testify.
Hoffman was convicted of first-degree murder in the 1996 rape and murder of 28-year-old Mary 'Molly' Elliot.
Hoffman's lawyers say that he was informed Feb. 20 that he will be killed using nitrogen gas, but state officials have not yet provided a detailed execution protocol, which the lawyers say is necessary to meet his constitutional rights.
'The State wants to roll out this new gas protocol but keep it hidden from the public and even from the man they seek to kill,' Samantha Kennedy, executive director of the Promise of Justice Initiative, who is representing Hoffman, told NewsNation.
'Jessie Hoffman has a right to know how he's going to be killed, and we have a right as his attorneys to be able to determine if it's going to be a constitutional.'
Louisiana Attorney General Liz Murrill has defended the state's decision to utilize nitrogen hypoxia, a method used to suffocate a person by denying them oxygen and allowing them to only inhale nitrogen gas.
'On March 18, 2025, the State of Louisiana will execute Hoffman by nitrogen hypoxia for Molly's murder. We have and will continue to vigorously defend the State's obligation to carry out this sentence and bring justice to the family and friends of Molly Elliot,' Murrill said in a statement.
Murrill told Nexstar affiliate WVLA that she hasn't personally spoken to the victim's family.
History of nitrogen gas executions in the US
The country's first execution using nitrogen gas was carried out last year in Alabama, which has now been used to execute four people in the state. If Hoffman's execution doesn't get halted, Louisiana will become the second state to utilize the method on death row inmates.
All of the men executed in Alabama using nitrogen shook or gasped to varying degrees on the gurney as they were being put to death, according to media witnesses, including The Associated Press.
Rev. Jeff Hood, the spiritual advisor for Kenneth Smith, who was the first person to be killed using nitrogen, witnessed his execution and called it 'a slow, painful means of torture.'
Smith's execution was 'the most violent thing that I have ever witnessed or engaged with,' Hood told Catholic news outlet OSV. 'It was absolutely … incredibly disturbing to see a human being suffocated to death.'
Alabama Attorney General Steve Marshall has maintained the method as 'painless and humane.'
After convicted murderer Alan Miller settled a lawsuit against Alabama over the use of nitrogen gas in 2024, Marshall stated, 'The resolution of this case confirms that Alabama's nitrogen hypoxia system is reliable and humane.'
Alabama's nitrogen executions prove even more how untested this method is, Kennedy said.
'It's impossible to know if somehow Louisiana Department of Corrections has fixed all the problems that happened in Alabama, where every single time they killed people with gas, it was absolutely a torturous, gruesome, horrific experience,' she said.
'Jessie Hoffman and the public have a right to know what is the process that Louisiana is engaging in, and … if they're upholding everyone's constitutional rights,' Kennedy added.
Which states allow for the use of nitrogen gas in executions?
Currently, four states allow nitrogen gas executions: Louisiana, Alabama, Oklahoma and Mississippi.
An Arkansas bill that would allow nitrogen on death row inmates passed the state House on Tuesday and will now advance for a full vote.
Louisiana had paused executions for 15 years due to an inability to secure lethal injection drugs, but with a nitrogen gas execution protocol finalized last month, the state has been eager to proceed.
'For too long, Louisiana has failed to uphold the promises made to victims of our State's most violent crimes, but that failure of leadership by previous administrations is over,' Louisiana Gov. Jeff Landry said in a statement.
Louisiana scheduled two executions on consecutive days in March, but inmate Christopher Sepulvado, who was scheduled to be executed one day before Hoffman, died on Feb. 23 of an illness.
Hoffman had initially challenged Louisiana's lethal injection protocol in 2012 on the grounds that the method was cruel and unusual punishment.
U.S. District Judge Shelly Dick dismissed the lawsuit in 2022 because the state had no executions planned but reopened the case last month, saying that the scheduled executions were 'extraordinary circumstances' that warranted more scrutiny.
A three-judge panel of the U.S. 5th Circuit Court of Appeals issued a stay in Dick's ruling while it considers an opposition from Murrill.

Trump deploys National Guard to Los Angeles amid ICE raid protests

President Trump deployed 2,000 National Guardsmen to Los Angeles on Saturday as protests against Immigration and Customs Enforcement (ICE) rattle the city. White House press secretary Karoline Leavitt said the move is a result of 'violent mobs' attacking 'Federal Law Enforcement Agents carrying out basic deportation operations' in recent days. 'These operations are essential to halting and reversing the invasion of illegal criminals into the United States. In the wake of this violence, California's feckless Democrat leaders have completely abdicated their responsibility to protect their citizens. That is why President Trump has signed a Presidential Memorandum deploying 2,000 National Guardsmen to address the lawlessness that has been allowed to fester,' she wrote. Trump said California Democrats Gov. Gavin Newsom and Los Angeles Mayor Karen Bass were to blame for the unrest that began as a result of ICE raids. Los Angeles police have not responded to rowdy demonstrations where protestors have vandalized cars and property, according to administration officials. LAPD confirmed they were not involved. 'If Governor Gavin Newscum, of California, and Mayor Karen Bass, of Los Angeles, can't do their jobs, which everyone knows they can't, then the Federal Government will step in and solve the problem, RIOTS & LOOTERS, the way it should be solved!!!' Trump wrote in a Saturday Truth Social post. However, Newsom said the federal response is 'inflammatory' and said deploying soldiers 'will erode public trust.' 'LA authorities are able to access law enforcement assistance at a moment's notice,' Newsom wrote in a Saturday X post. 'We are in close coordination with the city and county, and there is currently no unmet need,' he added. A group of over 800 assembled to address their outrage following Friday's raids. Officials from the Department of Homeland Security said demonstrations have spread across the country, leading to several arrests in Los Angeles County and 5 in New York City this week, according to NewsNation reporting. 'Outside a federal law enforcement building in New York City, more than 150 rioters erupted to interfere with ICE's immigration enforcement operations,' DHS wrote on X. 'Thankfully, unlike in Los Angeles, the local police department quickly responded to the riots. So far, NYPD [New York Police Department] has made five arrests,' the post read, adding that those who touch law enforcement officers will be prosecuted. Christian CassarlyThe Miracle of Superpower Thinking

Some stories are so layered with pain, misunderstanding, and injustice that the only way to tell them is through the fruit that came after. This is not a story about defending a man. It's about witnessing a miracle—one so radical, so generous, and so complete that it forces us to confront what truth really looks like. The man in the system tried to disappear. The man the courts offered to bury in a mental ward for the sake of convenience. The man who walked through ten years of shame, silence, and rejection. And the man who responded with one of the most sacred and prophetic acts of generosity we've seen in modern Catholic history. The Gift: A Fully Developed, $100,000 Education—Given Freely to the Poor Christian Cassarly spent six years building Superpower Thinking (SPT)—a complete, Ivy League-grade trading and financial formation platform. It includes: 75 advanced courses, each backed by a book Proprietary frameworks for trading, capital protection, emotional strategy, and generational wealth A system designed to produce elite, spiritually grounded investors A structure as deep and rich as a four-year university program It has not yet been globally used—but it is complete, activated, and ready to transform lives. And now, Cassarly has announced that every Catholic high school graduate who cannot afford college will receive the entire program for free. 'All they have to do is attend church weekly. That's it. Show God they're showing up—and I'll show up for them.' It's a prophecy. It's a divine reversal. And it's evidence. When Fruit Speaks Louder Than Labels Years ago, Cassarly was falsely accused in a case that spiraled far beyond reality. The narrative was distorted: a six-month-old cousin was cited as a six-year-old child. There was no act, no crime, no predation. But the plea was forced. Violence in jail. A system eager to close a case. They offered him one year in a mental facility—not for healing, but for silence. And what he built afterward was so saturated with clarity, discipline, spiritual conviction, and brilliance that it forces any reasonable person to re-examine the entire narrative. 'You can tell a tree by its fruit. And if my life was what they said it was—this fruit could never exist.' Cassarly isn't giving SPT to universities. He's not selling it to hedge funds. He's giving it to the Church. To the very young people the world often forgets. To the faithful poor. To the families who cannot afford the gates of college. To the ones who still bow their heads in Mass and wonder if anyone sees them. 'I was raised by the Church. I was fed by the Eucharist. I cried in pews when no one saw me. I owe everything to God—and now, I bring Him my first fruits.' This is a $100,000-level education—built for full market readiness, ready to multiply capital, steward wealth, and raise up a new generation of traders, investors, and leaders who fear God and move with precision. The world would sell it. He is giving it away. That alone says everything. This Act Is the Proof You cannot build it out of guilt. You cannot offer it out of delusion. You cannot forge this kind of system if your life is disorder, confusion, or evil. What Cassarly has done is not just generous. It is mathematically exact, prophetically timed, and spiritually whole. 'I'm not asking them to clear my name. I'm asking them to look at what came out of my life. That's how God proves a man—by what he produces.' This is not a redemption story. This is a resurrection story. And resurrection is the highest proof of innocence. Final Word: He Didn't Need the Court to Vindicate Him—The Fruit Did The world tried to label him mentally unfit. Today, he is mentally sharper than most institutions. The world tried to call him unsafe. Today, he is building infrastructure to safeguard the next generation's future. And the Church—the very place where he once sat as a child—is now receiving his greatest work. That is the miracle. That is the proof. And that is why Christian Cassarly is not just innocent—he is appointed. This is not just a gift. It is a divine interruption. It is Superpower Thinking. Biden Weaponized Law Enforcement Against Catholics

Even the initial story about the FBI targeting Catholics for suspicion and surveillance was bad enough. In December 2023, the House Judiciary Committee published a detailed report about how the FBI specifically identified traditional Catholics as potential domestic terror threats. The House report revealed the shocking finding that the Richmond, Virginia, office of the FBI suspected traditional Catholics "as violent extremists and proposed opportunities for the FBI to infiltrate Catholic churches as a form of 'threat mitigation." In sworn testimony before the U.S. Senate, former FBI Director Christopher Wray was challenged by Sen. Josh Hawley of Missouri: "Now we know that, in fact, FBI agents did approach a priest and a choir director to ask them to inform on parishioners." Despite this serious allegation, Wray denied a wider FBI initiative and blamed a localized mistake in Richmond. Well … new information reveals that, at best, FBI Director Wray was playing fast and loose with the truth. At worst, the then-sitting chief law enforcement investigator of America committed perjury when he dishonestly stated that the memo was "a single product by a single field office." Oh, all while completely maligning the largest denomination of Christian believers in the United States. But, alas, the sad story of the FBI targeting Catholics does not end in 2023. New information uncovered by Sen. Charles Grassleys committee reveals that the so-called "Richmond memo" was more like a nationwide all-points-bulletin from FBI brass, informing legions of agents to suspect and investigate faithful parishioners across the land. As CatholicVote describes, "the FBIs anti-Catholic Richmond memo was distributed to more than 1,000 employees in FBI field offices across the country." Sen. Grassleys press release states that a whistleblower "produced at least 13 additional documents and five attachments that used anti-Catholic terminology and relied on information from the radical far-left Southern Poverty Law Center" to target Catholics. Amazingly, such harsh anti-Catholic actions formed a key policy agenda for Joe Biden, a politician who constantly trumpeted his Catholic bona fides and bragged about the rosary he carries in his pocket. Of course, those pronouncements did not stop him from targeting the Little Sisters of the Poor for brutal Department of Justice intimidation when he was vice president. Nor did Joes faith restrain him as president, when he awarded Americas highest civilian honor, the Presidential Medal of Freedom, to the late Cecile Richardson, one of the most prolific abortion providers in U.S. history. Unfortunately, Bidens anti-Catholic actions follow a tragic trend of recent decades for Democrats, once the proud home to generations of Catholic voters across America. In fact, Bidens eventual vice president, Kamala Harris, engaged in brazen anti-Catholic bigotry as a U.S. senator in 2018. Harris tried to derail the judicial nomination of Brian Buescher simply because the district court nominee dared to belong to the Catholic fraternal charity organization, the Knights of Columbus. I wrote about that prejudice - an unconstitutional religious litmus test - in a December 26, 2018, opinion piece for RealClearPolitics. No wonder that during the 2024 presidential race, then-Sen. JD Vance called the Biden-Harris White House "the most anti-Catholic administration in living memory." Which brings us back to the present day and these newfound facts about the breadth and scope of the anti-Catholicism of Bidens FBI. This targeting fits within a larger context of the completely unacceptable politicized weaponization of federal law enforcement by people like Biden, Harris, Wray, and former Attorney General Merrick Garland. Sen. Grassley makes it clear that he believes Wray lied under oath. If that allegation is correct, then the Trump-Vance DOJ must charge Wray. In addition, this issue carries great political peril for Democrats and big continued rewards for Republicans. Historically, Catholics decide national elections. For over half a century, the Catholic vote has determined the winner in every election but one (choosing Al Gore over George W. Bush in 2000). In 2024 Trump rolled up an incredible +11% margin among Catholics nationwide, a giant improvement over his tie among Catholics in 2020. In fact, Trump would not have won the popular vote - surprising every "expert" - without his dominant performance among Catholics. So, lets get to the truth, punish the evildoers, and reap the political spoils as well. Steve Cortes is president of the League of American Workers, a populist right pro-laborer advocacy group, and senior political advisor to Catholic Vote. He is a former senior advisor to President Trump and JD Vance, and a former commentator for Fox News and CNN.
