Delhi High Court directs legal aid to Indians on death row in Indonesia
The Delhi High Court on Friday (May 2, 2025) directed the Indian Consulate in Indonesia to ensure three Indian nationals on death row in the foreign country were given adequate legal aid to pursue remedies.
Justice Sachin Datta issued notice on the petition by the spouses of the convicted Indians and directed Ministry of External Affairs to pursue the matter at the diplomatic level.
The court further asked the authorities to facilitate communication between the convicts and their families in India.
Raju Muthukumaran, Selvadurai Dinakaran and Govindasamy Vimalkandhan, all hailing from Tamil Nadu, were arrested in July 2024 for allegedly smuggling 106 kilogram of crystal meth aboard the Legend Aquarius cargo vessel.
They were stated to have been awarded the death penalty by Tanjung Balai Karimun District Court, Indonesia recently for violation of narcotics law.
'The Indian Consulate in Indonesia is directed to: (i) take requisite steps for the purpose of ensuring that the convicted Indian nationals are afforded adequate legal representation, and to render appropriate assistance to them for the purpose of pursuing appellate remedies,' the Court ordered.
'The respondent Ministry of External Affairs, Union of India is also directed to pursue the matter at the diplomatic level with the Indonesian government, for the protection of the Indian nationals under applicable international conventions or bilateral agreement/s,' the Court said.
The petitioners said the men were bread winners who worked at the shipping company in Singapore and they were of limited means.
They pointed out the limitation period for pursing the appellate remedy was very stringent and requisite steps were required to be taken immediately.
As a result, the plea sought directions to the Indian Consulate in the foreign country to render appropriate assistance to the death row convicts.
The petition said the petitioners received the copy of the Indonesian court's judgement on April 29.
The matter would be heard on May 6, 2025.

One person survived the accident and is currently under medical observation.

New Delhi: A Delhi court has discharged a man apprehended for alleged murder in Redfern, Australia, in 2003. The court noted that it was a case of mistaken identity as his fingerprints did not match with the actual crime file. Additional Chief Judicial Magistrate Pranav Joshi discharged Mohammed Basheeruddin, 37, in an order passed on June 13 after considering the forensic reports. "On June 12, 2025, the report of the CFSL was received in sealed condition. Today, the report is opened in the open court. As per the report, the fingerprints of Mohammad Basheeruddin, who was arrested on May 17, 2025, are different from the fingerprints of the original FC (fugitive criminal)," the judge said on Friday. "In view of the report, Mohammad Basheeruddin is discharged from the present proceedings," he added. Earlier on June 29, 2003, the body of a man named Shoukat Mohammed was found inside a sleeping bag in wheelie bin on James Street, Redfern. The victim was drugged and assaulted before being strangled to death. Advocate Farhat Jahan Rehmani, appearing for the current accused, told the court that the name of the actual accused mentioned in foreign records was Bashiruddin Mohd, a different individual from the current accused, whose full name was Mohammed Basheeruddin. The counsel claimed that the current accused obtained his Indian passport in 2016 and since then has never travelled outside India except Kingdom of Saudi Arabia.

Karnataka high court directs reporting & verification of foreign nationals
Bengaluru: Through an interim directive, Karnataka high court has instructed the additional chief secretary, home department, to issue a govt circular/notification by June 18 to various entities — including educational institutions, medical facilities, employers, state police, local authorities, intelligence bureaus, district collectors, and police commissioners — concerning foreign nationals. The mandated circular shall stipulate that all interactions with foreign nationals must be promptly reported to the Foreigners Regional Registration Office (FRRO) in a designated format. Additionally, all current foreign nationals affiliated with these institutions require audit and verification. Regular status updates must be submitted to FRRO and state police. Justice Suraj Govindaraj noted that non-compliance would result in civil, criminal, or administrative sanctions under the relevant laws. The court was addressing a petition from six Syrian nationals, residing in Banaswadi, Bengaluru, requesting visa extension after their permits expired in 2015. The petitioners are also requesting refugee status. "The phenomenon of overstaying by foreign nationals has emerged as a significant concern.
