Andhra Pradesh high court pulls up police for violating norms in arrests and summons

Vijayawada: Police are often violating norms while arresting the accused and summoning witnesses, the high court observed, while warning that it will not be a mute spectator if police continue to stifle
personal liberty
and freedom of individuals.
If police are not taken to task, this kind of incidents will continue to recur, noted the bench comprising Justices R Raghunandan Rao and K Manmadha Rao during the hearing of a
habeas corpus petition
. One Meka Venkatarami Reddy had moved the HC contending that his relative, retired police officer T Balasubrahmanya Reddy, was abducted by unknown persons. He sought directions to the police to produce him before the court.
The HC earlier asked Balasubrahmanya Reddy to appear before it after the prosecution said he was summoned by the special investigation team (SIT) probing the alleged liquor scam. On Monday, Balasubrahmanya appeared before the high court and stated that police came to his house to issue notices to his son, Eswar Kiran Kumar Reddy. He further said that police took him to Vijayawada after he told them that his son was not staying with him. He also mentioned that a DSP rank officer abused him during the questioning.
Taking a serious note of his submissions, the bench asked the prosecution under which section he was summoned. The bench also questioned how a father could be taken into custody if the son is not available. "When section 179 of BNS categorically prescribes that persons above the age of 60 and those suffering from health issues should not be summoned, how can the police ask Balasubrahmanya to appear before them in Vijayawada?" the bench asked, and directed the ASP of SIT to give a written explanation for the violations committed.

The court further directed the SIT not to summon Balasubrahmanya again. Even if his statement is required, only the investigation officer should visit his home for recording the statement according to law, and no other police officer should go to his house, the high court said.

Agency: PTI Last Updated: Kochi, Aug 20 (PTI) The police have named a couple as accused in the case of a 46-year-old woman who died by suicide after they allegedly threatened her over money lending in Kottuvally in Ernakulam district, a senior officer said on Wednesday. On Tuesday, Kottuvally native Asha Benny died by drowning, a day after she was allegedly threatened by Bindhu and her husband, Pradeep Kumar, who live in the neighbourhood. Relatives of the deceased alleged that Asha had borrowed over Rs 10 lakh from Bindhu, who demanded a high rate of interest. However, despite repaying more than Rs 20 lakh, Bindhu and Pradeep continued to demand additional money, a relative said. Distressed over the situation, Asha first attempted suicide by injuring herself. Following the incident, Asha and her family approached the police, who held discussions with Bindhu and Pradeep, a retired police official. However, after the discussion, Bindhu and Pradeep allegedly went to Asha's house on Monday night and threatened her again, Asha's husband, Benny, said. On Tuesday, Asha was found dead in a river, and police later recovered a suicide note from her house. Speaking to reporters, Ernakulam Rural Police Chief M Hemalatha said that a Special Investigation Team (SIT) had been constituted to probe the case. 'The SIT has been formed under the leadership of the Munnambam DySP. As it is the first day of the investigation, we are completing the preliminary procedures. A detailed investigation will be conducted in the case. We have amended the charges and included the offence of abetment of suicide," Hemalatha said. A senior police officer said a report had been filed at the magistrate's court to arraign Bindhu and Pradeep as accused under the offence of abetment of suicide. The officer added that fresh charges were included on the basis of the suicide note recovered from Asha's house. Hemalatha said the financial transactions between Asha and Bindhu were being scrutinised and that investigators would also examine whether Bindhu and Pradeep had engaged in illegal moneylending activities. Meanwhile, Benny, the husband of the deceased, said he had only recently learnt that his wife had borrowed money. 'Asha had attempted suicide earlier, and only then did we realise she had borrowed money from Bindhu. She told us the money was borrowed in instalments for house repairs, medical expenses, and purchases for her small-scale textile business," Benny said. According to him, Bindhu and Pradeep had threatened Asha on three recent occasions, and she was deeply distressed on Tuesday before she took her own life. He added that his family was expecting a fair investigation into the case. Asha's body was handed over to her relatives after the post-mortem on Wednesday. She added that she was initially in shock but is now recovering and urged well-wishers not to visit her, promising to return to her duties soon. 'Naturally, I was in shock after this attack, but I am now feeling better. I request all my well-wishers not to trouble themselves by visiting me. I will soon be seen working among you again.' Her office described it as part of a "well-planned conspiracy to kill her". Police officials said the assault was serious and could have been life-threatening. The accused, 41-year-old Sakariya Rajeshbhai Khimjibhai from Rajkot, Gujarat, has a criminal record and was previously booked in five cases, including a knife attack, police said. He was detained immediately and is currently being interrogated at Civil Lines police station. Delhi Police have registered an FIR under sections 109 (attempt to murder), 132 (assault on a public servant), and 221 (obstruction of public servant). Authorities said Sakariya arrived in Delhi two days prior, carrying out reconnaissance near the CM's residence and her camp office. CCTV footage captured him in the area, and his mobile phone, seized by police, reportedly contains videos of previous public hearings.
